a student's death. >> but first we're following some breaking news in ybor. police are looking for the driver of a car that crashed into a bar. >> this happened at the bad monkey. police say there was a fight at the bar after the bar closed. two people involved in that fight are under arrest. a third person was in the car that hit the bar. it's not clear if the driver lost control or hit the bar on purpose, and the time line is a little bit murky. >> police are looking for that driver right now. we have a crewea scene. we'll have a live update just ahead. thanks for waking up with abc action news on this early tuesday, i'm dan shaffer. >> and good morning, i'm deiah riley. we want to get a look at your forecast. ivan is standing by with a much cooler forecast. >> much cooler, across the north, we've been flirting with upper 40s across the north. it feels colder not only because of the temperatures, the humidity is well down north

tampa, 61 not bad there: here we're running several degrees cooler than we were this time yesterday. titan doppler radar, just some cloud cover that will be left over, especially through the morning hours. then i think as we warm things up we'll get back into sunshine and temperatures get back into the mid-70s. we'll do the cooldown again and then the extended forecast even chillier temperatures on the way. we'll talk more about that in the next hour. good morning everybody, we're starting off with a traffic alert on eastbound take a look at this. we have a water main break that has closed two eastbound lanes on hillsborough avenue. this is east of 275 between 22nd and 30th street. so, again, two eastbound lanes are blocked. you might want to avoid this area altogether. you can use mlk to get around this instead. i will let you know as soon as it clears, but we're expected to reopen by the end of the day on thursday. elsewhere in the bay area no big issues to tell you about.

tampa side of the howard franklin bridge. and your drive on the veteran expressway looking good, a lot of that overnight construction has cleared. 18 minutes from 54 to 275, 6 minutes from waters down to 275. thank janelle. 2 minutes after 5 right now. breaking overnight in tampa, officers pursuing a stolen car arrest the two people inside after they got stuck on railroad tracks. this whole thing started after police tried to pull that car officers pursued for more than 4 miles at speeds of up to 80 miles an hour. when the chase got near bush boulevard, the driver tried to drive over railroad tracks but got stuck. that's when police arrested both people in the car. a polk county school board employee accused of a coverup after a student's death will have a chance to fight for her job. back in may, 17-year-old calin kirk was hit and killed by a car while crossing clubhouse

giving false information to district management indicating kirk was ray signed to a bus that did not require him to cross that particular road. administrators have recommended firing young. young told us the whole truth has not been told. the long boat key police chief says he can count the number of burglaries this year on one hand, and that's no accident. compiling data from the fbi, the national home security company protect america found long boat key was the safest this year the quiet beachside town only had three burglaries. the chief of police says the island also helps keep crime down because there are only two roads in and out and they use automatic license plate readers to track criminals that might drive in. >> if something comes back from tallahassee, we'll get that and be notified within moments that vehicle is on our island. >> the cameras do not track

the homicide rate is rising in florida, especially homicide by firearms. it's been going up ever since the stand your ground law went into effect in 2005. that law allows residents to use deadly force if they believe they're in harm's way. according to data gathered by the cdc, the average number of homicides was 82 per month during a six-year span that ended in october of 2005. during the next nine years homicides increased to 99 per month. that data also found the rate increased about 32%. the study found states without this law didn't see that kind of jump. forget oranges, grapefruits, strawberries, florida's newest cash crop could be a multibillion dollars industry within a few years. we're talk about marijuana grown for medical use. reporter clifton french is outside the very first medical marijuana dispensary in our area. how much money are we talking about here? >> yeah, you know, according to

$1.6 billion, and this comes just a week after florida voters passed amendment 2, which gives some people the ability to pursue medical marijuana. now, here's the deal. this is more than just selling weed. there's an entire economy behind it, farmers, storefronts, salespeople, cooks to make edibles. they're turning marijuana into candy and cookies. that means jobs for people hoping to jump into this growing industry. that'shy even before amendment 2 passed one week ago. this company is called trulieve. they opened this office back in august, three months before amendment 2 passed. and according to their website they plan to open several more storefronts and businesses across the state of florida including three more in the

water, clifton french abc action news. 5:05 now, a manatee county official is sounding the alarm about a closed phosphate plant that threatened to flood tampa bay with contaminated waste. the county parks and natural resource director says there is no closure planned for the piney point phosphate plant. that plant stopped operating over a decade ago. the department of environmental protection took over when the plant owners went a life or death situation over the weekend for a tampa bay area man. jose escabio says he was on fletcher avenue when the driver in front of him started take ever taping his brakes repeatedly. when he tried to pass the driver the driver flipped him off so he threw a coin at the car. the driver, security guard started following him. he kept following until escobio

