>> right now on newschannel8 at 5:30. a sneaky cop gets busted snooping through a woman's driver's license information for his own use. now that cop is out of a job facing much bigger trouble. >> good evening everyone. i'm josh benson. >> i'm jennifer leigh. thanks for joining us this evening. the former sarasota police officer gave that private information to his brother and what his brother did with it is where things get really complicated. john rogers joins us live. john, this officer has resigned

>> reporter: oh, he is facing some big trouble jenn. the officer is lieutenant ken castro. he gave the information to his brother and his brother committed a crime. this is a violation of castro's authority. lieutenant ken castro was a beloved and respected public servant both inside the sarasota police department and out in the community. but according to these documents obtained by newschannel8, back in october, castro used law enforcement resources for person use. records show he looked up a woman's drivers license information and gave it to his brother who then trespassed onto her property and caused damage. >> it is important that law enforcement officers take this seriously. because, we have a right to privacy in our person day is a. when that privacy is breached it can have very negative consequences. >> reporter: castro was trained and knew this was illegal. according to florida statutes, law enforcement may access this

purpose of carrying out official functions. after the investigation began, castro resigned from the force on october 25. he is now facing a criminal charge for misuse of confidential records. >> my name is john rogers with newschannel8. >> reporter: we reached out to castro, but he did not respond to our requests for comment. legal experts say his story could serve as a lesson. >> hopefully, other law enforcement members in the community will understand that the significance of maintaining their responsibility to maintain our privacy. >> reporter: as the criminal investigation moves forward, the sarasota police department is conducting an investigation of its own. because of this, the police chief could not comment at this time. back to you. >> well john, have you spoken to the woman who had her address shared? >> reporter: i did speak with her this morning. the woman who is in her 70s says she is fearful in her own home and she feels that this

>> so disappointing. all right, john rogers, thank you. tonight, police in orlando are retracing their steps in the search for a missing newborn. investigators had several dumpsters towed away from an apartment complex. the woman of a child admitted she discarded her baby after giving birth on monday. >> this should have never happened. and the way that it happened is disheartening. and, we really hope that we can find the baby. >> the detectives are now searching a field and area around a retention pond and underneath bushes for any sign of the baby. the mother is currently locked up. tonight, fire investigators are looking into what sparked a house fire that killed four children in the florida panhandle. the mother and her 14-year-old daughter escaped but the children who died were 11, 5, 3, and 11 months old. there were no working smoke detectors in the home.

started from the water heater. today osha released its report from a deadly tent collapse in a bay area business. the tent owners are held liable. it collapsed in new hampshire last august. two people died. they found 14 serious violations including not using the proper tent stakes. osha is recommending a $33,000 fine. criminals who can't buy guns always seem to find a way to get them. after a spike in violent crimes, the hillsborough sheriff's office has had enough. this is a specific area they are focusing in on. >> reporter: most definitely. it is between i-275 and bruce downs and fowler. that area is known as the box. it is also an area that saw a dramatic rise in the murder rate over the past two years. the sheriff's office was

the hillsborough county sheriff's office hosted operation gun box. 73% of those homicides resulted in firearms. we felt we needed to get out there and protect the community. >> reporter: so undercover deputies carried on a four month long sting operation trying to buy as many illegal guns as they could. they bought 20 stolen guns. >> we trace the guns and find out they were stolen. but because the owner didn't have the information provided to the police, they could be entered as stolen. >> reporter: arrest warrants were issued. 65 people. some of them have been in trouble for the law before. >> if you possess a gun and you should not, we are going to come after you. and we are going to be as strict as we can be. the rest of the community deserves to be able to walk around safely without fear of gun violence.

guns, deputies also recovered all sorts of drugs ranging from cocaine, marijuana, to meth and heroin. but the guns put the deputies at the most risk. >> we ask them to go into a situation where there is a gun. we are trying to buy firearms or drugs so the gun is ready. >> reporter: now most of those arrested are facing state charges. eight of them are charged with federal offenses which would land them behind bars from anywhere from 5 to 40 years. >> serious penalties there. josh thomas live for us, thank you josh. the florida teen arrested for posing as a doctor could also face charges of grand theft. police say 18-year-old malachi love robinson was accepting patients and performing physical exams. authorities say he defrauded an 86-year-old woman as he treated her for severe stomach pain.

and forged her personal checks during home visits. love robinson says just wait for the truth to come out. >> i am deeply saddened and a little disrespected by some of the things that have come forth, but i will say my attorneys are working hard. they are working around the clock to make sure this issue gets resolved in the best way possible. >> he is currently out on bond. florida lawmakers have come to an agreement on how many jurors it will take to sentence someone to death. the house voted to require a 10- 2 vote for a death recommendation. mike vasilinda explains what that all means for the legal system. >> reporter: before the u.s. supreme court ruling, seven out of 12 florida jurors could recommend a death sentence. that changes dramatically. it will now take at least ten jurors for death.

