>> and tonight, the situation has gotten so bad, daytona beach sent buses to shuttle them to the salvation army, but hardly anyone has left. the property appraiser's office where the homeless are still gathered and shannon, you confronted the volusia county commissioner about why this problem hadn't been solved? >>reporter: right now, only 17 people decided to take the salvation army up on their offer to bus them over to the shelter for a warm bed tonight. there were 46 beds available. tonight, tomorrow, and likely many days after that, dozens will sit here in front of the county administration building until something more is done. in the meantime, it will be closed because today the county leaders told me they're in a no-win situation. the property appraiser shut the doors today, all because one employee was a costed outside. >> it doesn't make sense. we need the services. >>reporter: the property appraiser feels his employees

and now the county is in the process of shutting down the rest of the office inside of the administration building. because of if one does it, they all have to. >> do you believe that incident was enough to close the office. >> i thought the incident was blown out of proportion. >>reporter: but it's about liability. with the door shut, it opened another. if someone got hurt, then the county could be sued. >>reporter: how long are you going to shut it down? something has to be done. >> absolutely. >>reporter: but that's something is anyone's guess, the only way to solve it is to give them somewhere to go. the salvation army is just one part of the solution. there isn't enough beds for the dozens of people camped here. wagner thinks there needs to be a second location for the rest. >> i don't know what we're doing, it's simply, to me, something we get done tomorrow. >>reporter: now the commissioner told us that the money is there. the city of daytona beach could use cra money and eventually could have that permanent place

there is no easy answer here, but like we pointed out, the commissioners, this is what they get paid to do. tonight, the mayor of daytona beach, and that commissioner, will talk hopefully that means solutions will be done. for now, live in daytona beach, eyewitness news. u.s. marshals have just taken over the search for a prison escape ee and his girlfriend and 3-year-old son. he escaped the work release program at this volusia county hotel. deputy say had a gun and her son. bullock got work release because of good behavior in prison in spite of the conviction for armed robbery. >> work release is designed to reintegrate people back into society, get them a job. >>reporter: now, if the girlfriend is caught, she could be charged with aiding and

at this hour, we're still going over every frame of body camera video released by orlando police from an officer involved shooting, it shows in detail what happened as the officers tried to stop a 17-year-old for a seat belt violation about a week ago. channel 9 watched that video several l tiles and cathy it's the same video they will using to investigate this kags. >>reporter: another officer said in the report he believed that the suspect's vehicle was headed right for officer jonathan mills. now you can see mills fire his gun four times at the suspect as the suspect took off. >> the officers on opd's special tactical unit says they saw the white charger backing in at a shopping center after midnight a week ago saturday, and noticed that the driver was not wearing a seat belt. you can see the officer jonathan mills, wearing the body camera, get out of his truck, and approach the car with his gun drawn. >> stop. stop.

two others in the car, which turned out to be stolen. the security video from a business showed a wider perspective of this scene, the driver, whom opd has identified at 17-year-old trevon, kept moving and then the officers started striking the windows with their batons. >> stop the car, do it now. >>reporter: instead, the driver backed away from the officers, backed into a parked car, then peeled out. you can see that the charger is heading directly at officer mills when mills fired the first shot. he fired three more, rapid fire shots as the car took off. police say he was shot, but kept driving until he crashed into a vacant house. the teenager was not seriously hurt, and is now facing 3 felony charges. officer jonathan mills is on paid leave, while fdle investigates the shooting, to determine whether it was legally justified. martha.

camera video for yourself, log on to wftv.com/videos. we now know the names of the two people badly hurt in a recent dog attack. investigators say five pit bulls attacked 50-year-old virginia farley and 29-year-old richard farley, along with two juveniles in their sanford apartment last tuesday. all five dogs were eventually killed by the police. we're told farley is still in the critical condition tonight in a hospital. still no word yet whether anyone will be held account fbl for what happen -- accountable for what happened. new details on what led to the second arrest in a man for a man accused of child abuse. todd left jails last week, accused of beating his 3 biological sons. he's accused of using a rubber hose to hit the boys and even waking one of them up in the middle of the night to push a car that was out of gas as a forl of punish. he was arrested for abusing his

a polk county man is behind bars, accused of shooting a man and leaving him for dead in the woods. george was arrested and charged first-degree murder on friday. detectives say he shot and killed 38-year-old alexander, jr., earlier this month. surveillance footage helped link the suspect to the crime. the search continues tonight for the gunman who shot someone outside of an adult entertainment. the diamond club on cimarron boulevard. deputies say he was found with a gunshot wound to his torso after he pulled into the parking lot of the lounge on east colonial drive on saturday. he later died at orlando regional medical center. this afternoon, the city of orlando agreed to sell land to the orlando city soccer club, for 18 million dollars. where they're build thg new -- building this new stadium. jorge estevez went to the construction site today. when commissioners green lighted this sale.

