we told you about as breaking news yesterday morning. one person is still missing and sadly police say they have little hope of finding that person alive in the wreckage. officers report 88 people were injured in the crash, nine seriously. authorities say it appears the two-passenger trains collided head on without braking. right now they are trying to determine why a safety system designed to automatically stop trains to prevent crashes likes this didn't work. both trains' black boxes are recovered and are now being analyzed. a family's beloved dog attacked and killed at a boarding facility. we found out the owner of the operating illegally. >> according to code enforcement officials. michael paluska spoke to the business owner that claims she can't be shut down. >> reporter: kayla, a 4-year- old terrier's owner says it's too late to save her but hope telling their story could save other dogs from a similar horrific fate.

they had both been killed, it would have been beyond words. >> reporter: code enforcement will shut -- michael paluska, abc action news. 4:36. the zika virus continues to spread around the world. china reported its first case of zika in a man who recently traveled to venezuela. chinese health officials believe the virus is unlikely to spread now in china due to cold temperatures and lack of mosquitos. here in florida the state is receiving nearly 1,000 extra kits from the cdc to test for the zika virus. governor scot says all 16 of florida's zika cases are travel- related. scott is also asking the cdc for more training to help florida hospitals identify zika symptoms. the spread of zika causing concern among olympic athletes including hope solo. she tells swill if she had to

if she had to make a choice she would not go to the olympics in rio. this morning the u.s. department of justice is not happy with the city of ferguson, missouri, that city at the center of riots following the police shooting of an unarmed man black man 18 months ago. last night the city council voted to except justice department recommendations to reform its police and court systems but with conditions including limiting the cost to ferguson. justice officials call those conditions unacceptable and says it will take legal action to make sure the city complies with the constitution. hundreds of parents upset their children may be forced to change schools due to overcrowding are now taking action. >> hillsborough county is proposing rezoning which neighborhoods go to which school. >> as abc action news reporter marisela burgos explains, parents met with district officials last night to make their own rezoning proposals.

4:43. yesterday morning we showed you the damage on the royal caribbean cruise ship hit by hurricane-force winds. now the ship's captain is telling his side of the story. the anthem of the seas ship master claims the weather forecast he received wasn't "anything near what we experienced." that is despite the national weather service issuing an alert on friday. passengers captured video of furniture toppling over and massive waves from their state room windows. >> it developed so quickly. that is the special thing you know. the it became so intensified. in 24 hours it moved from being this to what you see here. >> the cruise ship is expected to return to its new jersey port by tonight. right now four sailors competing in this week's olympic qualifiers off

in the summer we're all in the low 70s. that's what florida can do in february. we can also get pretty good rains. now nothing, low clouds, you'll see a little sunshine but not much early on. then we'll get back into full sun by later today. no rain today. i think we're in pretty good shape. in fact the wind will begin to subside. the only thing we have to work on, the temperatures, still cold later today. only in the 50s. then really chilly as we head tu tonight as we clear things out and begin to talk about temperatures that are going to fall back into the 30s and low 40s. 62 thursday. friday around 70 degrees. look at the forecast into the weekend, milder certainly saturday but then another cooldown on the way beginning sunday. let's look at the morning commute. this is i-275 at ashley drive. no problems out there. of course janelle is checking traffic cameras. she'll tell you what the other bay area roads look like in a minute.
