sorry? well, for failing to timely notify people living near its new wales plant in mulberry of a sink hole that sucked hundreds of millions of gallons into the aquifer. steve andrews broke the story last week and he is back tonight with an important update that includes that overdue apology. >> reporter: keith before i get into that, let's show you what the sink hole looked like five days ago and what it looks like today. this is what thursday as we flew over on eagle 8 hd. this thing developed under a gypsum stack. it is round, circular, about 45 feet across at this point, today, this hole is getting bigger. it is widening. it appears as though the walls are eroding, cracking, separating. i looks as though it is about to collapse. now, florida's department of environmental protection claims

but, the guardians of our environment have been dead silent about this. all of this. from the get go. so, who is watching to make sure that contaminated water that fell through this massive sink hole is kept out of our water supply? mosaic apologized for not being up front. but after sitting for 19 days on information about millions of gallons of radioactive water dropping into the mosaic admitically has trust issues. >> is anybody going to be fired for not coming forward? >> that would call for speculation we are not getting into. >> reporter: polk county became aware of this sink hole september 9. it failed to notify the public too. >> did you do enough? >> as far as notifying our constituents? the problem is what do you tell them? you know? we had ... >> reporter: possible danger

it was up to mosaic to make it public. >> the constituents don't elect mosaic. they elect you to the county commission. and, county commissioner as far as i know, the polk county government didn't let the county know. it is your responsibility isn't it? >> morally, yes. >> reporter: polk county does not have the expertise to monitor this hole, the leak, or contaminated ground water so it will rely on in large part mosaic. >> dep need to be giving us daily updates. >> and they haven't? >> no. no. we haven't heard from anyone. >> reporter: in tallahassee today, dep, the agency responsible for guarding our environment, couldn't risk deputy director gary clark away fast enough from our mike vasilinda. >> we can set somethingup later. >> no we cannot we have have try today reach you for days and you do not return our calls and you are avoiding this again. i don't understand why you

mistake. >> reporter: i like to know what that guy is chuckling about first of all. today's polk county commission meeting, the dep is also offering the test the wells of neighbors. but the dep is not talking. the governor today told us he thinks dep is doing a good job. but he believes in transparency. well, if he believes in transparency, how could they be doing a good job because they obviously have been anything but transparent. >> i don't know where to watching people running away from cameras hearing commissioners say what do you tell them? tell us the truth. what is going on in our neighborhood? we are talking about the wells being tested. when do we get results back from that? we want to trust mosaic, but where is the proof? >> that is the question. we could be getting results as soon as tomorrow. and if no contaminants are found, that doesn't mean we are in the clear because according to mosaic, this water moves at about a thousand feet per month

wells for some time. probably seven, eight, months, maybe a couple of years down the road to make sure this stuff has not gotten through. >> it is troubling. as you showed, the wall that perhaps could collapse in and make this hole even bigger. who knows what is to come. >> reporter: there is nothing like transparency in government and this is nothing like transparency in government. >> if you live near mosaic and want to request a water test, here is the number. (813)500-6575. again, (813)500-6575. we have also posted this number for you on our website, wfla.com. saint petersburg's mayor and head of public works faced tough questions about the release of sewer water into tampa bay. during a meeting with state lawmakers and the department of environmental protections, they revealed more than 248 million gallons of waste water were released. legislatures want to know why saint petersburg shut down a

consulting report that showed it could lead to problems. >> what is critical here is when the plant, when the decision was made to close the plant and the plant was actually closed, who knew about this report? because, this report came out before that date. um ... >> the plant was closed. >> right. >> mayor kriseman claims he was never shown the report. he is calling for an outside legal investigation to find out who knew and why they didn't >> a pasco county man is accused of hitting a 79-year- old school volunteer with his car on purpose. deputies tell us lawrence franklin refused to go in the correct drop off lane this morning. we are told franklin took his foot off the brake and allowed his car to roll into the volunteer who was trying to direct him. the victim had a minor injury. parents tell us it is daily danger for their children.

side for help worried that a terrible accident is just around the corner. a small sidewalk runs along the stretch of road in front of clearwater central catholic school. now, one mother says she sees students walking and riding their bikes in the street. 8 on your side east jamel lanee joins us now. she is live along the road. and jamel, what is the county saying about this potential danger? >> reporter: good evening stacie. well, the county says that there are road, but parents say it will be too late. anna constantine won't let her son ride his bike to school. >> they have absolutely no sidewalks to ride on out of the traffic. we can't share the road. there's no bike lane. >> reporter: the road stretches about a mile. there is a sidewalk in front of the school. but, we found these bicyclists and walkers in the street.

