daughter have never been found. volusia county prosecutors were said to taken to trial next week in st. augustine for murdering all 3 of them in october in october 2013. and they were planning to argue he deserves death if convicted. today, prosecutors asked the judge to delay the trial for as long as 2 months while they figure out what to do about the u.s. supreme court decision tuesday. that is because it will florida's death penalty scheme which makes judges the decision- makers rather than juries is unconstitutional. wftv legal analyst melvin perry believes that decision is bad news for volusia county prosecutors. >> unfortunately my reading of the hurst case it takes the death penalty totally off the table for the case is currently pending trial now because the scheme, which is in place, is unconstitutional
