the millionaire convicted of killing his wife is getting a new trial and that might not be all. the lawyer for bob ward is also trying to get him out of prison while he waits to be tried for a second time. we told you last year about how ward filed paperwork saying his attorney made too many mistakes and he didn't get a fair trial.

go to a second trial. a big development in this ongoing case. >> reporter: it really is. it's something defendants do all the time in appeals but it doesn't often work. the former billionaire -- millionaire will get a second trial. ward should be freed while he now awaits a new trial according to his attorney. the new trial request was granted mostly because of this video that convinced jennifer -- judge jennifer harris that work should get a new trial. the tip was from a holding cell when ward asked for a -- an attorney but prosecutors used the entire 32 minutes of the tape in court. in closing arguments, his refusal to speak to investigators are test his hands for gun residue meant he was guilty. judge harris said bob ward's attorney didn't object enough with prosecutors when they used evidence that violated his right to remain silent.

and he in fact did not get a fair trial. prosecutors addressed word's right to remain silent 25 times. the state attorney we just talked to said they have already appealed. they will take that up. the attorney general will do so in the appeals court. jennifer judge harris is the same judge who presided over the trial. right now we are working to find out why the judge has come to this conclusion now and didn't come to it back then. we will have much more tonight on i was -- eyewitness news at 5:00. we are tracking some showers developing this afternoon and even heavier rain in the forecast for tomorrow. rusty mccranie is tracking the latest for us from severe weather center 9. >> from here until this time tomorrow you will want the umbrellas if you're heading out. showers just percolating right now at the lunchtime hour across central florida.

you can see darker bases to the clouds but generally dry across the region and its warm. 790 in downtown, 800 in daytona. a brisk wind is cranking of the warmth. same thing in kissimmee and claremont. a couple showers in polk county near winterhaven. we have seen a couple try to get going in lake county. a small share just passed over groveland but not much is happening. i want to take you to the broader view. take a look at this massive system in the southern plains. it's beginning to move into the gulf coast states. this will bring a widespread outbreak to the gulf coast including our western panhandle later today and that is the storm system that the march in tomorrow. today, it's more of a local garden-variety thought -- a storm but it will increase across various parts of florida. we will look at the potential for severe storms moving into the region tomorrow morning. we will get timing and impact

other injuries caused aches and pains. she was trying to take jancarlos ortiz for vehicle theft. he apparently didn't want to go back to juvenile court where he has already faced charges for allegedly attacking a deputy with a stolen car where he try to get away and for allegedly stealing a firearm. both of those cases were from last year. sheriff deming's appealed to the teenager to turn himself into a void in the confrontation like the one that happened here. the sheriff stopped short of saying he believes ortiz should be charged as an adult saying that is up to prosecutors. we could find out today what the state's intention is for when he faces a judge. kathi belich, channel 1 eyewitness news. two deputies are off the investigation. investigation came after

officer kimberly brey try to purchase drugs at a party. brey was asked to take a drug test but she and the other deputy resigned. struck falluja county deputies have now released the name of one of the motorcyclists who died in a crash in volusia county. rosemary mayo was on a motorcycle with a man when a truck drove into their path on north u.s. 1 in oak hill last night. patrick was driven by michael wilson. female motorcyclist was pronounced dead at the scene. mayo died at the scene. no word yet if wilson will face charges. a man is in the hospital after gunshot wounds. police say that was no mistake. kimberly eaton learned from investigators that three suspects targeted the victim but police have not said live. >> reporter: no, but when police searched the apartment behind us in this complex, where that shooting happened, they reported smelling pot and

they have not said whether or not the men who stormed in and opened fire were looking for drugs. one man is in the hospital and the three men who put him there are still on the run from police this afternoon now say the suspect -- suspects targeted roger brown. >> he never filter all those gunshots. >> reporter: cayleb jones found her brother with three shots to the gut. he is now in serious but stable condition. before he was rushed to the hospital, brown told police and his sister how the gunfire started with a knock on the door. >> he gave it up and next thing you know, gunshots. >> reporter: no one else was hit. brown describes them as three black man, a very vague description as officers continue to search for the suspects. detectives do so they will interview the victim again asking for covers but for now that is all pay and his family

>> you have your mom and little brother and their with a bullet stuck in the wall. it almost) hit my mom. >> reporter: she says she is trying to talk to her brother to ask about the shooter but that he is into bad of shape to ask anything. that is the same problem police are running into but we will check back in with them later this afternoon to see if they have a better suspect description. this afternoon, crews are still working to restore water to about 30 homes in ocala following a water main break. this video shows just how bad the break was. a precautionary boil water advisory is in effect for those affected. crews expect the water to be back sometime today. no word yet on what caused the breakage. nevada caucuses are tonight. marco rubio appears to be gaining some scene. the senator from florida has received a major injection of establishment money and support.

