developing tonight, a visit to the ice cream truck ends with a child being hit by a car. >> he flew to the grass. >> now police are searching for the driver who took off. police in winter garden say they found that vehicle they believe hit a 3-year-old boy this evening not far from that scene. >> but tonight they are still looking for the driver who did this. channel 9's jeff levkulich is live in the neighborhood along cypress street tonight. you talked with the little boy's family and they say he was hit while getting ice cream

getting some ice cream from the ice cream man right out in front of their home when the little boy was hit. tonight they're looking for the driver that hit him. the accident happened around 6:00 on cypress street in winter garden. sky witness 9 was overhead moments after the call went out. 3-year-old daniel monsaive was with his brother lewis getting ice cream when he was hit by a car. >> it hit on the corner of theheadlight. he flew to the grass. >> reporter: police say the driver of the car didn't stop and took off down the street. >> did he say anything? >> no, he just hit him. he moved to the side so he wouldn't run him over or something and just ran fast. >> reporter: meanwhile the driver of the ice cream truck sprang into action. >> the ice cream man went running and got the license plate, you know, so he helped us a lot. >> reporter: police say the suspect ditched his car and fled on foot at this elk lodge

daniel's cousin says her cousin seems okay but went to the hospital just in case. >> i was scared like something worse happened to him. >> reporter: now, we're told by the family that little daniel is expected to be okay. he might be home later this evening. now, as far as this road, some of the family members told me that it is very busy sometimes where drivers are speeding up and down. they would like to see maybe a speed bump here on this street to slow those drivers down. reporting live in winter garden, jeff levkulich, channel 9 eyewitness news. >> and of course, we're going to stay on top of the search for the driver throughout the night. we'll have updates tomorrow on eyewitness news this morning starting at 5:00. we are following breaking news right now happening in orange county where deputies are searching for three armed suspects who stormed into a home. this is a live look at the scene on broken pine circle. deputies say three people were

suspects burst in, stole some property and then took off in a vehicle, which was also stolen from the home. one person suffered a minor injury. another chilly night. temperatures already dropping big time across central florida. the temperatures are still going to drop throughout this evening. >> right now some areas are under a freeze warning. certified chief meteorologist tom terry tracking the following temps. some folks are going to wake up to some frost. >> we're about a month behind schedule to get a freeze in parts of the area. as of the top of the hour, 37 ocala and holding. 39 in deland. that's a hold over from the last hour. we haven't continued our drop. it's been falling fast. 45 in sanford. other live current conditions, 35 in citra. getting close to the freezing markup north where the freeze warning is in effect from palm coast westward all the way into parts of marion county.

we'll also go over the freeze duration, that's critical, at least four to six hours i think in marion county tonight. >> right now as the temperatures dip near freezing in marion county deputies are trying to find a missing in danger this evening. old margaret lehman. investigators say a deputy found her this morning walking away from bellview high school and brought her back. seen. developing tonight, investigators in jacksonville believe the certainly for a missing toddler is over after the prime suspect in that little boy's disappearance led them to his remains. channel 9's angela jacobs has been following this emotional story all day. >> reporter: 5 1/2 months, 400 searchers and 38 agencies. >> our goal from the beginning was to find lonzie barton. >> reporter: we showed you the certainly last summer for 21- month-old lonzie barton who disappeared in july. >> i said if there's a puddle.

the efforts finally ended today when the prime suspect in the little boy's disappearance led them to a new location in the city south side. reuben ebron, the toddler's mother's boyfriend took authorities several miles further south than teams previously searched. tucked away in a wooden area at a dead-end street an emotional chief investigator spared the details. >> it wasn't a little blue coffin he was in where he deserved to be. first of all, he didn't deserve to be dead. >> reporter: prosecutors suspect a deal last week with lonzie's mother on child neglect charges may have played a part in ebron's cooperation. >> i will be tell you her plea started a series of meetings for defense attorneys for reuben ebron and here we are a few days later. >> reporter: one of the meetings we caught this morning of ebron arriving at the state attorney's office. while we don't know the how or why of what happened of this little boy the most important question has been answered.

