down near pinellas high school right now. >> a ruling by the supreme court saying the death penalty is unconstitutional. the potential price tag for taxpayers. i'm wendy ryan. >> the u.s. supreme court says that florida's death penalty gives too much power to judges and not enough to juries. >> that's right. sarah rosario is live outside of the courthouse right now. >> reporter: yeah. so we learned that many of the cases could end up being retried right in these very courtrooms. that could create a big bill for taxpayers. it's unclear at this point exactly how much that could cost. but we learned that is not the only thing that may happen. >> reporter: a jury convicted of hurst of stabbing a coworker to death in 1995. a jury recommended execution in

unanimous vote to sentence someone to death. but in florida, the judge was able to decide on the death penalty for hurst. he brought it to the supreme court who ruled that it is not constitutional. >> the judge cannot change it. >> reporter: now juries will be more empowered to decide the maximum penalty, not judges. but that could also affect 400 florida inmates currently on death row, creating a potential mess in our courts. >> there will be a number of people where the sentences will have to be reheard. >> reporter: the state will have to go through every case and decide which ones to retry and which ones to commute. there will be inmates challenging their own death sentence. but steven crawford thinks it's necessary. >> we want a jury to make the decision, not an elected or appointed judge. that's what the case is really

that ahead of our next strong front coming up in a few minutes. >> thank you. a teenager will spend the next three years behind bars after pleading no contest to a dui manslaughter. jennifer was just 16 years old. her blood alcohol level, .13 when she ran a red light, hitting and killing keith davis. today a judge sentenced her to five years in prison for credit for time already served and five years of probation. the victim's girlfriend susan blaine still visibly shaken there two years after his death. she spoke to us right after the sentencing. >> he would give the shirt off his back. i miss him. we were together like i said 17 years. and that's a long time to just be gone in a minute.

ripped apart and her life was turned upside-down. she accepts the judge's sentence and hopes to one day forgive her for her boyfriend's death. and a pinellas county teacher is out of jail on bond right now. kevin timmons is facing charges of dui. he was driving down the wrong way when he was pulled over. he performed poorly on field sobriety tests and admitted to taking prescription medications. but he registered a .02 on the blood alcohol test which is below the legal limit. covering citrus county tonight, a bay area community says their one-stoplight town is a drug pen and they will do whatever it takes to take it back. methamphetamine may be behind it all. >> reporter: this latest house

ma i see as an eyesore for this town. but residents say it's symbolic of something much bigger, an epidemic of methamphetamine manufacturing and use. >> i don't know how many kids have got to die before they will actually try to do something to stop this mess. >> reporter: walk around the area and seemingly everyone here knows someone using meth or has lost someone they love to the drug. >> we didn't neighboring it. we had help. we had people against us on her getting the help she needed. and this town was part of it. >> reporter: laura's stepdaughter overdosed in 2012. they found her in an abandoned trailer with no electricity or water. angela was just 41 years old. her death, just one of dozens.

i'm tired of seeing it now. i trust no one now. >> reporter: the town is splintered as squatters have taken over the homes. both suspiciously burning down overnight in the past month. amanda brown reportedly admitted to being a drug addict. >> manufacturers and meth sellers, no more than a cockroach or a rat to me. >> reporter: they are willing to do whatever it takes to take back their town from drugs. >> i've got a concealed weapons license which in my 60 years i never carried one. i do now. >> reporter: brown is now accused of arson. and the state fire marshall is investigating not only this fire but the other one last month. still, both of them deemed suspicious.

in istanbul, their popularity now fading. and owners abandoned them. they cost $1,800 per dog to bring them to miami. they were brought to florida from turkey by the golden retriever rescue. some states in the northeast under more than two feet of snow. and more is even piling on. part of the upstate new york area getting 34 inches of snow and counting. the winter mess causing chaos on the roads. a lake effect snow now spreading across the great lakes region from new york to michigan. and another clipper is moving into the northeast, bringing snowfall as far as kentucky. it looks like major cities like new york and boston will be spared this time. but the deep freeze adding a layer of its own on benches and cars. >> you can't really think anything. it's just covered in ice. covered in water. >> right now many midwest states are also under a windchill advisory as temperatures drop to negative 30 in some places. that's cold.

historic building is now frozen in time after nearly being destroyed by flames. fire broke out at the building over the weekend. temperatures below zero though caused the water used to fight those flames to freeze. look at that. about 10 inches of ice now covers the building. incredible. all of that ice could cause the building to collapse. now the most accurate weather team in florida, abc action weather. >> chilly out there today. some folks thinking we could get ice of our even. >> we did. >> we did have frost out there in citrus and hernando counties. everybody else in the 40s. it warmed up beautifully. look at the cloud cover out in the gulf. i think those clouds will continue to stream across the gulf tonight. so that may keep temperatures up just a bit. but as we mentioned, if you look closely, it says ugh, frost.

there is a frost advisory in effect also for tomorrow morning. with temperatures expected to be down around freezing in our extreme northern counties. this morning, it dropped down to 28 in gainesville and tallahassee. you see where the coldest weather from. in orlando it bottomed out at 41. titan doppler radar is quiet. frost advisory for the northern counties for tomorrow morning. probably not as cold as it was this morning thanks to the cloud cover that i think will stream across overnight. temperatures right now downright chilly. we should be in the 70s this time of year. we only hit the 50s today. outside from tampa, mostly cloudy and 61 degrees. st. pete and clearwater, both clear. and right now in the upper 50s with the winds coming in off the gulf. again, we talked about this last night that. is very often the key to everything.

wind for that air to travel down land. whereas the minute we get more of a northwesterly flow, the air travels over the water which is warmer and usually keeps our temperatures up quite a bit. temperatures right now in the 50s and 60s. but you can see a little bit of the high cloudiness coming in. and the models, what we call our rapid refresh model is very bullish on clouds rolling in o'er night-- overnight. not only that, but a couple of sprinkles across the area tomorrow morning. i think the air is too dry for this. but this is an indication that if we get clouds, there's a chance that temperatures will be warmer tomorrow than it was this morning. that is definitely something that we will be watching and have the update tonight at 11:00. outside of that, again, tomorrow just a lot of high clouds. you may begin to see one of the

sunlight refr acs from the ice chris -- reflects from the ice. if you look at the pattern, here it is. clouds thicken through tomorrow into thursday. and then there comes low pressure. now, i do think there will be an area of strong and maybe even severe storms somewhere on the west coast of florida. but it's too early to tell right now. it all depends where the low sets up, where the energy is the strongest. so we will watch this. it's not something that i'm overly concerned about. but just in case, friday definitely the day where we have to worry about showers and storms. whereas saturday we clear out and maybe another chance of a few showers on sunday. northeast winds for the boaters at 10 to 15 knots. gulf temperature in the 60s. there is your sunrise and your sunset. clouds thicken overnight and into tomorrow. keeping it dry for the time being. rain chances are highest on friday. then on sunday, another chance of rain.

as we cool off again early next week. all right, thank you, dennis. we want to take a look at the backup on the howard franklin bridge. you're looking northbound on 275 there. the northbound lanes from the pinellas bridge to the howard exit even through downtown backed up at this hour. we're told that multiple small accidents are to blame. avoid that area if possible. if you know anyone coming home that way tonight, give them a heads-up and expect them to be late tonight. abc action news at 5:00
