mornings on "the view." s thanks, and good night, everybody. solving the growing issue of homelessness in daytona beach is pitting the city against the county. >> certainly this is not the way to get it handled. >> and tonight the mayor says he's trying to work with the county to come up with a solution. city and county leaders are at a standstill tonight trying to get dozens of homeless people off the sidewalk outside a government building in daytona beach. >> so many people are now living there county leaders had to close its doors to taxpayers. channel 9's ty russell is live at the property appraiser's office. county leaders said the issue

you tracked down city leaders who say, not that easy. >> reporter: martha, we just did a count moments ago and found 88 people sleeping right outside this county building. tonight, they are silently making their statement heard that they want more done for them. city and county leaders are listening but they're not making a move right away. >> it's terrible, people living like this. i find it horrifying. >> taxpayers we talked to in daytona beach want answers tonight. they want to know why dozens of people are camped outside the volusia county government building closed because of this camp. we learned today most don't want to leave until they have a permanent place to seek shelter. the city teamed up with the salvation army to give some a bed for three months. but most of them are still empty tonight. so we asked the city leaders about it. >> what can be done? let's say tonight or tomorrow? >> i think i've described to you what can be done and what we're doing. so the city has taken initiative. i can't say that for anybody else. >> we then wanted to know whether the city or the county

>> who's to blame for -- >> there's no blame. this has been an ongoing problem. >> reporter: earlier we talked to the county about the problem and one leader believes the money is there on fix it now. >> i don't know what we're doing. to me it's something we can get done tomorrow. >> reporter: but the mayor says it's much harder to do, but he doesn't see this camp staying out here much longer. >> in all likelihood we will compel them to recognize our statutes if we have a place for them to go. >> reporter: some tonight are sleeping on county property, but most of the people are sleeping on city property. now, the mayor has proposed county leaders and city leaders meet next friday about thehomeless problem. goth the county and city say they don't want to trespass anybody here, but if there is a place for them to go, they want them there. we are live in daytona beach tonight, ty russell, channel 9 eyewitness news. the following breaking news happening right now in marion county. deputies are investigating of a woman was found dead inside her home. deputies responded to the home

late this afternoon after a family member found the body of 57-year-old tamara. detectives are not collecting evidence and interviewing those closest to the victim. detectives say they are the preliminary stages of this one. we'll be in touch with them overnight and bring you any new developments or suspect info tomorrow on eyewitness news this morning starting at 5:00. tonight we're getting a look at new body cam video released by orlando police from an officer-involved shooting. it shows in graphic detail what happened the moments officers tried to stop a 17-year-old for a seat belt violation last week. this video is wild. listen to it. in the report one officerbelieved the suspect's vehicle was heading for officer jonathan mills. seconds later mills opened fire on the suspect as he tried to take off. [ shouting, honking, gunfire ] >> there are those four gunshots. the teen suspect was shot but kept driving until he crashed into a vacant home. he is now facing three felony

as for officer mills, he is on paid leave tonight while the fdle investigates the shooting to determine whether or not it was legally justified. u.s. marshals have taken over the search for an escaped inmate and his girlfriend and her son. we first told you about gary bullock's escape friday night. 24-year-old natasha quigley helped him cut off his monitor and escaped work release at this hotel. he was in custody on charges of burglary, grand theft, armed robbery and was granted work release because he had good behavior in prison and his crimes were not enough to disqualify him. >> he's going to lose a substantial portion of his good time and gain time. he's going to end up facing new additional charges. >> an amber alert has not been issued for quigley's son because he is with his mother and was not abducted by a stranger. new tonight two potential political careers are over after a county commissioner candidate was arrested. >> they've taken my name and

and i don't feel bad for me, because i'm 67 years old, but i feel bad for my son, because he had a shot. >> we told you friday anthony ferentinos was charged with grand theft, scheming to defraud and forging documents. detectives say ferentinos who owns t.j. auto sales in kissimmee falsified pay stubs to help car buyers qualify for credit. ferentinos told us he is innocent, but because of the allegations he and his son, john, who is running for a seat in the statehouse are dropping out of the races. flde says seminole county holds the only arrest under florida's new reverng porn law. stephen ward was arrested after he posted revenge pornography of a woman on facebook. the victim didn't want to talk with us today but showed deputies a text from ward and a screen grab of his facebook page where a sexual photo of her was posted. >> the more familiar law enforcement becomes with this

