see the play equipment throughout, it looks like any other day care, when the police say he was abused by the director. this is video of a child, picked up and thrown to the ground, inside of a clermont day care that has parents stunned. >> oh, my god. i'd kill her. as a mom,s i'm sorry. >>reporter: clermont police say it happened inside of the children's palace day care center. the woman in the video is kimberly reid, arrested an child abuse charges, after a coworker recorded it on the cell phone. the boy in the video is just four years old. >> ridiculous. that's crazy. i'm upset. >>reporter: trisha ramos has a 4-year-old of her own. she

after seeing the video, she's glad she didn't. this is how the police say reid characterized her decisions. >> she chalked up to she was >>reporter: sent an e-mail day care's license. today, we saw a sign on the door that says temporarily closed due to change of ownership. >> that's ridiculous. >>reporter: but dcf says since the owner is relinquishing her license, anyone opening up this day care would have to apply for a new license. as for reid, she has been in trouble with the law before. we're working on putting that part of the story together for the 5:00 o'clock hour. for now, in lake county, channel 9 eyewitness news. today, an appeals court has just overturned the conviction and 45 year sentence for a man who killed a bar bouncer in downtown orlando. craig stabbed milton torres to death in 2011.

appeals just ruled that he should be resentenced on a lesser manslaughter conviction. the court said that he did not kill torres out of hatred or spite. the city of daytona beach wants you to donate to the homeless assistance programs, after dozens of homeless people carped out for 44 -- camped out for 44 years. on friday, the police relocated the camp over concerns of inappropriate activity. the city has set up a ling on their website for anyone to donate, so far, more than $100,000 has been raised. this afternoon, we've learned seminole county investigators are searching for the people who were riding in the same car that a boy was kill canned. the investigators say the teenager was in the car when opened fire in the car. roy ramos spoke to with the

the other people in the car ran off after the shooting. >>reporter: it's been three days since this, they have had a very hard time speaking to residences that live here in this neighborhood, until now. they say they are speaking to someone and we asked investigators if that person was in the car at the time of this shooting or may have witnessed what happened. they say they were unable to release that information, but these are also questions that that mother wants answers to. >> i need to know the truth. >>reporter: jeanina washington is searching for answers after her 15-year-old son, tamar harris was gunned down and killed friday afternoon. deputies said the shots rang out just after 3:00 o'clock can and when they arrived, tamar was lying on the ground and died after he was rushed to florida hospital altamonte. >> i just want my baby back. >>reporter: according to seminole county sheriff's deputies, tamir was a passenger in his mother's car, when shots

that the victim's mother had to say for yourself, download our wftv mobile news app and go to the video section to listen to her interview. a volusia county man facing charges, last year, christopher todd was accused of driving into a group of horse back riders when one yelled a racial slur. investigators say he hit a woman on horse back, injuring her and the horse later died. today, todd pleaded no contest to several charges. his sentencing has not yet been scheduled. >> in the next hour, hundreds of volusia county teachers are expected to attend a bargaining meeting, the teachers and the district have not reached an agreement after many teachers have decided not to work extra hours for school activities and field trips. the district is offering teachers a 3% raise, but teachers say new health benefits will require teachers to pay more money out of pocket. the first vote of the 2016 presidential election will be

mike is there now, mike, the one victim was a teacher of the year nominee. >>reporter: yeah, vanessa, investigators have identified her as 54-year-old sandra cook, they tell us that she lived in that house right over there. police tell us that they do know the name of that second victim, but they're not releasing it just yet, because they want to get a hod of that person's -- a hold of that person's family. just before 11:00 a.m., melbourne police came out here to investigate two deaths, they have not said how the victims were related or how they died, but they do tell us that they both knew one another. only two people were involved or they tell us that those were the only two people involved. neighbors tell us that they have not seen the victims in more than a month now. >> i don't know them very well, they're pretty much, you know, keep to themselves, he had a big airboat and a big truck.

