here earlier this month. when the passenger in the car started mouthing off, he was arrested. deputy bearden told the sheriff that thompkins holmes grabbed his gun while cuffed. >> the angle the deputy was at and is the angle that thompkins holmes was at, he was able to reach and is put his hand around the side and grab the deputy's gun. >> reporter: now the sheriff explains that couldn't have happened. >> in order for this to have happened, he has to have taken his hands, come around like this, been able to, while handcuffed, do this, do this, do this, and then get the gun out. didn't happen. >> reporter: deputy bearden shot thompkins holmes twice.

bearden told investigators he felt thompkins holmes could kick, wound, or injure him. the sheriff does not believe man. i was hoping for a word from the former deputy. >> he's not available. >> is there anyone with the family that might be able to speak? >> nope. nope, we have no comment. >> reporter: i did reach out to thompkins holmes as well. but a man who answered the door told me his attorney advised him not to comment. deputies released their former colleague from a jail here after he post the a $2,000 bond . coverage from the impending caucuses in iowa. keith cate has had a very busy day. he has this update.
