a man came into a store around 3:30 this afternoon. with a knife. he attempted to rob a clerk. that clerk had a gun near by and police tell us he took that gun and shot that person in the head. that person has been taken to a near by hospital where he is has life threatening injuries we're told by police. we did have a chance to catch up to the clerk's brother. to say. >> my brother told me over the phone, he says, the guy walked in behind the counter with a knife, i didn't even want to stop my brother throughout the store. my brother, he had to do what he had to do he shot him. now, again, that was the clerk's brother. again he said that his brother very shaken up right now. he has a wife pregnant with twins at home.

out what was going on. >> jamel lanee live for us. thank you. and following a weekend shooting incident. a homeowner in pinellas county shot and nearly killed an intruder in his backyard barn sunday afternoon. the homeowner said he fired a warning shot first and ordered him to get off his property. but the intruder attacked him instead. so he gave the warning shot, a verbal warning but it resulted in a shooting. >> reporter: he said he told him about 15 times. we found out the intruder apparently has some sort of mental problems that's grandmother. she reported him missing and in danger just houred before this shooting sunday. and he disappeared from her house five days earlier.

as a mar -- marine and is proud of it. >> he served in the marine so i know he's going to protect himself. >> reporter: but he says he's not asking for a conflict with anyone. and when this man showed up in his backyard. things turned violent very quickly. dundee says that he fired a warning shot but desmino lunged him. that's when dundee shot desmimo one time with his firearm. >> i think he did a great job. i commend him, i really do. >> reporter: no one answered the door. neighbors say he's an odd ball who comes and goes but never seemed dangerous or threatening to them. we've been trying to reach

his son tells me he left on a preplanned trip around 5:00 this morning and that's why he's not home. we also spoke to a former prosecutor turned defense attorney vanessa albaum, and she tells us based on the fact she does not believe this guy is going to face any charges for shooting that intruder based on the facts again that we know so far in this situation. keith. >> mark you said the neighbors describe him as an odd ball. what else do we know about this jacob desemond, does he have a criminal history? >> yeah, we dug up his history. he's been charged with aiding a run away. nothing violent, nothing like this. he is in bay front hospital expected to survive. no charges fired against him yet either in this case. detectives are sorting all of this out trying to figure out

he's not going any where with that bullet wound in his stomach. >> hopefully when he heals he will get help. governor rick scott toured areas of southwest florida that were damaged when a tornado touched down this weekend. the ef2 tornado rolled through cape carol saturday night. winds reached up to 135 miles per hour and scattered debris for about 12 square miles. several homes were damaged and about 10,000 people lost power. no deaths or serious injuries have been reported from all of this though. a scary start to a new semester for one usf student. a man grabbed her and kissed her in the cheek at the parking lot of green village there. and the airport was busier

from the bay area that is giving this legislation real teeth. >> reporter: meet patti, patti made national news when it was spared by a judge after he pursued a boy into a corner. state law calls for a dog who be put down. >> this gives an opportunity for the owner to say to appeal and say let's look at this. let's really look at the details here and let's make the right decisions. >> reporter: patti was spared when a sarasota law ruled the judge unconstitutional but it's still in effect in most of the state. under the current law a dog biting someone is automatically considered in the wrong. this legislation would change that. animal rights activists and lobbyist jack coy says if he feels threatened and shoots someone he's protected by stand your ground. >> however if my dog is with me, and my dog feels threatened or if he feels i'm threatened and he attacks you then the dog

dry air. high above in the atmosphere. so big reason why we have the pure blue skies here today. current temp we have the north wind here at 5 miles per hour. again a very nice evening but obviously with the temperatures that cool and the sun is still up we're going to expect a very chilly night. as a result the national weather service which did have this freeze warning in place for leavy county, marion county points north did include some counties in the coastal area. inland areas away from the coast that's where you have to look for the possible freezing temperatures during that time. coldest air of the season here the coldest night here this season is 47 degrees. forecasting 42 tonight. this would be the coldest air of the season.

these low temperatures 45 degrees. tampa 42. cool temperatures if you're going to be out and out for a long period of time you might want to bring a jacket because it might sneak up on you, those temperatures will the fall very quickly. lots of sunshine to start the day at 7:00 a.m. again you see those temps are cool now. st.pete 50. up in weeke washee. you don't want to be there. it's much too cold. the flow around that high is generally from the north that's why the freeze warnings are in place for southern georgia and northern florida. clouds primarily down to our south. that high pressure will continue to dominate and the flow around that high will give us a northeasterly wind for tomorrow that tends to be a milder flour. - - flow. with the position of the high that keeps us cold. an area of low pressure approach the area with rain chances and yo u can see that area of high pressure does shift a little bit.

so it's going to keep us on the cool side of that high for several days. 64degrees for tuesday. same number for wednesday. we stay fairly cool thursday 69 degrees. there's the rain chance, again the timing on this can change. but our thinking is later thursday and the late part of friday. temperatures warm up for a little bit there. friday and saturday, but another cold front sends us into the cool category it's sunday and monday too. for those who have been wanting cool air and didn't get it in december, there you go. >> enjoy. >> thank you steve. get ready the price of gas is changing. >> and we think you're going to like it from now on. and how low the experts predict the prices will plummet at the

the new test uses a technique that uses blood biopsi that scans for cancer dna. the ride sharing company uber announced in a blog post that it will be cutting ride prices and it includes tampa. it's something uber has done in the past after supply and demand after discovering supply for demand dropped. not clear what kind of discount you should expect but uber is hoping the price cuts will pull you off your couch and get you out there riding some where. all right rumors of an apple car are starting to heat up. the apple giant is registering apple. car and other domains suggesting they're thinking about building a car. how about that. >> always have something going on. we have a couple of stories