escobio admits he threw a punch and that's when arasayef pulled out a gun and fired several rounds. >> the first shot he shot at me i started ducking and ducking and i jumped the gate. >> he ran for cover at a neighbor's house. arasayes was arrested. he's out of jail. we didn't find any prior criminal history for him. this morning we're learning a 79-year-old man has died from his injuries marathon in fort lauderdale. the vehicle went right through a street closed for traffic for sunday's event. the driver stayed on the scene. we're waiting to find out if he's going to face any charges. the victim's family says he was an avid runner and had run three previous races to prove to his grandchildren they could do anything they set their minds to. we're learning more about an arson fire with messages of hate next door. we showed you these pictures yesterday of this mobile home

trump. neighbors tell us they saw two men running from that vacant home yesterday. and they say the property manager is looking into setting up surveillance cameras. investigators think the people who set the fire are also behind a similar message on a house a few block away. more reports this morning about president-elect donald trump's possible cabinet members, now a senior trump official is telling some news outlets, former new york city mayor rudy giuliani is the secretary of state. giuliani was a surrogate for mr. trump on the campaign trail. >> we'll check in now with ivan. >> anywhere you slice it here, we're looking very chilly this morning with 50s widespread at this point here. it feels colder. ed humidity's low and that alms makes for a fall-like feel, and getting into later fall now as

portions of polk county running anywhere from 5 to 10 degrees below where we were this time yesterday. a little milder down to the south. we have some extra cloud cover, and that's because there we're closer to a front that continues to reside across south florida, but you see the moisture normally get these fronts and you get the clear air, a nice depiction and if then the clouds, no this time around we've got the moisture streaming in from the gulf, southwestern, northeast that's what brought us the overcast skies yesterday. mostly cloudy this morning, certainly, but by the afternoon we'll begin to warm things up. the front continues further to the south and we'll begin to clear things out. that will set the stage for very nice temperatures. i think we'll get back into mid- 70s by later on this afternoon with mostly sunny conditions and that continues through tomorrow. another cold start. we'll talk more about that in a few minutes. thanks ivan. 9 minutes after 5, breaking news just into our newsroom.

time. at least one person is injured. police are right now looking for the driver. abc action news anchor james tully is live at the scene. what can you tell us about what happened. >> reporter: i think i'm just going to step aside. you can see clearly here behind me, this is at the bad monkey bar in ybor off 7th avenue. this black nissan ultimate, this police cruiser is going to get right in our shot. this is a black ni bar. you can see the damage it did, knocked out a pane of glass. look at how the doors were pushed back there, and then a little bit crooked. now here's what we know, the biggest story is that police are still looking for the driver. we know that there was one person taken to the hospital with some minor injuries, what police are calling minor injuries. this all stemmed from a fight that happened elsewhere in the city. two other people are in custody.

15 minutes after 5, new vandalism with politically inspired graffiti. you just saw that there, an episcopal church posted pictures on its facebook page, a swastika and the words hail trump were painted on the side of the sanctuary. another church in yanked was hit. we showed you the sign that was changed to say trump nation, whites only. that same phrase showed up on a wall in the church's cemetery.

since election day. one of the men at the center of the making of a murderer case could be out of prison sometime today. a judge ordered brandon mas psy to be released. he's been in prison for eleven year-to-year for the murder of photographer theresa high school beck. the state of wiscons judge ordered he be released while the appeal process plays out. good morning from the weather center, cool start out there compared to yesterday. we're in the mid-50s across the nature coasts, 59 new port richey and a few low 60s out there certainly. a little bit less cold, more comfortable. either way it's colder than we were this time yesterday. we're going to continue that trend through the next few days, especially in the mornings. through the afternoons, each

second here, plenty of sunshine for the rest of this week. we're going to be dry. not the overcast skies we saw yesterday. a lot of cloud coverage through the morning hours, but throughout the next few hours and into the afternoon i think we'll be getting rid of those even. we're looking much better with this north wind taking over, bringing us plenty of sunshine and cool mornings and mild afternoon high temperatures. nothing organized moving through here as far as any additional fronts for the rest of the week. still a lot of cloud florida if you're making your way through the southern part of the peninsula. mid and upper 70s this afternoon, again, you wake up early enough, this is what you're going to feel as you walk outside, upper 40s to low 50s tomorrow morning once again, and even our southern counties will get in on the cooler weather that, well, it's not as cold this morning because of the clouds but by

that will set the stage for a chilly morning and nice recovery for the afternoon. tomorrow, especially across the north, we're going to jump 30 degrees from our morning lows to daytime highs. pretty impressive range of temperatures we can do this time of the year. 75 for the daytime high, a little below average: it will be fine, it will be great. upper 70s through the rest of the week. notice the overnight temperatures getting a little milder along with the daytime temps and then we put a halt on that on saturday. saturday and sunday, a huge one here as the front comes in saturday night setting us up for not just cold morning lows but daytime highs that are only going to be in the upper 60s. get ready for that early next week. and good morning everybody, we have an issue out there on hillsborough avenue. this is going to be east of i- 275, a water main break has taken away two lanes here on hillsborough avenue between 22nd and 30th street. so traffic still pretty light