you're watching channel 9 eyewitness news at 4:00, coverage you can count on. new this hour, what we're hearing from one of the good samaritans who jumped in to try to catch a thief, snatching an elderly woman's house. in marion county, you can see the suspect almost right there, ran down two people after he she tried to get away. the good samaritan and she told you she was almost run a over while trying to help. >>reporter: yeah, it happened all behind me here in this parking lot, now, that victim says that shes was just trying to help and that suspect lookeded like she was determined to get away, no matter how many people she had to plow through. take a look at this video. surveillance cameras rolling in

when deputies say this woman, snatched a 79-year-old woman's purse. and then, she smashed into numerous bystanders trying to help stop her. >> it happened so fast. >>reporter: in the video, you can see as the suspect wearing black walks towards the victim. you can see her grab the victim's purse and take off. the victim, wearing pink, chasing after the suspect. lori burns was getting out of her car and she heard the commotion and the victim screaming for help. . >> i can see this little lady, running, and she's hollering help with her arms in the air, and next thing she's going like this, my purse. >>reporter: she and the daughter's boyfriend sprang into action and caught the suspect, they caught up with her as she was getting into her car, they tried to get her out, the suspect decided to take off. >> with the door open, she put it in reverse, and just flew back as fast as she could. hit cole with the side of the door and the side of the door knocked me down. >>reporter: you can see burns and two others hit as the suspects was trying to get away.

but first, it is so warm, we actually have our sea breeze developing, now, this is typically something we talk about during the summer months. but remember the water temperatures are in the low 60s in brevard county, so that's cool enough to push some cool air inland, that's the sea breeze. and that can actually generate isolated showers, it won't t today but we can't rule it out for tomorrow. this evening, we're dry, temperatures in 270s, through dinner -- in the 70s through dinner time. then we drop in the 60s overnight. the morning low in orlando is 63 degrees. if you're at daytona beach, the morning temperature will be 60. cocoa beach, 65. the only 50s will be possible in marion county. morning temperature in ocala, 59 degrees. now, tomorrow is looking even warmer. especially if you're south or west of orlando here. think lake county, polk and osceola counties, tomorrow es's high is 83. palm coast, 73 tomorrow.

in the upper 70s in titusville tomorrow. downtown orlando, 82 tomorrow, 83 closer to the attractions, and ocoee winter garden 82. the warmest temperatures will be in lake county, 82 in leesburg, clermont, mascot, park ridge, 83 for a high temperature. and as i said, we'll get our sea breeze developing once again tomorrow. and a few isolated showers will be possible with that sea breeze, but there's really only a 10% chance for any rain tomorrow, so mainly dry. and still fairly warm. here's your five-day forecast with your weekend always in view. you can see a higher chance for rain, though, as we head towards thursday, this will be the day to watch. a chance for heavy rain, and a chance for thunderstorms. we're going to talk about your threats in the next half hour here, but behind that storm system, it's windy and colder on friday. and a nice looking saturday. some local lawmakers are taking a stand against drunk drivers, in an effort to keep you safer on the road.

this afternoon, there's a new effort underway to better protect water ways in seminole county, but homeowners are going to have to do their part as well. kimberly looked into why the county is so concerned with the kinds of plants home and property owners have been fronts. >>reporter: if seminole has its way, shorelines like the ones behind this home on lake jess sup, might stay just like this. >> i don't -- i do not have anything in particular that i will need to remove. >>reporter: an ordnance is in the workss to limit how much herrera and anyone else who lives on the county's rivers and front property. the county says the earliest that ordnance might go to public

right now, it's under revision, because of that, county leaders declined to talk about the proposal. but say it's aimed at protecting and improving the water. the current form of the ordnance says ever increasing pressures of additional uses are being placed on the shorelines. officials now want to monitor those shorelines to make sure owners have the proper plants and they don't clear out vegetation that clears the water, making it better for wildlife and native plants. someone wanted to build a dock like this one, they would need permission from the county, the okay to clear out vegetation like this that makes up so much of the shoreline. along herrera's stretch, that's no problem. he's not planning to change the landscape that made him want to buy this lake side home 11 months ago. >> the weeds that do grow around, you've got to keep them down, but i try not to destroy anything, just try to keep it as it is.