bring justice to lonzie and remove him from where he was today is a what today is about. >> reporter: angela jacobs, channel 9 eyewitness news. >> and investigators expect to file new charges, although they would not yet say who will it be against. pending results from the medical examiner's office. for the second time in less than a week knives and drug paraphernalia were found in timber creek high school. the principal sent a message to parents today but stressed no students were threatened and school resumed as normal. an orange county man is facing charges after deputies say he stole 88,000 dollars from an atm. at new year's gay on the bank of america new year's day on the bank of america. an employee filled the atm but left it unlocked. eric provost used the machine and returned to steal the money. orlando regional medical center is asking for your help

in a coma two weeks now. a man believed to be hispanic or asian and 5 1/2 feet tall was nearly killed along colonial drive the sunday following christmas. investigators say he stepped off of the median and directly into traffic. he had no driver's license on him and his fingerprints didn't bring up any matches with law enforcement. now hospital officials are asking for tips from the public. >> we're hoping someone may have been there, may have seen something, may recall something, and may be able to contact us and let us know any information they have. >> the hospital cannot release a photo or a sketch of the man because of federal privacy laws. a 52-year-old man convicted of raping one woman and murdering another is off to prison where he will spend the next 45 years. >> i feel like justice has been served. i'm glad. >> john lytus pleaded guilty to all of the charges against him

murder for calling laura found dead on the side of a road last september. the surviving victor churched and raped was in court and felt 45 years in prison was fair. lytus was also accused of raping a third woman but not charged in that case. 9 investigates dangerous fuel spills at orlando national airport and airport employee sent us this picture of fuel spilling like a geyser from today. this happened after a truck hit a fuel pit as the plane was getting gassed up. employees say spills are common. since our story aired on eyewitness news at 5:00, the airport spokesperson told us the spill was very unusual and safety measures have been put in place to keep this from happening again. the spokesperson says spills are cleaned up immediately. jury selection continues tomorrow in the retrial of a teenager convicted of helping to lure another teen to his death. 19-year-old amber wright had her conviction overturned in 2014 when the court found out

wright is one of five teens accused of luring 15-year-old seth jackson to a marion county home where he was beaten, shot and burned in 2011. right now, city council members are still discussing the future of a retention pond that has nearby residents upset. we told you about plans to rip out the last orange grove to make way for a shopping plaza. council members have been discussing the proposal the last three years. they want to take more than three acres of lake charity's wetlands. a teenager accused of running over an orlando police officer will have to wait until tomorrow to find out if he can get out of jail right now. an attorney for edward kelte said he should be granted a bond so he can await trial at home. he's accused of this, running down officer william anderson who you can see in this dashcam video getting run down. anderson's wife says her husband is still dealing with the effects of that impact. >> he still cannot pick up our

her and we were told not to expect a full recovery in both his physical and cognitive abilities. >> the judge is reviewing the video evidence and expects to issue a ruling tomorrow. you can count on us to let you know what he decides. a former volunteer firefighter whose on parole for arson in another state is now facing 45 years in prison for police caught travis pierce admiring his work after he burned down the clubhouse at course. pierce told the police he saw the flames on his way back from picking up milk. investigators said he didn't have any milk on him but did have lighters, a flashlight and gloves that reeked of smoke. orlando police are investigating two of their officers after a questionable chase outside the city without lights and sirens activated. the department apparently knew nothing about an officer chasing a jeep last month. eventually the jeep ended up following the police car. deputies radio transmission

concerned about the officers, worrying the patrol car may have been overtaken by the bad guys. >> a chase in the area, try to locate the unit that is in the area. apparently we can't identify them and we want to make sure the vehicle. >> deputies caught up with both vehicles back in the city about ten minutes after first noticing this chase. officers mike favorite and fred roll are now under investigation. drivers may be getting ticketed for no reason while county intersection. county officials shortened yellow light times at this intersection at turkey lake and sand lake road. traffic coming through here used to get 4.the seconds. now it's down to 4.4. even though it's a few tenths of a second it can make a big residents along this quiet street want to know what happened after their neighbor was found unconscious outside a home. >> he never, ever, ever caused trouble.

new tonight, residents along a quiet brevard county street say they're not getting answers nearly a week after their neighbor was found collapsed inside. >> we first told you last week a child screaming for help alerted them that something was wrong. channel 9's ty russell went back to the neighborhood looking for answers. neighbors told you they're concerned because they still don't know exactly what happened. >> reporter: martha, i've been asking for answers for nearly a week and deputies are being tight-lipped. i've been working to find out whether it's suspicious that a grandpa was found lying in the street next to this black carport. neighbors confirmed to eyewitness news tonight this was a picture we found on facebook of 67-year-old german heridia. we were here last tuesday when deputies set up a crime scene for nearly five hours collecting evidence like this black pickup truck after they told us a man collapsed. deputies wouldn't say who but

man who was lying on the ground was herridia and called for help after hearing commotion and his granddaughter screaming for help. neighbor patricia hughes has known him more than 30 years. >> he never, ever caused trouble or did anything to upset anybody. >> reporter: since that night neighbors have been contacting us through email concerned for their safety. they told us authorities are keeping them in the dark if foul play is involved. we sent email messages to deputies for updates last week. we were first told there were none. and then our email messages didn't get a response later on in the week when we requested the incident report. and almost a week later we are still waiting on the incident report, so today we went to the sheriff's office to get the document but walked out empty- handed. and his home is not far from the spot where he was rushed to the hospital. now, we went to that home and knocked on the door. nobody was there. now, we were able to reach out

