he was supervised by mental health professionals, deputies say he stabbed his own mother 23 times. tonight, the question is how close was that supervision? orange county deputies say they picked up gresham and her boyfriend, david, yertd morning under the baker agent, which a allows the deputies to take someone into custody if they're a threat to themselves. that happened just hours after the investigators found 81-year-old julie gresham stabbed to death inside of this home. >> it's a sad situation. >>reporter: this court order eyewitness news about taned shows he ended up in the court system again in 2007, that time, deputies charged him with stabbing his mother to death. but a court found him not guilty buzz a judge determined he was was insane. >>reporter: these court documents say he ordered him here to lake side behavioral healthcare for psychiatric evaluations, but the records

storms iss over in severe weather center 9. >> bob, still have a tornado watch out for the far western panhandle until 10:00. we may get another watch expanding across parts of north florida early in the morning. right now, we're watching the big batch moving our way, ahead of it clouds, but a few coastal showers tonight. this is the timing of storms between 2:00 and 4:00 in our western zones near the i-75 corridor and the turnpike. we could see the highest risk of scattered wind damage with strong winds from the gulf between 3:00 and 6:00. for the i-4 corridor. very early on in the morning. and in fact, orlando, the forecast models showing rain, lightning and some heavy downpours, right at 5:00 a.m. i'm updating more timing, including a brighter out look, when it finally gets to be martha. right now, state troopers are trying to track down a driver who left a jogger dying in a ditch. they found the victim and nothing he could do to help.

avenue in west cocoa. so far, the troopers tell you there are no ynss to this crash. >>reporter: -- ynss to eyewitnesses to this crash. >> it would have been dark and dusty along this rule road, it's possible that the hit-and-run driver never saw the victim. 39-year-old jason -- went for a morning jog and never returned home. when his girlfriend and friends went searching, they discovered his body in west cocoa. he was the victim of a hit-and-run. >> i think that's sad. i think that's really sad, i don think that should have happened. >>reporter: troopers say the driver definitely should have stopped. >> we don't know, had this person received immediate care, what his outcome may have been. >>reporter: troopers told me fhp investigated 448 hit-and-run crashes in brevard county last year.

crash on mall bar road, which is still open. the troopers do have clues to close this latest crash. >> we do have parts of what appear to be a turn signal, but trying to confirm. we don't have a vehicle distinction, or any witnesses or a pinpoint of when this crash happened between 4:30 and 5:30. >>reporter: troopers believe they are looking for a light gray cris letter, working -- chrysler, they're checking a nearby convenience store and the hopes of catching video of the vehicle involved in the hit-and-run. on this dusty, rural road, the driver may not have faced charges if he or she, sichly would have stopped. -- simply would have stopped. and i'm also told by fhp, the message they want to drive home is this, if you think you hit a sign, an animal, get out of the vehicle and check and call 911 immediately. live here in brevard county, channel 9 eyewitness news. the state is trying to shut down an orange county home day

admitted to officials that one child inappropriately touched another child in her care. dcf is looking into the apopka home day care near vicks road. tim barber has been in touch with them and the owner and if owner told you she hadn't had a problem in nearly two decades. >>reporter: and bob, shes also says that she has a good reason why she did not see the alleged abuse. nearly 20 years ago, sheri quit her career and followed her dream to care for kids. . >> we have our fishing, matching game. >>reporter: but recently, that dream turned into a nightmare. >> it's upsetting to me. because these kids, these parents, you know, this is why i do what i do. >>reporter: in december, dcf filed this complaint. it was filed after a 4-year-old boy was accused of inappropriately touched a 5-year-old girl while she was in another room. she did not see the abuse

up on her and she was washing it out of her hair. she ran into her bedroom, to grab a towel, then came over to the kitchen to wash herself and the baby off, and that lasted no more than 3-4 minutes. >> under the law, a family home day care can have up to ten kids. she and her mother usually watch half that amount. the only reason dcf found out is she reported it to the child abuse hotline herself. she says it was the right thing to do. >> i didn't get an attorney, because i didn't feel i needed one. but now, i'm reconsidering that. >>reporter: she is asking for a hearing to share her side of the story with dcf. neither of the kid goss to the day care anymore. we reached up to the officials in tallahassee and vnts heard -- haven't heard back. in orange county, tim barber, channel 9 yns news. -- eyewitness news. we're ready with a report on the breaking news in orange county.

barbara road in pine hills where a mother and her teenage daughter were found dead in a home, and ty, what have you been able to learn? >>reporter: martha, i just talked to the deputies about 15 minutes ago and and they told me they do not believe this is a murder-suicide. this is mine hills and they confirm to me that a mom and her teenage daughter were found dead here in a home in pine hills. overhead from sky witness 9. crime scene investigators arrived, we learned both bodies, the mom and the daughter, were found around 2:30 this afternoon. now, deputies say again, it does not appear that it's a murder-suicide. but investigators told us that both bodies were found by a man who lives at the home. now, deputies would not say if t relation. and right now, deputies are canvassing the area, they are talking to neighbors, for any leads on any suspects, they don't have any suspects named at this point. now, there are several questions, we are still working on, for instance, the identities and we're also asking deputies

we're following breaking news in orange county where a death investigation is underway. at a pine hills home, a mother and her teenage daughter were found dead inside earlier this afternoon. live look right now from sky witness 9. at this point, the deputies will only call the deaths suspicious, they have not released the victim's names, of course, digging to get more information, as soon as we get it, we'll pass it to you. a local insurance agent is accused of stealing the identity of one of his customers and stealing her money, too. this man, is already facing charges in one case. and channel 9's jeff deal found out, state investigators believe he could have more victims. >>reporter: standing in front of a judge. >> that from a person 65 years of age, or older. >>reporter: a registered insurance agent, accused of using his trade to steal from clients.

me, you know, you can trust me. >>reporter: 66-year-old napier lives on social security, she met him while working as an office. he showed up at her home and convinced hader to hand over funeral costs. with the money. >> yes, i paid him cash. i paid him cash, i trust him. and i believe in him and i trusted him. >>reporter: the investigators believe he pulled a bait and switch on a phoenix life insurance policy, telling her it will be $58 a month when in reality, it was $118 a month automatically taken from her account. then they say he stole her identity to sign up for two more policies also with automatic withdrawals. he has since bonded out of jail. no one answered at his winter garden home, but state division of insurance fraud investigators believe he likely has more victims. they're investigating two other case s, also involving senior citizens.

he's not allowed to sell beer or wine in the same location that housed a hooter that did the same thing. the problem is, legacy middle school the 300 feet away and that's against zoning rules. shannon butler stoke with the owner today who hopes the commissioners change their minds. >>reporter: this now empty building will be home to a new japanese restaurant. that's it. the county will bend the rules. county law says the food can come, but the beer and wine with r banned. the location is directly across from a school. the county ordnance says booze can be served only if it's 1,000 feet away from a school. and he is only 370 feet. >> although the code does require 1,000 feet, e i think this is a situation where a variance of that amount would serve for the better than the worse.