>> charles guy is accused of doing the same thing to another victim. he was arrested in late december. if the men are convicted, the maximum time they'll spend in prison is a year. new since 6:00, we found yet another orange county neighborhood that hasn't had trash pickup in weeks. residents in windemere say their neighborhood of nearly a dozen homes have been forgotten. channel 9 eyewitness news' angela jacobs went to see how bad it is. >> reporter: they've been waiting for trash day for weeks. >> the first day in january they came one time and only emptied half of our garbage cans so the bottom half was still full. since then, we've had no garbage pickup. >> reporter: when you look down the street. >> i see garbage-filled bags with garbage filled in them. >> reporter: while 11 homes sit prepared for pickup, the right to live on the end do their best to manage. >> we've become our own trash compacter. we're mushing it all down,

because we just don't have room. >> what i'm going to do to hope out is i'm going to try to generate less trash. >> reporter: the past few weeks, we've been following and showing you the problems with scant to nonexistent trash pickup reported county ride. they say they've got no answers to their phone calls to the county wondering when the haulers will actually show up. for now, all they and other residents here can do is wait. >> we're hoping this friday they pick it up. i don't know how we're going to go four more days, because we're already overflowing. >> reporter: in orange county, angela jacobs, channel 9 eyewitness news. >> we reached out to the commissioner but i did not hear back. they plan to address the trash pickup in a meeting tomorrow. a cab driver held up at gunpoint by two men outside a wal-mart in broad daylight spoke only with eyewitness news tonight. the victim did not want to be identified but he told us that he was sitting in the parking lot on vineland road at the

he told the duo to go to the cab at the front of the line. minutes later the suspects returned and pulled a gun on him. >> does the make you apprehnsive about anybody that comes in your cab now? >> yeah, i'm feeling scared of anybody get in my car. >> the county sheriff's office released video of the suspects to eyewitness news, and it's on our website. if you recognize the people in the video, police want you to call crime line. an accused gang member who once escaped from an osceola county jail won a critical appeal in his case. michael rigby was arrested after escaping from his cell. prosecutors argued he was a habitual felony offender and sentenced to 22 years for the escape. in october a judge ruled the sentence was illegal because rigby only had one prior conviction and granted him a new hearing. prosecutors told us today they stand by their original arguments. in titusville one teen is in custody and police are looking for at least one more suspect in a car theft and crash that happened yesterday. police told us the suspects

driver near the intersection of barna avenue and country club drive. at the time no one was pursuing the suspects. police think they saw one of their patrol cars and got spooked. >> the light was damaged, the bumper was mashed up, you know. and they ran up on my property. >> in 2014 the end of 2015 titusville police saw roughly 32% rise in auto theft. a significant number of those cases were crimes of opportunity but also dealing with repeat juvenile offenders. we are one week away from the iowa caucuses. tonight a chance to get to know the candidates with a two-hour town hall. it was not a debate as each presidential hopeful was on stage all by themselves with the moderator. first up, bernie sanders whose poll numbers are rising and with more attention on the vermont senator, sanders started out answering a question a lot of folks have about his beliefs, what socialism means in his opinion when it comes to his plan for america.

means to me in its essence is that we cannot continue to have a government dominated by the billionaire class and a congress that continues to work for the interests of the people on top, while ignoring working families. >> before hearing from his main challenger, hillary clinton, martin o'malley answered questions but the focus was really on how hillary would handle the audience now that she's neck and neck with sanders in the polls. >> the other side is not talking issues. they're talking insults. so i'm proud of the campaign we've run and what we've put people. and it's a tough campaign. and it should be, because it's the hardest job in the world. >> tonight the candidates are again alone on the stage. there are two more democratic debates when things change. the republicans, the next debate is thursday in iowa. we'll be checking with the state attorneys office to see whether charges are filed against a marion county man accused of shooting and killing his neighbor.

and his live-in girlfriend got into a dispute and his help. deputies say the neighbor grabbed his gun, got into a him. >> the responsibility of the sheriff's office right now to do a thorough investigation for the person that was deceased, also for the neighbor. >> deputies say they will forward this case to the state attorney's office once their investigation is complete. no word yet on what caused the fire that badly damaged a home that neighbors say is linked to the city mayor's family. neighbors say the father of daytona beach mayor derrick henry live at the home on magnolia avenue that caught fire around 10:30 this morning. a woman who also claimed to live in the home couldn't say what started the blaze. maitland city leaders pushed back a final decision about a controversial retention pond until next month. right now developers want to take out the city's last orange grove to build a new retail shopping plaza. developers say they would need a retention popped and a new road. the plans would use more than 3

county. two people are dead after a two- vehicle crash that shut down both directions of i-4. we're learning from troopers that the crash happened on the interstate. traffic is being diverted to 1792. new tonight a deal to sell land to the orlando city soccer club that was just agreed upon this afternoon could now be in jeopardy. >> a local group filed a lawsuit to stop the sale of the land where the new stadium is already being built saying because some of that land was taken through eminent domain, the sale is illegal. channel 9's jeff levkulich talked to one of the women behind the lawsuit tonight. but they told you the suit doesn't have any legs. tonight. they told me part of the land that that group is suing over is not even part of the sale. orlando city commissioners approved a deal this afternoon that will have the orlando city soccer club pay millions important the land where the new stadium is being built. but community activist says not