driver, they would beep at us. >> say they get out of the road. but where is there for you to go? >> nowhere. >> reporter: speeding cars, distracted drivers, constantine says it is an accident waiting to happen. >> a car is going to maybe, somebody is reaching and the core goes six inches off, onto the grass. and oops. >> reporter: we took our questions to the public works manager. >> when is a sidewalk expected to be built on this roadway? >> well, we 17. >> reporter: gregory catroni stays studies are currently being done on the road. >> we have to put in ramps and look at connectivity. we have to look at pedestrian safety. more importantly, the drainage has to be permanent. >> reporter: this project won't in the works until 2017, what are we telling parents regarding the safety of the child? >> i would say be patient with us. firstly. >> reporter: now, final design plans are expect today be

>> new tonight, sarasota county detective haves closed the books on a cold case that is more than 30 years in the making. we have to go all the way back to 1985 to see this man, allan doris walker paralyzing her. he was released on a promise to appear but took off. when walker died from complications related to the attack. detectives took another look at the case and found this mug shot from 1988 at a man named allen sherwood. looked like the same guy and it was. the fingerprints matched. he died of cancer in 2003. but the sarasota county sheriff says these investigators have

governor rick scott is asking for help from the president in the wake of hurricane hermine. he asked president obama make a major disaster declaration for florida providing federal resources to support the efforts. the request is for help for families impacted by the storm as well as far local governments. it is a project that means a lot to the future of tampa. >> we are talking about lightning owner's vision for channel side. we will show laid out and what is next for the area. i'm hillary clinton and i approve this message. i know more about isis then the generals do. john mccain, a war hero. he's not a war hero, he's a war hero because he was captured. i like people that weren't captured ok.

tampa. not a bad view overall. not much in the way of shower activity. you can see the radar's quiet little popup showers have developed around the eastern sections of hillsborough county. lake placid, south of debring. this area has broken out a little bit. not any lightning strikes at this point. right over brandon, just north of i-4, slowly drifting to the southeast. these are not substantial brief showers really: temperatures will stay warm. the average this time of year 89 degrees for temperature. that is what we will forecast the next couple of days. as for the evening 83 degrees. isolated rain will continue. you saw the radar. not too much going on. but we will leave that chance of a shower in the forecast throughout the evening hours. probably won't be a strong shower or thunderstorm. but it could be brief. at 7:00 a.m., 77 degrees, sun and cloud withs the small rain chance at noon. 86. a popup shower, feeling kind of steamy. and that 30% rain chance at 4:00 p.m. in the afternoon for tomorrow. similar day it looks like. but we are trending a little drier.

overall. 87 go. odessa, and river view. 86 in new port rich chief. 86 dade city. inverness, 84. 91 sarasota. lake tas id 85 degrees. a lot of sunshine around the area. a few popup showers. we didn't see the big thunderstorm activity on the east coast, so we the same outflow that helped to create late showers. the red color, drier air. mid and upper levels of the atmosphere. stabilizing things across the southeast. you can see not much going on in the way of weather at the moment. fairly stable atmosphere. some of that will filter its way further south, especially across the northern part of florida. the rain chances will drop the next couple of days and favor is southern spots because they won't be as dry high above. we have karl and lisa. two tropical storms out in the

into potentially a category 2 hurricane at the hurricane center. scooting off to the northeast. no effect it looks like at this point for the city of tampa, or tampa bay area. tropical storm lisa, 45 miles an hour winds. should have problems with dry air and wind shear, probably won't strengthen into much over the long haul. certainly won't affect the u.s. rpm forecast computer model. there you go. pretty quiet in the overnight in the morning hours. a small rain chance for us. and for tomorrow, chance, 30%, we will call it isolated showers and thunderstorms for the area. 30% for wednesday. 20% in the forecast for thursday and friday. that is a below normal rain chance for us. so, we will see fewer showers meaning plenty of warm temperatures. we have been getting near 90 degrees and the humidity seem to be quite high. the overnight lows are pretty warm. that is is a fall forecast for you. >> next week maybe. >> maybe. >> maybe. >> all right, thanks steve. the tampa bay heart walk is
