safety harbor with the new developments. >> reporter: dan, i just got done speaking to the homeowner of this house, a young woman who says she and her boyfriend were asleep at the time, they heard a bang and then glass shattering. they thought someone was breaking into their house. instead they walked outside and saw a car into the side of their house but no one was in it. pinellas county deputies say after 1:00 stolen vehicle slammed into the side of this house and a driver and two suspects took off running. within minutes they had the helicopter and canines on the ground and in the air searching for the suspects but they have all gotten away. the homeowner says her dogs were asleep on the couch, at the time of the crash, she and her boyfriend though, everyone is fine. a sign that the driver took out, much like a stop sign or slow school sign, a medal sign went flying flew the window. the glass went all the way across the house to their bedroom but again everyone is

bradenton with what is expected to happen later this morning. >> reporter: good morning. this is a neighborhood where this all went down, in fact this is the home here where all of this happened, county code enforcement tells us this neighborhood, this community in fact is not even zoned for this sort of business. a family's beloved pet is dead, the family wants answers and the county plans to be out here today to shut this business down. jim dwyer, owner of 4-year-old caleb the terrier says she was assured the owner of peter pan's sitting and boarding their dog wouldn't be mixed with the larger breeds. however it turns out it was not the case. that dog was put in there with a huge breed, a dobo argentino, a large dog that can reach up to 100 pounds, typically used for big game hunting. the larger talk attacked the smaller dog. the owner says the attack was tragic but simply a mistake and animals are unpredictable. if we can come back here live,

investigators believe a safety system designed to automatically stop trains to prevent crashes like this one didn't work. it's 5:38. this morning a florida man's so- called prank still getting attention now on our abc action news facebook page. we've been showing you the pictures you see here, that is an alligator. all week long, of that 3 1/2 foot gator tossed into the window of a south florida wendy's, the man behind the stunt says she's sorry. joshua james is out of jail but a judge ordered him to stay away from every wendy's. he says all he meant to do was prank a friend who worked at the restaurant and says he'll never do anything like this again. >> right now it's definitely going to be the last of anything that i do. just because, like i figured out, like, i'm really in trouble for this. i think my pranking days are over as of today. >> he's still facing an assault with a deadly weapon charge and has to undergo a psychological evaluation.

with any animal except for his mom's dog. this morning time is ticking before polk county school board members have to decide if the superintendent is in or out. they are meeting friday to leroy. we were there for yesterday's board meeting, the first time they came together since the investigation into her behavior became public. the associate superintendent harassment. rivers also claimed she became hostile when he refused her advances. the board members told us the drama is an embarrassment. >> it's my opinion that her leadership style is not appropriate for the polk county public school system. at this time i have lost confidence in her ability to continue leading. >> three board members in fact say they lost confidence in their leader. the superintendent avoided our questions but told the board she's sorry and wants to move forward. 5:39.

you probably noticed that. 50 degrees in tampa, less windy though and that is good news. more details coming up. weeks before spring breakers escape to the florida panhandle flames partially destroyed a popular beachfront restaurant in destin overnight. aj's seafood and oyster bar's thatched roof caught fire 6:30 last night and spread throughout the upper floor of the restaurant. there is some good news, the owner says that fire looked worse than it was. the lower floor suffered only minor damage and hopes to reopen as soon as inspectors say it's safe. this morning one of the popular toy hoverboards is blamed for starting a fire that destroyed this house you see behind me in nashville. firefighters believe the hoverboard's lithium battery started that fire. it started on the first floor, trapped two teens upstairs. the teens' dad said the 16-year- old daughter had to break a second-story window and jump out. >> i was kicking in the doors and thought i'm going to lose two of my four children today.

at her please jump baby, please jump. she jumped out the window without hesitation. i can't tell you how brave that was. >> after his daughter jumped out brian fox helped his teenaged son climb out with a ladder. both teens suffered minor injuries. firefighters say friends of that family also bought a hoverboard that also caught fire. only the hoverboards was damaged in that fire. the both families bought them from amazon. amazon is giving anyone who bought a hoverboard a full refund. this former catholic priest accused of killing a second grade teacher in 1960. 81-year-old john fite was arrested in arizona yesterday. investigators say he was the last person to see irene garza alive when she attended a confession in a church in south texas. garza was 25 years old at the time. he denies killing her but investigators say he told another former priest a different story.

that will set the stage for a very chilly morning that will -- won't be a wind chill but you have to deal with temperatures in the 30s, even low 40s as far south as tampa. we warm up a little by the afternoon into the low 60s. still a good 10 degrees below where we should be. on friday, the highs about 70 degrees as we head through the afternoon. then we'll kind of stay there by saturday, upper 60s. not looking for 80s any time soon or highs well into the 70s but we'll take that and then on valentine's day 64, with partly sunny skies. we're heading outside, corey dierdorff is driving around checking things out for us. he's on i-4 around malfunction junction but this morning it is functioning just fine. no crashes or breakdowns there. it's taking 20 minutes to get back and forth between lakeland and downtown tampa. we're also checking out your drive through pinellas county.
