andrea constand at his home. they hope to have 13 cosby accusers testify and use a phone call recorded by constand's mother. >> the call should come in. it's a call that was made into canada. and it was legally obtained there. we should be able to use it. >> reporter: cosby's lawyers trying to keep that evidence out of the case. wanting to suppress several days of testimony cosby gave in the accuser's lawsuit a decade ago where he acknowledged giving constand several pills and wine before what he c consensual sexual encounter. his attorneys claiming cosby is the victim of racial bias and prejudice saying he's already been tried in the court of public opinion. >> to accept the assumption of guilty by numbers or guilt by volume is really the same thing as accepting the assumption of guilt before innocence. >> reporter: danya backus, abc news, los angeles. hurricane newton is moving

causing damage and power outages. two people are dead and three missing after a shrimp boat capsized in the gulf of california. newton is expected to reach the u.s. border as a tropical storm by midday today. parts of arizona and new mexico will get several inches of rain with the threat of flash floods and landslides. this may send more gold diggers to california. a prospector found a gold nugget the size of a steak. it weighs about 18 ounces and could be worth melted down. >> he said t-bone steak, we think fill lay mignon. the prospector isn't giving interviews. the severe california drought has sparked a modern day gold rush with more gold diggers heading into the dried up riverbeds. coming up apple's big day. what we can expect from the company's unveiling of it. plus, the fallout at fox news now that a former anchor's sexual harassment suit against

three crew members were killed in a helicopter crash in the chopper had taken off from the airport before it went down in a rural area. it was reportedly on a test flight. investigators from the faa and the ntsb are on their way to the scene. a damaging report coming out says covert testing of tas agents at airports is, quote, incomplete and unreliable. a draft of that report obtained by abc news says one reason for that finding is those fake passengers testing tsa screeners are not anonymous. officials at seven in ten

getting enough role players to make sure the tests remain covert. a report found tsa screeners failed 95% of covert tests. thousands of students across the country are learning their future education is in jeopardy. itt tech has announced it's permanently closing all of its campuses nationwide. the company blames a recent move by the department of education to ban itt from enrolling students who use federal financial aid. 8,000 employees also lost their jobs immediately. and we should get t next apple iphone today. the big question is will the iphone 7 have a headphone jack. most of the rumors say no, it won't, which means apple may also unveil new ear pod headphones that connect some way or the other. the new iphone will have a dual camera future and upgrades to siri and imessages and expected to announce the second generation apple watch and new features for apple music and apple tv.

it's wednesday. either feels like it or feels a little earlier, with the short week here. temperatures in the mid and upper 70s now, we're clear, wind out of the northeast, we have temperatures generally in the mid and upper 70s. still low 70s to the north. we had the 60s yesterday. that was nice. so plenty of sunshine, we have a couple of showers in forecast south of hillsborough. well down to our southern counties and not amounting to much, 10% to as much as 20% coverage. fast moving showers east-to- west. rain chances increase as we've been talking about later in the week. conditions mostly quiet in the tropics. a wave close to africa but nothing doing with that. titan doppler radar pretty quiet. just ground clutter, no rain showers, in we're clear. in fact very little cloud cover

up from lake okochobee to the south and you still have that flow, a lot more moisture, not just at the surface but you go higher up in the atmosphere and then further north very dry for this time of year. you can see that more clearly here with the orange hues coming up from the north. we're kind of in the middle now and plenty of moisture to the south. we'll have more rain for the south florida area but look at yesterday's 24-hour rainfall map. this is pretty impressive for this time of year, still wet season but notice that speck. that was the couple of showers that rolled through sarasota yesterday. we may even have some lightning associated with that later today but still it's a limited day for rain chances. not just today but thursday as well. friday we'll begin to get into it as far as rain coverage around 40% to 50% heading into the weekend. the east flow continues. by 1:00, 2:00 a couple of showers here again. this is south of polk.

so we're talking into manateant sarasota counties with coverage -- manatee and sarasota counties with coverage 10%, so most of us stay dry. the gulf looks good, atlantic basin, 70% chance of developing but it's eventually headed to the north so that is excellent news. the national hurricane center has a pretty high rain chance. 92 today at apollo beach. 91 tampa. a little more moisture, a little more humid, not as comfortable. yesterday no it will be a repeat of today with the east wind. for boaters it will be northeast 15 knots early and then turning north at 10 by the afternoon. 1 to 2-foot seas with a moderate chop. uv index still high so if you are hitting the beach you need the spf still this time of year across our latitude here. 84 degrees. that's the water temperature at clearwater. temperatures in the 70s around
