is arresting drug is ocala businesses we reached out to the attorneys of the man getting arrested who said he was wrongfully kicked and punched while on the ground. they declined interviews but sent us a statement that says in part, mr. prices satisfied with the efforts of the federal government to address the law enforcement conduct depicted on the video footage. records show price has several charges open on arrest and he is out on bond.

already pleaded guilty and are awaiting sentences but former marion deputy jesse terrel left it up to a grand jury to decide and yesterday, they handed him an indictment and accused him of violating price's civil rights. tonight, his attorney didn't respond to our phone calls and text messages but last year, when eyewitness news talked to his attorney, he told us he was expecting an indictment from this surveillance video. we followed up with the marion county sheriff's office after we received that surveillance video and we have learned the sheriff will hold a news conference tomorrow afternoon. we are live in ocala. >> we will be at that news conference. disturbing video to say the least. a soggy day and night and the rain is still falling. >> tom terry tracking the wet weather. how long will the stick around? >> i'm not going to mess up the

new dash cam video shows a trooper pulling over 78-year- old arnold whigham yesterday, stopping traffic on the 528 and ultimately driving his truck to safety. whigham told us he is still not sure how it all happened. >> the good lord must have taken care of me. >> we are lucky there were no injuries and that we got this guy stopped because he had already traveled 8 miles.>> he will have to go under a series of tests to see if the state law revoke his license. the orlando police chief gave his review of 2015. there has been an effort to engage with the community but violent crimes were still up. told you about several initiatives the department has implemented to get closer to residents such as coffee with a cop and community forms. chief mina says those are working but homicide stolen from 15 in 2014 to 32 in 2015.

expanded and then he was hit. >> deputies still managed to subdue francis. they also arrested courtney johnson for interfering with the arrest. she is charged with resisting without violence and is out on band -- bond. a man accused of shooting and killing a man entered a guilty plea today. christopher rodriguez will spend the next four years in prison for his role in the killing of tevin davis. his twin brother, mineral rodriguez was convicted and sentenced to life in prison for the same murder. the group trying to legalize medical marijuana in florida has collected enough signatures to get this issue on the november ballot. the people united for medical marijuana submitted 683,000 signatures to the state division of elections today. of course, a similar proposal made it to the 2014 ballot but barely failed to passed. the lake county fire department says one of its new aid agreements with other cities is paying off. the county has an automatic aid agreement with other city --

they call whichever cruise the closest to an emergency getting crews there faster like during the citrus packing plant fire earlier this month. new tonight, one person dead following a crash that blocked a road in orange county. troopers say one car was traveling north on dean road in your 408 and turned in front of another car. one passenger the northbound car died. two others in the driver are now in serious condition. the driver of the second vehicle also sustained serious injuries. the crash remains under investigation. it may soon become harder to petition for change. the charter review commission is requesting to change the rules for partitioning -- for partitioning and amendment. petitioners would have to wear a badge identifying whether they are volunteering are getting paid to collect signatures. special elections wouldn't be allowed during election years either. the woman who sued casey anthony for defamation is sitting in jail. how investigators say some of

deputies about the case and they say store surveillance video was key. >> reporter: and we have been working on getting some of that surveillance video. when detectives took it back to where the victim was living, they were able to quickly track the suspects from trucks into orlando and bring them to jail. this is the motel where deputies say zenaida gonzalez and jonattan acevedo worked as carpet cleaners when they stole a guests credit card who had cancer. >> the victim was living at the motel and that's how they were able to obtain his credit card while they were in his room cleaning. >> reporter: that guest was hospitalized for treatment and finding suspicious activity on his account. deputies say a trail of numerous stores across kissimmee to orlando cracked the case. >> we took that surveillance video and showed some of the individuals he worked at the

identify both consoles and jonattan acevedo we told you when a judge tossed out the defamation lawsuit, consoles filed against casey anthony, after gonzales said anthony used her name when she claimed the nanny was left in care of her daughter caylee before the toddler disappeared back into thousand eight. today, the couple was found living at this orlando motel. deputies say when questioned, the admitted to using the card to rack up more than $800 in charges. >> these individuals take advantage of someone who was an innocent victim. >> reporter: we just checked with the jail here and found out both arrestees have bond pending on their charges of credit card theft and orange county tells me as soon as osceola county accepts that bond, they will be released. a good samaritan is recovering in the hospital after being shot trying to stop

