breaking right now. a store owner opened fire after 2 gunmen tried to rob him. police are searching for one suspect. >>a convenience store owner took matters into his own hands when to armed men stormed inside. >>police arrived at the chevron just after 8:00 tonight to find a suspect on the ground with a gunshot wound and another on the run. ty russell is live at the scene. this store owner is known to be armed what happened? >>reporter: we learned that the store owner fired several rounds of both suspects. moments ago i talked to his wife who said this is not the

out his gun during an armed robbery. i have been in touch with cocoa police who are still here, there are evidence markers on the ground, clothing and shoes that were taken off the alleged gunman. there was also a gun on the ground and we are working to find out who's car this is parked next to the gas pump. we were first on scene to find police collecting evidence at the chevron's tatian. -- station. this store owner was held up at gunpoint by 2 people. police found one alleged robber with a gun sought -- gunshot wound inside the store. we have video of the man taken out on a stretcher. the other man took off in a car. before the other suspect got away the owner was able to fire at least one shot in the getaway car. witnesses told police it was a silver car. we have video of police in rockledge stopping a silver

a man and woman were inside. we are working to find out if the 2 scenes are connected. police are still talking to the owner of the store. police are still collecting evidence outside the chevron station. right now we are working to find out the identities of the 2 armed robbers. we are live in cocoa, ty russell. >>we will stay on top of the search for the suspect got the night we will have any develops on eyewitness news this morning. a man accused of hitting a 3-year-old with his car is in jail after he turned himself in. police say billy gibson was driving on a suspended license when he hit the toddler yesterday. the toddler and his older brother walked out into the street to visit a ice cream truck. today the mother says she is thankful her son escaped with a few bruises.

happen when i see everybody screaming. it was scary. >>epson is facing a 3rd degree felony charge of leaving the scene of an accident with injuries. developing tonight in volusia county, authorities at daytona beach shores need your help finding a man who attacked a senior citizen in the middle of the day for what appears to be no reason. angela jacobs spoke with the victim. she was out walking her dog when she was attacked. >>reporter: it is hard to believe at that time of the day there were no witnesses except for the victim who saw the attack that happened right here in the suspect who took off down this main road and got away. 6 hours after an attack from a total stranger left her with a concussion. >>i'm shaken up but okay. >>reporter: we spoke with the 71-year-old victim not ready to go on camera and in disbelief.

the day and night and this is never happen. >>reporter: she was walking her dog along the sidewalk when the suspect came around the corner, hit her on the head so hard she went into the wall and down. >>it happened so fast i did not realize. i got a good look at him. i won't ever forget it, it is something that is very frightening. >>reporter: she describes him as the ark scanned about 6 feet tall in his 20s with a scar on his face. he got away. tonight residence in this tightknit complex told me they are an easy. >>i can't believe some they would do this in broad daylight to someone especially someone her age. >>reporter: with no idea on what motivated this man who did not rob her, this victim feels grateful to officers who arrived in minutes. >>i could have passed out and laid there. hopefully they will catch this

of the state speech. governor. rick scott called on lawmakers to pass a $1 billion industry tax-cut package and he also wants another quarter million dollar of incentives to bring companies to states. >>fantasy sports are one step to becoming legal in florida. lawmakers decided to move forward with a bill that would [ indiscernible ] for operators. the industry has exploded with an estimated 3 million players in florida alone. today's decision comes as some states are trying to stop people from playing because of concerns of gambling. the bill needs to clear several committees before reaching the house for. people from such a florida and hundreds of others could have distances changed to life in prison without parole. this comes after the us supreme court ruled the death penalty sentencing is unconstitutional. this is huge news. a jury recommends a death sentence but the judge has the final say. the supreme court ruled the judge has too much to say in death penalty cases.

the death penalty is on hold in florida and also means the florida law will have to be rewritten. >>i think when the supreme court throws out your mechanism for capital punishment, the legislature is obligated to step forward to come up with a solution. >>that means it looks like the death penalty will be taken off the table for suspects waiting trial in florida. today jeff action told us his office is reviewing the supreme court decision. legal analyst bill schafer said attorneys may argue the ruling and it may only affect new cases. >>they may argue that unless your case was on appeal or you raise this constitutional issue at trial or on appeal you wave that argument. >>state attorney jeff ashton said he will be working to get

left them badly injured and he is worried there could be more dangerous trees out there. a 3 ton laurel oak fell on his car as he was driving along robinson street back in november 2012. it smashes suv and left him in need of multiple surgeries. the same tree was ordered to be removed 5 years earlier. his attorney says the city admits to having 90,000 more of these oaks planted all over town. >>a part of this case that keeps me up is the fact that there may be many other trees waiting to topple down on another vehicle. >>valdez says his medical bills are far more than $5000. he asked the city how many oaks they have on the removal list and they're working to find that number. commissioners say it is time to revisit the florida manatee sanctuary act especially as it relates to slow speed zones. one commissioner who presented

a fire station has less than 2 weeks to find a new home. in 6 weeks the state will take over this area for road construction. we first told you about this back in 2013. the state paid $2 million for the downtown station and the city community center. firefighters were supposed to be out by the end of 2015. now 2 weeks into the new year they have nowhere to go because finished. firefighters have to double up in one of the city's other 2 fire stations. seminal county has agreed to give out there proof trash cans. right now only certain residents can get them. 64 alan there proof trash cans cost around $180. commissioners voted to give the