>>reporter: a fully private venture. a look at this construction site of the new stadium shows progress, but this progress no longer comes with a major price tag for taxpayers. >> the motion carries. >> all right. finish the stadium. >>reporter: orlando city council members approved the final deal to buy this land in paramore from the city of orlando, an 18 million dollar offer. >> we'll get ready to get ready for the beginning of 2017 and the grand opening of the stid yaum. >>reporter: expected that the new stadium would be built. the 2017 major league soccer season. able to pack more than 25,000 fans inside. but on the outside, is a surrounding community of paramore, which the team addressed its continued commitment, even though their project is now totally privately funded. >> we will don't do that, we will continue to take the residents of paramore, the

with everything that we do and we want to be good neighbors, for many, many, many years to come. >>reporter: and part of being a good neighbor is job offers, well, today, the team said that they will continue to make that a commitment and try to employ some of the people and give some of the businesses around here a cut of this 155 million dollar venture. live in orlando, jorge estevez, channel 9, eyewitness news. late this afternoon, orlando city commissioners ended a battle over a piece of land that is home to a century-old oak tree. a multimillion dollar deal to sai constitutional green. 3.5 million dollar. they'll also throw in a city owned piece of land worth 2.5 million. orange county is going to be talking trash tomorrow morning, because of ongoing problems with missed pickups that have plagued the new automated service. commissioner boyd asked for that discussion, and we've reported repeated problems with the

january 4 #g9. some folks going weeks without pickup and al thoe the county -- all though the county says problems are dwindling. >> once a week is picked up. got to get it picked up. >> that resident says his neighbors went without pickup for the first two weeks of the year. they could fine the haulers for missing pickups, but they have not yet decided if they're going to do that. titusville police believe a stolen car suspect got spooked before he took off and crashed into an innocent driver. the suspect lost control on country club drive over the weekend. the stolen car ended up in his front yard. >> i just feel -- why, that's why i moved here from south florida. all right. we came up here. >> got a little crazy there.

32% rise in auto thefts. a fire at the old ymca building in daytona beach, that was recently purchased by the islamic center is still under investigation, they are trying to determine how it started. firefighters believe teenager got into the building yesterday and started the fire that took three departments and hours to put out. it likely was not a targeted attack against muslims. a bill that would help expedite lab testing of dna testing, including sexual assault kits was passed unanimously today. more than 13,000 kits waiting to be testing here in florida. the bill now moves on to the state senate. a project to improve a busy orange county road should be finished by the end of the week, 1792 from lake avenue to lee road in maitland is being resurfaced. the work had to be pushed back because of the heavy rains.

charges tonight under florida's new revenge porn law. it's the second arrest on that new statute in just a month. >> the law just enacted in october makes it a crime to post sexually explicit photos on line in an effort to seek revenge or harass an ex. the penalty the law carries may not be enough to stop the crime from happening. >> the man being heeld here allegedly sent a scream screen grab of his facebook page to a woman and his wall, there was a naked photo of her that was clearly meant to be private. shows nothing but selfies of hid kids today, but a naked photo is what has him facing revenge porn charges. >> this law has been a long time coming, there have been too many victims of this type of posting >>reporter: he was arrested in december for domestic violence against the same woman.

today, but she showed the ep didtys i text from war -- deputies he tested. no one answered at the home where he was arrested, he's not the only one accused of breaking the new law. >> do you understand? >>reporter: accused of doing the same thing, he was rs aed in late december. -- arrested in late december. the maximum time they'll spend in prison is a year. and because it's not considered a sex crime to post revenge porn. >> the challenge with prosecuted any new statute is does the conduct define all of the elements it takes in order to get a conviction. >> ward is being held on no bond because he wasn't supposed to have any contact with that woman in the first place, after his first domestic violence charge in december. he is expected to be arraigned next month. in seminole county, channel 9,

you may recall questions about why george zimmerman didn't face charges under this law. along with her phone number, and e-mail address. investigators told us because of the way that that photo right there was cropped, no actual nudity was shown and no laws were broken. surveillance cameras in one seminole county neighborhood recorded the moments a man graduated from car break-ins to home break-ins. he was stealing -- he could have accessed as many as 8 different addresses. >> very upsetting, it's violating, honestly. and there's nothing you can really do about it, you can see him now. but other than that, you have to hope that he it gs caught. >> deputies are reviewing the

the report shows a man spoke a dirt bike from the hopes. west metro parents are upset about the efforts to fix an overcrowding home. a second school on the site of metro west elementary. and the new school would have the same capacity, more than 800 students. some parents fear it would be overcrowded in a tighter place. >> they can say, hey, logically, five years from now, hey, i have a solution, let's do this. we put 1600 on half of this project, let's put another 1600, there we go. >> di trith leaders say they -- district leaders say they considered other locations. thousands of brevard county drivers will need to talk a detour next month, wick ham road will be closed near aurora road. february 22nd to install a new culvert. the grant paid for the nearly $800,000 project. the new drainage will better

ahead of the storm system. and based on this, my forecast model just updated, while i was on the air. let's see what it says for the rest of wednesday. it's showing more cloud cover moving through can late-day showers, and thunderstorms, coming on by. the previous run, actually has heavier stoppers a little bit earlier in the day. we're going to be watching from late morning wednesday all the way through the first part of wednesday for the best chance of rain and thunderstorms, and yes, over an inch of rainfall in a few spots as well. a slight chance for a tornado, but i think mainly some strong gusty winds, similar to all of the other el nino systems we've seen here over the last couple f of weeks. the five-day forecast with your weekend always in view, isolated showers, mainly at the coast tomorrow the, then we get rain likely. especially towards the afternoon hours, on wednesday and into wednesday night. thursday, i left a pretty high rain coverage, models are holding another storm system in reserve that will bring us more rain for the first part of
