and now during his 30-minute speech, senator rubio told supporters he will win next week and then again in november. he never mentioned how much he needs the support next week. >> reporter: presidential hopeful marco rubio is fighting to win all 99 delegates in his home of florida. it's a must-win state after polls show he's not winning. they'll have a final count tomorrow. rubio reminded people he served for florida in the state house and even as house speaker before being elected as senator in washington, dc. he never mentioned his republican opponents by name during the rally. by his delegates are far less than ted cruz and donald trump. he needs more than 1200 delegates to clinch the nomination. >> it always comes down to florida! it'll come down to florida on the 15th and in november!

"this morning" beginning at 5:00. a teenage fight escalated into an ambush when a family says two men fired nearly two dozen shots at their orange county home. and sop of the bullets nearly missed where -- and some of the bullets nearly missed where a baby will be sleeping earlier. cameron, the family told you they know who pulled the trig. >> reporter: and, greg, they told me -- trigger. >> reporter: and, greg, they told me they directed officers to them. you can see bullet holes in their garage door. but there still will be no arrests earlier. an orange county family is counting bullet holes and counting their blessings after a narrow escape from an enlawsuit of gunfire. >> he came -- enslot of gun fire. >> he just came out shooting. >> reporter: he opened the door to the shooter and an accomplice saturday night. with both men still on the run, he asked we not show him on camera but took us through the

he says two guys showed up and asked for his brother. >> i opened the door and answered them. i said, yes, the kid lives here. with that, he says one man stepped to the side and the other pulled out a gun. he slammed the door and took cover. >> he let off about -- i don't know, 13 shots or better? and they just shot -- shot up the house and ran off! >> reporter: the victim find out later his 19-year-old brother had got into a fight with the men at a party earlier that night. they believe the gunfire was retaliation. 22 shots in all, one hitting a swing where a 6-month-old baby night. >> if my son would have been in that swing, i wouldn't have a son right now. >> reporter: orange county deputies are investigating so far with no arrests. the family says they know who pulled the trigger. >> i just want them to be caught and prosecuted because fair. >> reporter: and the family tells me they don't know what started the fight that led to

but they say that this is taking things too far. now, of course, we'll be checking in with orange county deputies as they continue to investigate and make any arrests. reporting live in orange county, kimberly eden, channel 9 eyewitness news. and we're following breaking news out of tallahassee tonight. the state legislature has reached a late night budget deal which means lawmakers will end their budget fridays. they reached an agreement on dozens of spending items, including a bonus program which gives highly rated teachers scores for scoring well. reports of credit card skimmers at gas stations. we were there as state investigators uncovered a skimming operation in port st. john. they believe the crooks are targeting gas stations now because they will be the last businesses to get the more secured chip card readers instead of the swipe card readers. and these devices have been popping up in other areas in central florida. we told you about several skimmers discovered in gas stations all over osceola

last month, we even followed kissimmee police as they opened every gas pump in the sports in an effort to keep customers safe. they even told us random gas pump sweeps like that one could happen again. we'll be checking with winter park police in the morning to get more information about a man accused of having sex with a minor and not disclosing he was hiv positive. court documents show richey smith, jr., may have also had syphillus at the time of the incident. earlier this month, a judge ruled bob ward deserved a new trial after claiming his attorney made mistakes back in 2011. the new trial is likely years away and his lawyer wants bond granted while he waits. daytona beach police are

they say stole a car with a little girl inside. >> this happened this morning when police say she ran inside to pick up another child so they could go to school. mike spoke with the girl's aunt tonight. she says that girl is doing okay tonight. >> reporter: she's safe at home with her mother. but knowing that they're still searching for that suspect has the whole family nervous. >> reporter: michelle daye was at work this morning when she got the call that someone stole a car with her 12-year-old niece inside. >> it was just frightening. >> reporter: daytona beach police say it all started here on white court when they say the girl's mother got out of the car to pick up another kid for school. that's when police say the thief hopped in and took off with the woman's daughter still inside. investigators say the guy only got a few blocks down the road before he ditched the car here at eagle park apartments after they say he noticed the little girl in the backseat. eyewitnesses say they spotted

complex just seconds after dumping the car. eyewitness news got a copy of the mother's 911 call just moments after she realized her daughter was gone. >> yes, my daughter's in the backseat. and what i'm mainly concerned about is she's in the backseat. >> oh, yeah, definitely. >> this is scary, somebody jump in the car or whatever and you have kids. it makes you think about your kids. >> reporter: how does it make you feel the person that did this is still on the loose? >> that is very scary because he can end up doing it to someone else. >> reporter: investigators did get a description of that suspect. they say he has gold teeth and a mohawk. if you see him, daytona beach police want to hear from you. we're live in daytona beach, mike manzoni, channel 9 eyewitness news. tonight we find out that within the past two week, four lake county high school students have been arrested, accused of bringing weapons to school. last friday, a south lake high school student was arrested for bringing a butterfly knife to school.

the same school was arrested for having a knife. and two days before that, two students at umatilla high school were arrested for having a gun. a sumter county caretaker is facing charges for ripping off a 90-year-old woman she was supposed to be taking care of. they say amanda warner stole $2,000 from an elderly victim. she took a credit card and helped herself to the money. after they discovered what was going on, they called the sheriff's office and reported it. juries will now have the final say on whether a criminal lives or died. if 10 you out of 12 jurors vote in fair of the death penalty, they get put on death row. until today, a judge made that final decision. today we find out that governor rick scott will have the final say on a new ucf campus in downtown orlando. yesterday state lawmakers approved a plan to set aside $20 million for the project.

that request once doing that last year. we spoke with him today. he told us he's waiting on legislatures in tallahassee to send him the budget before he reviews the latest plan. 9 investigates learned it'll be difficult to prosecute the unnamed public official connected to a bogus charity. we've been telling you about one door for education and its ties to congresswoman corinne brown. she hasn't been named in the federal investigation. but the founder took a plea deal today, telling donors they were collected money for scholarships bah they really went towards personal expenses. a former federal prosecutor told us they have to prove the case isn't politically motivated before the unnamed official can be indicted. an orange county commissioner told us he was looking for money to replace

daylight saving time. that's this upcoming weekend. temperatures are in the 50s in palm coast, daytona beach, and deland. at 10:00 on tv 27, we were showing you the 50s. deltona and seminole county, altemonte springs as well, 64 in orlando. by morning, temperatures widespread in the 50s from 53 in ocala to 57 in clermont, kissimmee, and poinciana. but if you're in brevard county, low to mid-60s. a more mild morning. 57 is where you'll start when you wake up in the morning in orlando. i want you to check in, though, with brian shields. he'll be watching if any fog pockets develop. we had a few ongoing brushfires. so we'll have to watch those zones in case pockets of fog develops. we're back to 80 in orlando, kissimmee. county by county, again, your high temperature will depend on your location.

some orlando residents got a big scare yesterday when a loud noise suddenly shook their homes. and they told us they were surprised when they learned the shake was caused by a massive tree right there which collapsed in the middle of lake eola heights. we're asking what's being done to keep residents safe when it comes to accidents like this one. they told us more than 40 sports trees are on a removal -- 40 sports trees are on i aa removal list. condition on on a removal list. commissioners approved new rules to require more groups doing a better job of reporting how they spend money. current rules require followup reports but critics say that rarely happens. some local drivers are getting burned by e pass. we told you when the central florida expressway authority removed the indicators which