us all of his immediate relatives are in miami. we are live in brevard county eyewitness news. wildlife trappers are getting a bird's-eye view from a drone trying to track down coyotes near harbor beach park. we were at gleason park this morning as a drone took flight. experts were hoping to identify their traps. the city wants the animals removed and located to a more rural part of brevard county. >> the small habitat they're living in is not ideal for them. you know, it keeps on staying here pretty soon they'll become a problem around here. >> this is kind of cool. if trappers have not caught the coyotes by mid-week they plan to use a drone equipped with infrared sensors at night. volusia county officials are weighing the idea of moving the homeless to a daytona beach bus terminal. we've been reporting on the large number of homeless people gathering at the county

most leaders are on board with moving them to the bus terminal about a block away. it could take a few weeks before the county follows through with it. in orange county, ucf students who got this holiday's most popular gift won't be able to bring it to the dorms. the school is banning hover boards from on campus housing. ucf says the move follows recent fire reports and an ongoing investigation into hover board safety by the consumer product safety commission. however ucf says hover boards can still be used all around campus. you've got to be bundled up if you use them. >> wind chill. it's going to be bundled up in the morning. we're a month late though from when we normally would have this kind after night. >> perfect night for footsy jammies. early december, that's our average first freeze. it's late december for orlando. we don't have a freeze tonight but early december and here it

about a month behind. it's been very whacky temperaturewise as we know really since last year. 36 in palm coast right now. our cold spot on the map, 39 in deland. a lot of rural areas reporting mid-30s tonight. the freeze warning will verify a lot of these areas in blue will get to freezing at least for a brief period of time in the morning. palm coast back down toward ocala. 32 palm coast. a lot of colder pockets through here. 29 through ocala. 36 for leesburg. so it's going to be very cold to the north and where we get down into the mid-30s, that's where we're also be cold enough for a variety of reasons for getting frost to form in the morning. so make sure the pets have a warm place to stay, because they're going to be out in this perhaps tonight. 2 to four hours of a freeze from palm coast back to the west. this is not a hard freeze wherewe'll be at 27 degrees or colder. we're not going to be quite that cold. 4 to 6 hours after freeze around ocala.

you don't have to hit 32 on thethermometer. you can get to the mid to upper 30s and get frost on surfaces areas. the heat radiates more efficiently off those surfaces. even though thermometer may say something, it's colder on those that's where patchy frost will season. 60s. fantastic weather for tomorrow. if you like it a little warmer stick around. i'm going to try to warm things up for you by saturday. orlando in the low 60s. 65 degrees for sanford along with lake mary. kissimmee, heathrow all the way to the entire corridor of the state will be in the middle 60s. then we start watching friday. we're giving you advance notice. we'll have a storm system in the gulf of mexico. it will split its energy right here. right now we'll be watching storm energy approaching the

don't have any particular severe weather indications but we know from this last weekend where we had a high end ef 2 tornado hit cape corral in southeast florida this is certainly an el nino pattern. five-day forecast, the weekend always in view. there's friday our next best chance for rain and storms. another sharp cool down on sunday. lake county is trying to make it easier for you to get help in an emergency. the upgrades that will allow residents to send pictures and videos to 911. getting you ready for your tuesday morning. i'm brian shields. we are going to track the areas of frost and just how cold it is going to be when you head out.

a phone scheme is targeting to seens of residents -- dozens of residents and an 82-year-old woman was made to look like it's her fault. the suspect stole her number with an app and made the victim's number show up on the caller i.d.'s. investigators say the call could come from anywhere. the 82-year-old had to change her number after getting 43 angry calls back in just two hours. right now orlando police are looking for a person or persons who vandalized more than a dozen businesses along colonial downtown in downtown orlando. investigators say someone shot out several store windows with a pellet gun over the weekend. business owners said the damages could set them back thousands of dollars.

catch a white car passing by one business as its windows were shot out on colonial drive. lake county is working to upgrade the 911 system so people who need help may report what's happening without making a call. the county recently received more than $100,000 grant. the money will be used to replace old equipment and upgrade the current system. the new system will allow people to text, send pictures and even videos to a 911 dispatcher. hours ago, orlando mayor buddy dyer was sworn in for his fourth term in office. we were there at the dr. phillips center for the performing arts. three others were also sworn in. mayor dyer who won with more than 60% of the votes told us ending homelessness is his main goal. he is the longest serving mayor of orlando. health care options for women in central florida are about to expand. >> a 12 story hospital for