new at noon, president obama said the detention center at guantanamo bay undermines america's national security and needs to be closed. the president laid out a plan for the closure but jacqueline fell reports that faces stiff opposition from the gop led congress. >> reporter: the president says keeping guantanamo bay open drains military resources. he is cementing his plan to congress today. he says terrorists are using the guantanamo bay detention center as propaganda to recruit members. the president says under his plan, 35 of the 91 prisoners would be transferred to other countries. the rest, is considered too dangerous to transfer, would come here to the united states. he wants to work with congress to find a location that could securely hold those detainees. the president also says

area just after daybreak tomorrow morning. that's when you need to start really paying attention to the weather. we will have those storms lining up along our western zones and then marching from west to east. this is 10 am. storms lining up across i-4 producing gusty winds. some of these storms will attempt to rotate so we do have to watch for an isolated tornado. storms will fire off the coastline into the afternoon. this will not last all day but through midmorning and midafternoon is our highest risk for severe weather. today, the red bull's-eye, moderate risk level iv out of includes tallahassee. then, tomorrow the storm heads of the east coast. the site risk does include orlando to all areas north and west but even if you are in the green you could see some strong to severe storms. the overall threat tomorrow, wins most widespread at over 15

today, the marion county teenager convicted of luring her ex-boyfriend to his death was sentenced to 25 years to life in prison. investigators say amber wright and three other teams murdered seth jackson four years ago. her previous conviction was thrown out because she had not been properly read her miranda rights but a second jury came back with the same jury as the first, guilty work today, she said she deserve to be punished

countless recalls. that new recall with nearly triple that. 90 million airbags being recalled. the airbags have been known to explode during collision and send shrapnel at the driver. so far, nine people including an orlando women have died because of those impact. the president has officially requested $1.9 million to fight zika. that would go to stopping the virus into the u.s. and south america. he is also asking for leftover money used to fight ebola to contribute to the fight against zika. there 28 confirmed cases in florida, four in central florida. now that jeb bush is out of the 2016 presidential race, voters across florida are wondering if they can get a do over on their absentee ballots. the former florida governor dropped out of the race over the weekend. he will now -- supervisors of elections say they are now getting calls from voters wanting to change their ballots but they say once you cast your

new details emerging about the suspect in that deadly shooting spree in michigan. he is charged with killing six and injuring two others. investigators say the uber driver has admitted to his rampage and we are learning what he may have done hours before the shooting. elizabeth hur has more. >> reporter: charged with six martyrs and facing life in prison. >> do you understand the charges? >> yes, sir. >>reporter: jason dalton showed no emotion. >> i prefer to remain silent. >> reporter: and revealed no new details during his arraignment. prosecutors say the 45-year-old admitted to investigators he took people's lives..net's friends a say they are in disbelief. >> he was very quiet and reserved, not afraid to speak his mind but definitely not out to ever cause anybody trouble. >> reporter: according to the detroit free press, dalton once worked as an insurance

father of a 10 and 15-year-old. we are also learning from a local gun shop owner, dalton stopped in once a month and but a tactical jacket there just hours before the shooting. >>reporter: casey black say she called 911 to report his erratic driving saturday afternoon. uber confirms getting reports of his driving between the attacks that maintains those were the first complaints about him. dalton stands accused of shooting a people at three separate locations, killing six and injuring two. that includes a 14-year-old girl in critical condition, initially believed to be brain dead. >> abigail is strong. everybody needs to get that straight. my daughter is not dead. >> reporter: authorities say dalton is cooperating but still not talking about a motive. he is due back in court next thursday. we are following breaking news right now in altamont springs where we are getting reports of a shooting.

a new report shows the number of women getting double mastectomies has tripled over a decade. even though breast cancer rates have remained the same. >> the risk of recurrence or death after being treated with mastectomy versus lumpectomy with radiation is the same. >> the rest department of health study data between 2005 in 2013 and found rates of a single mastectomy also went up by 36% and those who got double mastectomies were about 10 years younger. doctors say women are choosing to have both breasts removed for two reasons, including the -- gene and tumors. many employers are trying to get their employees healthier by implementing workplace wellness programs. the programs are often for things like cash or gift cards for meeting you daily fitness goal but a new study shows those employees may be more motivated by the threat of

fentanyl is used to choose see -- is used to treat severe pain but it's connection to deficits soaring across the state. in central florida, it has been linked to 60 deaths last year. daralene jones started digging into the root of the problem and changed -- chased it back to heroine. >> reporter: john's addiction started with pills but his expensive. so, he was turned on to heroine. >> he was a smart kid. >> reporter: that's the thing. heroine doesn't discriminate. she watched her son go in and out of treatment programs in orlando and in 2014, she thought he finally turned the corner. >> he was going to bible study. he had money. he had just bought a laptop and clothes. a new bike to get around.

his body was found that lead to come -- badly decomposed. the corner found syringes, baggies and a glass pipe and a high level of fentanyl in his system. the heroin he ingested was likely laced with it. >> heroine is 2 to 3 times more powerful than morphine and fentanyl is up to 100 times more powerful. >> reporter: 9 investigates reviewed medical examiner reports statewide for deaths caused by heroine laced with fentanyl or. fentanyl. 530 8f ; 2014 were reported to the state, nearly double the year before. central florida accounted for nearly 145 of those deaths in 2014 alone. >> so when you mix this with heroine it sounds like it's instant death? >> it can be. >> reporter: there are survivors meaning the scope of the problem is far worse than the death toll piling up at the more.

in the celebration area, this list of three attractions in the next 15 minutes. right now, no lightning out of any of this but there could be pockets of heavier rain as it moves through the western sides of orange county toward holden heights. it hits winter garden and about 27 minutes. brief downpours there. then, this means storm system in the seven planes already beginning to move into louisiana. we've had two tornado warnings near new orleans and additional warnings are likely for mississippi, alabama and into our panhandle as far east as tallahassee. this is more of a localized event for us. rather than that part of the massive storm system which we will see tomorrow. scattered showers, more garden- variety, some thunder along the east coast and then all that moves off to the east. the atmosphere reloads for what we will see tomorrow. highs sink in around 800.