along par common striving lake nona. investigators say when the man saw the duo trying to get into cars, he tried to stop them. surveillance cameras captured them shooting the man twice in the leg. developing tonight, the national weather service has now confirmed an ef-1 tornado touched down in broward county earlier today leaving behind a trail of destruction. >> it ripped roofs off of buildings and through cars around like toys. george estevez has -- jorge story. on camera. >> reporter: here is a shot. it's right near pompano beach. within the last few hours, the weather service confirmed this was in fact an ef-1 tornado. i want to go over to this the damage. each other. the tornado even picked up this bus and simply threw it over several fences and onto a busy street and then, come over here

what you see. the area looks like a war zone. the storm tore off a roof at broward college and flip this brock -- flipped this box truck on the highway. the national weather service says the tornado touched down three times last night. crews are working to assess the damage, which could add up to millions of dollars. one person was hurt with minor injuries. this tornadoes part of the el nino system we have been seeing and talking about him severe weather center nine since january 1 of this year. for has seen seven tornadoes. this is serious stuff. >> we have a little bit of systems out there that are affecting us tonight. but no tornadoes. >> fortunately, the severe weather threat is very low but they did have a tornado down south today. we had the rain moving overnight. a lot of folks were out driving in it and more shower activity right now. it looks like they slow down

of i-4. it's wet, slow and go out there. 650, on and off rain throughout the night. we will and probably another .10 inches. lake mary, over 3 inches, new smyrna beach, look how close these numbers are, all within about a 10th of an inch showing how widespread and study the rainfall was earlier today. still tracking showers moving in from claremont past winter garden, ocoee. passing showers going through. said he rainfall moving offshore replaced by some of this broken rain but we notice to the south, an old friend sitting down south. this moisture is feeding along it. there is an upper air disturbance generating this rain off the gulf of mexico and that's what is moving in overnight tonight. here is featured track showing the batch we have moving through.

tonight. brian shields at 5 am on eyewitness news will have more rainfall moving in with occasional heavy downpour. pretty widespread rainfall and wet roads. then another batch in the afternoon. nothing excessively heavy but before the whole day is over, we could end up with another half-inch of rainfall on top of the 2-3 from today. drivetime tomorrow night and thursday evening, we are going to finally start to clear things that. friday, we clear out nicely. and the workweek but between now and then, early warning future track showing about a 10th to two tents of an an -- 2/10 of an inch. this comes off record rainfall daytona. one of the many things we see with el nino are excessive rainfall seasons in the wintertime. orlando tomorrow, temperatures

a family that has been fighting code enforcement over keeping chickens in their yards as a didn't realize having the birds was against county code. code enforcement has given the family three violations because they refuse to get rid of about six chickens. unless seminole county changes its rules at a meeting tomorrow, but enforcement could find the family up to $250 per day. those are expensive eggs. the family says that the board decides not to change the rules, they will comply. the toll plaza on the beach line has a new date to be once and for all demolished. esther, the central florida

they 528 tollbooth would come down during the first two weeks of january. they have now change that to january 31. the demolition as part of the project to widen the beef -- beach line. a new website will make it easier to access thousands of public records. the open data website will include things like ellen permits and police calls for service but a big part of the information will be data related to domestic violence. today's small groups got together to share ways it could be used to reduce domestic violence cases. the website is set to roll out in march. osceola county is asking lawmakers to help build four new schools and expand a high school.. the facilities are needed to deal with growth. right now, the district receives impact fees from the construction of new homes but says it needs more money. the school district wants the state to reassess funding to help counties that are growing quickly. this is your 11:00 sports

the rain kept highway patrol troopers busy. in central florida, there were more than 100 crashes between midnight and 9 am. at one point, more than twice as many crashes as troopers to respond. we have even seen some crashes tonight because of rain. >> and more on the way. moisture develops on the gulf and slides in. temperatures holding in the 60s but a wet commute with rain likely on and off all the way for about late afternoon for most of us. >> be sure to watch eyewitness news tomorrow morning at 5:00.
