reason this woman said she and her dog deserve an apology from a restaurant manager. >> and shark bait, how the diver in this shark cave managed to escape close quarters with a great white. good evening. i'm keith cate. >> i'm jennifer leigh. thank you for joining us tonight. let's get straight to some breaking news tonight. one person is dead in what's being called a road rage confrontation near a busy brandon shopping mall and it happened before the sun even went down. news channel 8's paul mueller joins us the kings row shopping center and there were a whole lot of people around when this whole thing went down. >> reporter: a busy, busy place, a busy intersection and especially given the fact this happened around 6:30 tonight. i want to give you a good live look at the scene, but first keep in mind this happened 4 1/2 hours ago and this is what you still have left, 1 huge crime scene here on bloomingdale avenue and don't expect this road to be open any

this crime together and there is a whole lot of work to be done. all of this began a few blocks down the road from here where the victim and shooter apparently exchanged some words. i want you to look at some video from a short time ago, all this coming to a head right outside the shopping center right here again during rush hour. two cars stopped in traffic, one in front, the other in the back. the guy in the front car gets out, exchanges words with the guy that guy then shot and killed him. then get this. the shooter pulls off the road and waits for deputies to arrive. now while investigators work to dot their as and cross their ts they have a lot of witnesses to talk with including -- dot their is and cross their ts they have a lot of witnesses to talk with including the shooter. >> three or four quick shots, we're all sitting here like

the southbound lanes of u.s. highway 19. a young girl riding in the car was rushed to the hospital with minor injuries. now only one southbound lane is open. the driver who hit and killed a hillsborough high school student is out of jail tonight. he's defending himself. nicholas constantino walked out of jail this morning after posting a $15,000 bond. he says the victim seen here, 17-year-old ashley perdomo dartedut hillsborough avenue. he admitted that he hit her but kept driving. >> reporter: you know that you hit her? >> no. all i know is something hit my car. that's what it appeared like to me. >> reporter: why didn't you stop? >> because it took me like a couple blocks to stop and when i stopped, i didn't even realize what it was. all i knew was my window was getting cracked. >> when constantino filed an insurance claim to get the car fixed, his agent notified authorities.

furious over the way she was treated at a fast food service restaurant. >> she has a doctor's note that said she needs her dog. peter bernard is at the mcdonald's. i see these service dogs sometimes wear a little vest. did this dog have anything to indicate that she is a service dog? >> reporter: that is part of the problem. the answer is no, this dog did not have any kind of tag. the owner of the service dog has that doctor's note you mentioned. it spells out all about this dog, but the it was in her car. when elisha griggs leaves her apartment, you can bet her 1- year-old pomeranian is right by her side named onyx. she's either traveling in this doggie purse or in her arms. friday morning at this mcdonald as elisha ordered a drink at the counter -- >> they told me no pets.

for her and i said yes. >> reporter: they retrieved the paperwork from her car. >> they told me the paperwork basically wasn't good enough and they wanted to know what my disability was. >> reporter: elisha called the manatee sheriff's office. the deputy told already mcdonald's had to let her in. did you go back? >> i went back and got a drunk -- drink just to prove a point. >> reporter: the mcdonald's rep called the incident a misunderstanding. the company issued a statement our restaurant with service animals. we have reached out to the customer to resolve the issue. elisha isn't looking for money or food coupons. she did get a phone call. >> honestly i would like a real apology from her. i kind of felt like that's kind of owed to me. >> reporter: elisha could get a small dog tag to inform people that onyx is a service dog. she told me tonight she just might do that. >> well, we saw that graphic there with the mcdonald's

mcdonald's does allow service animals. >> reporter: absolutely. that's the law. they have to. they did suggest, though, and the suggestion is they didn't know that this was a service dog. there was no vest. there was no tag. so perhaps elisha will do that and that will avoid any confusion in the future. >> peter bernard live in bradenton. thank you, peter. well, more women are coming forward accusing donald trump of sexual assault, but the nominee is focusing solely on the election. a former contestant on the apprentice claims trump made unwanted advances to her. she was looking for a job after season five ended and met with trump in new york. they was taken aback by what happen next. >> as i was about to leave, he kissed me on the lips. this made me feel nervous and

tapes of trump's lewd comments from 2005. donald trump is using his time on the campaign trail to deny those allegations and vow to prove his innocence. he kicked off a rally in greensboro, north carolina, today by showing off members of his women for trump coalition. the campaign has not yet specifically responded to the claims just made in that press conference. more revelations tonight from hillary clinton's e-mails, they show that she did not want her husband to pull out of a speech in front of bill clinton was set to speak a few days after she planned to announce her presidency. according to the e-mails, hillary clinton's aides had to change her mind concerned the clintons would appear too close to wall street banks. don't forget, i am heading to las vegas next week for the last presidential debate that takes place wednesday. be sure to tune into news channel 8 for our live coverage of that. a small beach town in oregon is doing something they never expected to do.

devastating tornado. jen holloway joins us now live from our tampa news center with a look at where things stand right now. >> a state of emergency is in effect now in manzanita after two waterspouts moved onshore and thankfully no lives were lost. imagine looking out your backdoor and seeing this, a tornado strong enough to rip apart neighborhoods. this video captures the beginning of the destruction as it was happening in the act. it was taken by connie ward. she later admitted even th still says it was way too close for comfort. in other video from the down town area emergency crews were quick to respond especially for downed power lines. this one in particular was causing concerns as a shred of metal dangled from the electrical wire. thousands are still without power. the storm also blew debris through windows leaving shards of glass behind as well and