possible shooting on campus. >> i was horrified, honestly. i didn't think that anything that bad would happen at westport. >> now at 4:00, how a fight over the confederate flag started it all. nearly 2600 students go to westport high school in ocala, more than 1600 of them stayed home. >> the students who went to class had to get extra protection from 10 ocala police officers. tim barber is live at the school. district officials are blaming a fight regarding the confederate flag that continued to fester on social media all weekend. >>reporter: and greg, that fight about the flag happened here on thursday, during the lunch in the cafeteria. these students were off on friday because of teach er planning, it took three days online for this to spiral out of control. vanessa smith was horrified when her daughter told her there were rumors on line there would be a mass shooting at westport high school. >> i wanted her to go to school for the socialization aspect but

allegedly threatening to harm students and himself. a police report shows a 14-year-old boy threatened to shoot up the school but said it was a joke. they determined there was no threat to student sgls there is a $5,000 reward for anyone who can help the olde police find the suspect -- orlando police find the suspect. he shot 21-year-old devin littles in the caramel oaks condominiums on light lighthouse circle in august. robinson is a suspect in a home invasion robbery. investigators are trying to find a motive. a cocoa man who was supposed to be landscaping was instead of accused of stealing thousands of dollars in copper wiring on the job from a big cable provider. the thefts happened on bright house networks property in bell burn, james and a coworker were recorded on security cameras, he is charged with taking copper and criminal mischief. workers in ocoee had a scare

they hit a gas line near a high school. they had had to shut down ocoee crown point parkway before noontime. the officials say the workers realized they struck a utility line, but not a gas line. neither the school or houses had to be evacuated. the road reopened around noon. the explosive spread of the newest mosquito born virus has world health organizations scrambling. the zika virus is spreading so quickly that, the world health organization has declared it an international emergency. in recent months, common symptoms include fever, rash and joint pain, and experts have said these symptoms can be milder than the fever or west nile, both of which are in florida. however, the extra danger effects expecting moms whose babies can be born with a very serious birth defect, relateded to smaller head size, if mom gets sick is. that risk is bad enough for

decade ago and since then, lake nona has been booming and they need more schools, but the district is refusing to build more schools beyond those trees. lake nona is a priority for the orange county school district, leaders say they want to build five new schools to accommodate all of the children they predict will continue to move into what they called their fastest growing part of orange county. but there are about 1500 acres of land where they won't put a school. 8 years ago, the army corps of engineers blew up the old bombs and rockets. they were uncovered decades after the site was used to test bombs after world war ii. not far from odyssey middle is vacant land where homes have been -- they don't want to take the risk of building a school on the that land, etch though millions of dollars went into cleaning it up. or those five schools could go is still unclear, but it is

are approved, the area will need more schools. and there's a big chunk of land where they can't go. four of the development plans to be approved, the district and the dropper will have to cop -- developer will have to come to agreement how they can get enough schools in the area to support all of the children to move in. deneige broom, channel 9, eyewitness news. the development proposals haven't made it to the school board yet because it's in the planning process. some of florida's adoption laws could be overhauled rierth now, adoption agencys is can ask courts to put children in the homes their birth parents prefer. but a new bill would allow budges to put the best -- judges to put the children in the best. the florida house plans to take up two controversial gun bills tomorrow as well. one would allow concealed weapon permit holders to carry their guns on college campuses in florida. the other would let permit

but channel 9 learned some are questioning if the changes would make us safer. >>reporter: ryan lost a friend a few years ago who was drung behind the wheel. -- drunk behind the wheel. get pulled over and you'll be asked to take a breath test. drivers who refuse can have their licenses suspended for a year. but lawmakers are considering tougher penalties, including fines, probation, points on a license and ignition interlocks. the goal, cut down on refusals, but ryan believes only jail time will make drivers think twice. >> six months of sitting in a cell, you're not going to get that six months back. >>reporter: a dui attorney says prosecutors don't need the breath test to gain a conviction, but it can help. drivers tend to have a variety of reasons for refusing the car. >> some people don't take it because oh, i've had way too much to drink.

flint, michigan is not the only place you'll find dangerous levels of lead. >> we checked government numbers today and they show two counties here in florida reported high levels in young children. channel 9 looked through the numbers today, and george, the troublesome levels are in children 6 years old and younger. >>reporter: yes, it was amazing, to look through those numbers, the two counties in florida are diks si and washington counts. they tested positive for high levels of lead. the water crisis in flint, michigan is highlighting the