>> the people in paramour have said enough is enough. why do you continue to violate the law. >> reporter: so she and others are asking a judge to stop the sell of the land to the soccer club. they filed a lawsuit late this afternoon in orange county court. they claim the city which took some of the land through eminentdomain is now trying to sell the land to a private buyer before they're legally allowed to. >> the law says you can't sell it, lease it or represent it for ten years. that's all we're going by. >> reporter: i reach out to the city tonight about the lawsuit. spokesperson wrote me in an email, quote, we have received the property at 601 west church street is not part of the sale of the land to the soccer team and therefore the statute cited is inapplicable. i informed her what city officials had to say about her lawsuit. >> they used eminent domain. they need to know what they did. they violated the law. >> reporter: and because the lawsuit was filed so late today, city officials told me they have not even seen it.

no word on when the judge will rule on this case. reporting live in paramour, jeff levkulich, channel 9 eyewitness news. at this hour seminole county deputies have not caught the man captured by surveillance cameras breaking into cars to then head into homes. check out this video. investigators say the man stole garage door openers out of cars just off county road 419. there's a spot shadow of him. the man used some of those car door openers to get into at least two garages yesterday morning. victims, of course, want him caught. >> the stranger is going through your stuff, but i don't know what reason. and it's just scary. >> right now deputies are watching the video over and over again in hopes of finding out who this person is and stopping him. they say he stole a dirt bike from one of the homes. tomorrow morning, moms from across the state will pour into tallahassee to fight for their children's recess. an orange county mother, heather mallet will be among the moms defending a proposal

be worked into the daily schedules at the elementary schools. they will plead their case with research backed by the cdc and the american academy of pediatrics. late this afternoon orlando city commissioners ended a battle over a piece of land moment to a century old oak tree. city leaders reached a multimillion deal to save constitution green. they decided to buy the park from a family for $3 1/2 million. they'll also throw in a city- owned piece of land on east gore street worth about $2 1/2 million. >> i walked by it many times a day. that's a nice piece of land. >> yes, it is. right across from the station, it's not too bad outside, right. >> beautiful. >> went from frosty all over the place this morning to, here we go, 56 now in downtown. our temperatures warmer than last night. we're up 4 degrees from last hour in deltona. we're down to 45 in palm coast and mid-50s elsewhere.

campus will hold in the low to mid-50s, rebounding back into the 70s for tomorrow, although the clouds will be pretty come nantburg the day and along the coast as well. over at new smyrna beach in daytona beach, the clouds returning. will barely make it back into the upper 60s. generally though 70s across the board to ocala and back in toward the beaches, daytona beach at 69 tomorrow. kissimmee, st. cloud, leesburg in the 70s as well. we'll keep more clouds still relatively rain free though during the day tomorrow. could get late night showers moving in late tuesday, but generally most of the moisture is just offshore. but then here comes wednesday. we flip over that clock to wednesday and all bets are off for dry weather. here comes the storm system in the gulf of mexico. moisture riding in from the south. notice the red and orange colors, a lot of miles keeping some of the heavier potential thunderstorm activity down to the south. looking at a lot of severe at 5,000 feet. things like that. just don't appear to be coming

last couple of el nino storms we've had. we'll see a chance for heavier thunderstorms. can't rule out a severe thunderstorm. i think heavier rainfall will be kind of one of the more widespread issues that the state will be dealing with here. here's 2:00 on wednesday. there's going to be a weak front draped to the north. that's going to keep that moisture funneling on through. our model turns most of the rain off for thursday. other models are showing a weak wave sliding on by and keeping a chance for rain through the first part of thursday afternoon. we've got wet weather. just an isolated chance for a florida. rain chances going up with at few spots. in fact there this is the american model forecast output. you can see anywhere from an inch to an inch and a half. some of the purple colors on the edge of the grid, heavier rain down through south florida. it's been very, very wet, especially along the coast in january so far. the rain chances going up, just in time for the weekend. i wouldn't spoil that for you. there's your five-day forecast,

investigators say smoking is to blame for the fire that killed one person at an independent living facility in lakeland. the bell la vista -- bella vista manor did not have sprinklers. exempt because it was built in 1971. other advocates say it's up to you to check on safety measures before moving a family member into a senior facility. troopers are working to identify a man they say could have been driving a pickup truck that crashed into an orange county house. the crash happened along overdale drive and the 417. troopers say the person behind the wheel first hit a car, a power pole, knocked down a fence and hit two other cars before crashing into a spare bedroom. the owner of the house say it happened in a matter of seconds. in volusia county school board members will vote

as part of the policy students will be required to wear long or short-sleeved white oxford shirts and black denim pants. if approved it would take place march 1 but wouldn't be required until the beginning of the next school year. in orange county residents and parents are worried about an overcrowding problem at the elementary school. a plan is in the works to cut the campus in half and build another school. many are afraid it will make things worse claiming there isn't enough room and traffic would become a nightmare. the district hopes to have the second school open sometime next year. the florida state university reached a settlement with the woman who says she was raped by jameis winston. they will pay $950,000 which includes all but $250,000 in lawyer fees. they're settling to avoid spending millions on the lawsuit. she claimed the university failed to respond to her allegations that winston sexually assaulted her. winston denies these