a unanimous jury. >> there were cases in the past where we went with this, that they would not have been prosecuted and it was some pretty serious cases. >> reporter: it was criminals like ted bundy who got death on a 10-2 vote that prompted the change. >> what do you think will happen with the higher threshold? >> as intended i think it will reduce the amount of people who go to the death penalty. >> reporter: since the year 2000, nearly half of all death sentences had 9-3 or lower. they had been pushing for a unanimous jury as well and view the compromise as a big step forward. >> this will prohibit a judge for turning over a recommendation for life without parole and making it a death sentence. >> reporter: ross spano shepherded the bill through the house. >> all 12 jurors must decide there is one single aggravating factor to justify the death penalty. >> reporter: florida never

it is why the high court said the death penalty was unconstitutional. the legislation doesn't address what happens to the nearly 400 people already on death row. that decision will likely be made by florida's supreme court. in tallahassee, mike vasilinda, newschannel8. >> and as of this morning, there were 389 inmates on death row. the legislation would be voted on by the senate and sent to the governor as early as next week. let's check in on some breaking news. a 16-year-old boy is critically hurt after a helicopter crash near the uss arizona memorial at pearl harbor. these images come from an eyewitness video on youtube showing the helicopter going down in the water. we are told five people were on board. faa investigators are on their way and the ntsb has been notified. tours to pearl harbor and to the memorial have been canceled because of this crash. you see it there again. we are monitoring this situation and we will bring you

now, to a preview of an 8 on your side investigation. we are working on for 11:00. there is major fallout for a company at the center of thousands of construction defects. shannon behnken is here and shannon, you broke this story nearly four years ago. you have been working on this a long time. >> reporter: we have je nebraska and this story is very near to my heart. we received piles of letters in 2012 for people begging for help. we found balconies falling off. walls that didn't have enough nails to hold them up. florida's attorney general took notice of our investigation and they did their own investigation. last week, they came up with a big settlement. now, we are going back to willow brook to find out what it looks like now. there are still a lot of questions here. like what happened to the building inspection? the attorney general mentions a lot of violations. why didn't the inspector's catch it? >> yeah. an i mean that is exactly the question.

73 degrees over the dew point of 41. 69 degrees in saint petersburg. east wind at 13 miles an hour. a little cooler because of the easterly winds coming across the bay. so if you will be downtown saint pete tonight, keep in mind you will need a jacket if you will be out a little later. high pressure dominates the southeast. we have a northeasterly flow. kind of make out how the clouds are moving in a south and slightly southwesterly direction. a few of the clouds reaching the east coast. maybe as the day goes tomorrow, a few of the fair weather clouds may develop across the peninsula as we start to add more moisture into our atmosphere. clear skies, comfortable temperatures for us. these clouds probably not around too much. not expecting much in the way of fog though it may happen toward the weekend. temperatures cool down and we start to see some fog. but the air has been dried up not to produce much fog near the next 24 hours. average temperatures tomorrow afternoon. a few clouds around.

as we go into saturday morning starting the day. mid 50s looks like. another beautiful day in the afternoon. mid 70s for us. a lot of sun and clear skies. more of a southeasterly flow sunday. that will make it warmer with near 80 degrees in spots. mostly inland spots. low temps chilly. still upper 40s . land of lakes. 5050arcadia. highs tomorrow similar to today. you can see 70s on the map. so enjoy this one. spring training getting underway with the pitchers and catchers reporting. they have to love this weather. 73 friday. 75 saturday. 76 degrees for sunday. and, the temperatures along with the rain chances increase a little bit. the rain chances come back as we get into tuesday, wednesday, we think the bulk of the rain likely will be on tuesday. we have a slight chance early wednesday depending on when the timing holding up for the day.

>> now to what is making headlines across america. after an alabama school bus driver got all the students off the bus, the entire bus went up check this out. on camera. incredible video. the driver had noticed smoke coming through the front of the bus. that is when she rushed all 15 students out. a witness noticed the flames >> and we could actually feel the heat from the bus burning. then it just all of a sudden went through the engine and the whole bus engulfed in flames. >> now, there are questions about whether that bus should have ever been on the road in the first place. mechanics were working on it hours before the fire which started in the engine. a woman with a long history of sneaking onto planes is back at it again. 64-year-old marilyn hartman was arrested in chicago.

from airports but she has tried without a ticket. and this is probably the all day. a woman is facing charges for biting a wendy's employee for getting her food order wrong. 25-year-old love lee robinson isn't looking so lovely anymore after throwing hay makers where they took the hot fires. now, the manager on duty claims robinson stormed inside cursing and came across the counter and attacked. >> she clamped downright above my kneecap. i continued to punch her because she was biting me. >> as you can imagine, robinson is charged with several crimes. newschannel8 5:69 o'clock is coming up next. it was a horrific scene. a hail of gunfire at a tampa nightclub. >> one of the victims was
