that girl in sarasota. deputies arrested him last night. also tonight a new case of the zika virus just reported here in florida. this time in brevard county. that brings the total number of travel-related cases in florida to 22. meanwhile the world health organization says $56 million is needed to combat the virus and that will only last until june. also tonight a man who tried robbing a bradenton pharmacy got more than he bargained for. i'm jamison uhler. >> clifton french shows us the one thing that motivated a customer to take matters into his own hands. >> i wasn't trying to hurt anybody. i was trying to do what was right. >> reporter: it's video of a man taking out a robber at a pharmacy. it turns out the man's girlfriend was behind the counter. >> i was protect being the one that i love. >> reporter: it was 12:30 on valentine's day. he was at this walgreens on cortez road to ask his girlfriend what she wanted for lunch.

also on the campaign trail, south carolina's primary just a few days away and nikki haley is giving her endorsement. she stands behind marco rubio giving the candidate a boost. trump still threatening to file a lawsuit over cruz's latest ad. trump holds a commanding lead in south carolina over the other candidates. >> so donald, i would encourage you if you want to file a lawsuit challenging this ad, claiming it is defamation, file the lawsuit. >> senator mike lee will campaign with cruz in the morning and marco rubio in the evening. the family a worker killed while on a roller coaster settled a lawsuit. that case was scheduled to go to trial this week until the widow dismissed the lawsuit. a ride car hit him. attorneys for the family

couple who won part of the powerball jackpot last month. >> i guess it wasn't jamison. finally we meet the lucky couple that will split it with two other winning tickets. david and 70-year-old maureen smith. they opened a trust and claimed their prize in a lump sum payment of $328 million. maureen says she has played the same numbers for year but doesn't play consistently. they didn't realize until the next morning that they picked the winning numbers. >> oddly enough i checked the ticket. i said she is messing with me. she really is. >> the pair talked about how hard it was keeping such a big secret for more than a month and even kept it from their children. the florida lottery says the winnings should be in the bank in about two days. a popular tampa restaurant

>> developing tonight, over 200 violations, administrative complaints and 12 follow-up inspections in less than a year. >> wendy ryan joins us with why the state is coming down on a tampa staple. >> taking action for your health and your safety tonight. the i-team uncovered repeat food violations and i spoke to the owner to find out why. it's tonight's dirty dining report. >> it's good. >> yeah. definitely good. >> reporter: truck drivers rod baker and craig dawson has been eating at the sandwich shop in tampa for 40 years. >> they really know how to fix the cuban. >> why do you like them? >> i guess because they have real crab meat inside. >> reporter: state inspectors had a different opinion, writing up 226 violations in less than a year.

your recent inspection reports. you had quite a list of administrative complaints and follow-up inspections, stop sales, temperature issues. >> can you come back here, please. >> absolutely. >> reporter: michael's family has owned the restaurant since 1948. he says he is hands on, running the place 24/7. >> you've had a lot of temperature issues. these are all of the inspections. >> and we have corrected all of them. >> reporter: the temperature violations so severe a few months back that inspectors issued a stop sale on 30 pounds of bean soup, cooked green beans and black beans because they were cooled in dangerous temperatures. the state finding veg he's, cheese, breaded chicken, butter, cooked pork at temperatures that could make you sick. >> if you're not following the food code law and keep thanksgiving at the proper temperature that's a concern for the public, don't you think. >> it's a big concern for the public. we have done all of our issues with that. >> reporter: he didn't want to

the response so far has been overwhelming. if you would like to share this information, all of it is on our facebook page. now to taking action for your money. tonight dia riley shows us the tax credit that goes unclaimed but could help those that need it the most. >> reporter: a financial counselor helped yvonne file her taxes. she was able to get a refund of thousands of dollars last year by taking advantage of the earned income tax credit. she said the refund made a big difference. >> it helped a lot. i work hard but i don't make that much money. so it was -- it was a big deal for me. >> reporter: consumer reports toby stager says many qualify for the ashed income tax credit on the yearly tax return. >> if you're a low or moderate income worker this can give you back some or all of the money back in taxes. you might even get more. this can really impact your tax refund.

earned income tax credit you can collect depends on your income, marital status and how many children you have. a single person without any children making almost $15,000 a year can get more than $500. and a married couple with three children making almost $50,000 a year could get over $6,000 back. but too few people know about this tax credit. >> one in five households in the united states that is eligible for the earned income tax credit does not claim it. >> reporter: and for those unsure tax filers, yvonne's tax counselor has this advice. >> this is money they deserve to get back. that is something available for them. and they should actually claim it. >> reporter: you can find out whether you qualify for the federal earned income tax credit along with other available credits and deductions on the irs' website. to file for the earned income tax credit, you will need a

>> rays spring training starts in a couple of days. pitchers and catchers reported in clearwater. the pirates as well. that is the kind of weather you're hoping to see for spring training and spring training games. a lot of sunshine. that is something that we will here for the foreseeable future as titan doppler radar continues to be rain free. and it's going to stay that way. outside, tampa, mostly sunny. 73 degrees. and that's actually about where we should be this time of year. we top out at 75. that's a few degrees above normal. normal is 73 for the afternoon high. record 83 back in the mid '90s. i would not be surprised if we're up around 80 by sunday or monday of next week. st. pete, 69 and sunny skies. the dew point 54. we have a little drier front coming through right now. a reinforcing shot of coolish air. not even cooler but coolish air.

drop down the dew points and the moisture and helps us from having to deal with fog tomorrow morning. as foggy as it was today, it won't be an issue tomorrow. nor do i think it will be for the next several days. as we get visibility issues from this morning down near zero in some cases. by tomorrow morning, it won't be a problem. maybe the only exception might be extreme eastern polk or desoto. not enough to issue any advisory others. not like today with that report down to a quarter of a mile in some locations. satellite picture, beautiful day. futurecast, if you're going out this evening, clear skies. a little bit of a breeze. yeah a little cool for us. lightweight jacket or a sweatshirt is a good idea once the sun goes down and cools off. you have nothing to worry about in terms of rainfall. tomorrow morning, we start off

mid 50s away from the beach but it looks nice with abundant amount of sunshine. then the east wind means clouds over on the east coast. i don't think it will be strong enough to bring much into our area. you get a strong easterly wind in the wintertime, sometimes it can bring clouds and a shower across the state. that's not the case this go- around. i don't think it will be an issue for the daytona 500 either. by this weekend, the winds are going to come around out of the south. so that means usually while the humidities begin to rise, you don't have to worry about rain coming over the east coast. temperatures will definitely start to rise. around 80 degrees by later on sunday into monday. now, long-range forecast, as i said, we're dry through monday. tuesday into wednesday, that's when our rain chances begin to return. now, at this point, there could be the risk of another round of strong thunderstorms. it depends on what develops. area of low pressure near us.

>> i put that on my registry. >> he is having a baby. he bought all four of them. we want you to take a look at a video of a city council meeting in texas. it ended with the mayor getting arrested. >> mayor lopez was escorted out in handcuffs. he called police to arrest a woman for touching him. when they refused he left the building. witnesses say he then pushed the woman. this is the second time in the last few weeks lopez has been arrested. he was indicted earlier this month on bribery charges. a california woman accused of trying to kill her barber over a bad haircut. says she is not guilty. we first told but this story on abcactionnews.com. a week ago 29-year-old adrian swain returned to the barbershop in san diego with a gun and pulled the trigger three times. it was loaded but didn't fire. if found guilty she could spend the rest of her life in prison.
