to come here and turn himself in: but for now, officers here are relieved that sergeant marcy pierce has been released from the hospital, and that her injuries, while painful, are not life threatening. >> if they're hanging out doing things they're not suppose today be doing, then we're trying to change that behavior. >> that was what orange county sergeant marcy pierce told us when we rode along with her in the same area where she was this morning, again, working juvenile crime. she was hired by the sheriff's office 22 years ago, and is highly regarded. today, sheriff jerry said she has a very jovial personalty even after what she went through this morning. we are told he suffered head, hand and back injuries but is expected to be okay. this is the teenager she was working to take into custody for vehicle burglaries. the sheriff says he should be considered dangerous because he's now accused of trying to kill sergeant pierce. we looked into his criminal

office has arrested him for stealing a vehicle and assaulting an officer with it while escaping when he was just 14 years old. the 15-year-old has also been arrested for stealing a gun and armed burglary. >> we are trying to find out how all of those charges were resolved but not all juvenile records are public. the sheriff is asking anyone with information about his whereabouts to call crime line. you can find that number on there's probably one officer here at the sheriff's office who is most reloved that sergeant pierce is going to be okay. that's sergeant paul smalley, her husband. >> reporting live from the sheriff head quarter, channel 9 eyewitness new. >> >> earlier this week the trial was delayed for another teen accuse of running down an orlando police officer. we were there tuesday as the judge pushed back edward's attempted murder trial date to give both sides more time to prepare. investigators say he ran over

been reported as having the virus. now, take a look that the map. during the last few week, it has hit ten florida down i in new case in orange county means 26. the most in the entire nation. jeff deal has been following this story. this comes days after they tried to keep the virus out of the local mosquito violation. >> that's right. that was on tuesday. the death briefed the commissioners on the virus and how to pretend the spread of it. this is the first confirmed it case in orange county but we've had other confirmed cases. the important thing to point out though is health officials don't belief any of the cases in florida came from mosquitoes here in florida. every person infected contracted the virus in another country, they believe. we just learned the person in orange county recently traveled to columbia.

if you have gassed up in st. cloud your debitor credit card information could be at risk. police found a skimmer at this 7-eleven on u.s. 192. we have been telling you about this for weeks, so channel 9 talk window customers about how this is impacting them. this has been an on going issue, just this week another was found at st. cloud pumps gas that the 7-lech all the time.

>> this afternoon the trial for a man accused of killing a wife and her two children is still on hold. the attorneys suddenly with drew the motion for a speedy trial. as plain reports a judge had to order him to appear in court today because at first he refused to go. >> the judge said he did not want to come to court today and he was quote extra kateed from his cell. his attorneys would not tell me why exactly but they did say he's under a lot of pressure as he continues to wait for his trial that is still on hold. >> there's still no date set

he smiled as he spoke with his attorneys. this morning they with drew their demand for a speedy trial and would not say why. >> we're trying to do what's in his best interest to make sure his rights are preserved. >> he has been in jail since 2013 accused of killing his wife and her two children, eight and nine-year-old michael and -- the bodies were never found: before the hearing, the judge saidtoledo refuse today come to court. >> i did order the deputies to bring him to courthouse today because i found this to be a critical hearing which required his participation and my questioning of your client. >> he asked attorneys to. >> he came to court on his own accord. >> you came voluntarily. >> they still intend to seek the death penalty if he's convicted and if the state passes new legislation for the death penalty procedure which was ruled unconstitutional by the u.s. supreme court.

indicate who they have found. after 24 hours it is suspended for bones inside these. they will have come back another day with heavier remains. >> they may already have made a connection to a missing person. a deputy told us there are indicators they found this man, adolph gray. he vanished in august of 20 had after leaving va lisa county jail a quarter mile away from today's search site. the family plans to search after his disappearance, instead our records show deputies used atvs to look for any signsover gray but it wasn't until yesterday when a surveyor found a piece of a mu man skull they again canvassed the area focusing on a spot under three feet of water about 100 yards inside the tree line.

point, nasdaq saw an increase of 17. sp 500 was down less than 1 point. an orlando man claimed a big machrees train refused to honor a warranty. he's one of 7 other consumers against machrees one. we tracked down the company for results. >> vanessa a florida attorney general investigation into machrees one ended with an agreement that it would make big changes. so i contacted the company this week, trying to help several consumers. >> the machrees had been stacked in a back bedroom for a year, ever since eddie claimed machrees one refused to honor its return policy. >> completely -- because i try everything. >> days after delivery, he told the store he could not sleep on it and wanted to return it like the store promised. >> if you don't like it, you got your money back. he says we have the same thing.

>> he say it is company refused to. >> machrees one told me it had been willing to replace it and he misunderstood the warranty. since 2014, 7 consumers contacted action 9 with complaints. and we sent those to the company with few results. machrees one is rated f at the bbb, with 294 complaints. >> eddie sued the company in small claims court and won a $1300 judgment. five months later he called action 9 because the company had still not paid him. >> it is completely unfair. >> so in people complain the florida attorney general opened an investigation. just recently they settled the case. >> the company signed a voluntary compliance agreement not admitting guilt but agreeing to change business practice. >> i contacted it store last week about eddie's complaint and four others. a customer service manager now said one complaint was already resolved, it will review the others.
