shooting on the lynnway early this morning. >> the individual had his hands in his pockets, the officers ordered him to show his hands, refused to do so, continued to come at the officers, they moved back, tried to create distance, eventually one of the officers fired his weapon. >> lynn police say the suspect fled from this gulf station on commercial street, after he allegedly walked into the store with his hand in his pocket, claiming he had a gun intending to rob the place. and then, the clerk reacted. the clerk of the store. >> that's wrong. like just like giving whatever they need, be safe and call the cops. >> the reporter: denny manages the shell across the street from the armed robbery, and he says, they're not uncommon in the area. >> i feel bad for the next door. i would advise to get, like a service window during the overnight shift. >> the reporter: now, the district attorney's office says

morning, milton stood before a judge today in brockton district court, charged with leaving the scene of personal injury and death and reckless operation of a motor vehicle. sergio lacone, who was critically injured in the hit-and-run, was taken off live support early monday morning. in court today, the defense told the judge after hitting lacone, guncall panicked, but turned himself in two days later, because he wanted today do what was right. >> he was unable to sleep the entire weekend leading station -- going down to the police station. >> the reporter: gonecall is married and a father of four children, who are between 8 and 14 years old. >> all i know is he's a good guy. and he's my friend. also, he knows my family. >> the reporter: prosecutors saigoncall admitted on tape to hitting lacone with this jaguar and then driving home. >> he stated it happened very fast and that he struck the person and proceeded to panic andreoff home. >> the reporter: prosecutors

found alone on the side of a busy road. this happened in lee, the child crossed the street and was found on an on-ramp. robert goulston live with us tonight with reaction from the boy's mother. robert. >> the reporter: vanessa, yeah, that 3-year-old boy made it across this busy street and about 75 feet up this highway ramp, the mother telling us, she picked up the boy a few hours later at the day care, but nobody told her. locals cannot believe that toddler made it this far. it even has the locals in disbelief. >> thank god nothing happened. >> the reporter: lee new hampshire police say a 3-year-old boy walked away from his day care and ended up playing basketball. she says her sons has down's syndrome, so he can't communicate easily, but she is so thankful a man driving by stopped and helped him. he walked out on to this busy

highway. the day care, his angels learning academy, voluntarily shut down right after the incident, but the boy's mother telling us, the day care never told her what happened, even when she picked him up that day. she ace sherbinski ex-husband was first notified that her son was no longer allowed at the day care, because he was a safety concern. it wasn't until the police called that they found out what really happened. one local telling us, the road the boy crossed is treacherous. >> traffic on 155, it's 40 miles an hour, and there's hills they exceed 60 sometimes, so you know, i'm kind of amazed that nothing drastic happened. >> the reporter: the state telling us, the center voluntarily closed on november 23rd, the department is aware of the incident in question, and is conducting an investigation to determine whether future action is warranted. the man who found the boy told us when he alerted the day care about the child they found, they had first told him they were not missing any one. the day care is a pretty good distance from the intersection

new at 5:30 p.m., a california couple stuck in a snowy forest for two nights lucky to be alive. they were driving on a mountain path when their tires became stuck deep in snow on saturday. the man climbed to higher ground, and sent a text message with their location, but rescuers did not find them until late yesterday afternoon. luckily, the couple was prepared. >> we had sleeping bags and we had food, we had water, so yeah, we did fairly well, i started to tomorrow is going to be burn the tire. burn the tire day. >> mark: the couple is fine, and happy to be back, i would imagine, with their family. >> vanessa: a south florida man is on the road to recovery after an alligator attacked him while he was duck hunting in the everglades. the 50-year-old says he was wading through the water with his friend last week when he thought he brushed up against a log, but within seconds, he knew it was something more serious.
