>> tracking it now cold mainly -- mainly cloudy this afternoon and dry for the daylight hours tonight and early tomorrow we will see a better chance of rain and storms. cloudy now but i've been keeping tabs on what is going on to the west in the gulf of mexico a developing system here. radar information drops off being well out in the gulf but it will be headed our way as we go the next 24 hours. that can bring isolated risk of severe weather. most of us in the green shade. a low-end risk of severe weather. when you get these storm systems especially with an el nio pattern, working in from the gulf of mexico, we have seen this over a number of years, late 1990s and 2007 toward lake mack and paisley you get rotation out of the storms and that is giving you isolated tornado chance and that is what we will watch out for tonight into the rest of our friday. wrapping up through the early

blaine tolison reports, prosecutors are now fighting to get the trial delayed. >> reporter: the judge here at the 7th judicial circuit has the difficult decision to make in the state case against luis toledo to either delay it by 60 days or move forward trying his best to interpret the supreme court's ruling on florida's death penalty scheme and how it applies to this case. prosecutors intended to seek the death penalty for toledo who is accused of killing his wife to xavier suarez and her children in 2013. bodies whenever found in the family lived in deltona. after more than 2 years, the case was scheduled to go to trial in state -- st. augustine next week starting the jury selection but the state attorney's office filed a motion just yesterday to delay the trial. that motion came just one day after the supreme court ruled the death penalty scheme is unconstitutional. the state asked for 60 days to hear something from the state legislator on how to proceed with the capital case. i would like to note the

defense has asked for a delay over the last several months, leading up to this for the same reason but now the possibility the state cannot impose the death penalty so toledo's attorneys want to go to trial. >> this is the death penalty but there's no mechanism to impose is obviously, the only reason for the state to continue the case is because they want to impose it. >> reporter: if the case ends up moving forward, the defense has motion for the judge to strike the states intent to seek the death penalty. the judge says he will have a decision for us tomorrow. into land, blaine tomlinson, channel 9 eyewitness news. meanwhile in orange county, the man who was sentenced to death for killing a 19-year-old to keep him from testifying in a home invasion case will be back in court this afternoon. in november, okafor was given the death penalty for murdering zaldivar in 2012. his face can be changed because of the supreme court ruling. we will be in court and let you know what happens on eyewitness news at 4. in a few hours orange county school leaders will
