the u.s. supreme court has spoken. honest services will not stand affecting high profile cases like former enron exec, jeffrey skilling. conrad black. and some of the charns against former governor rod blagojevich are based on this law. good afternoon. i'm sean lewis in for steve sanders. >> i'm allison payne. we welcome our viewers who are watching us around the country on wgn america. in a unanimous ruling by the justices today, the high court set limits on the use of the honest services law. the ruling in effect states that prosecutors were wrong in using the fraud statute to

convict former enron ceo jeffrey skilling. >> in her opinion justice ruth bader ginsburg wrote that prosecutors may continue to seek honest services fraud convictions in cases where evidence shows that defendants acceptd bribes or kickbacks. that is something that did not happen in the skilling case or in the case of former sometimes newspaper magnet conrad black. what does the ruling mean for blagojevich who was on trial right now? wgn's julie unruh is live in the loop at the trial. good afternoon, julie. >> remember, both the jeffrey skilling and conrad black cases are the ones that brought this to light but they were convicted on the flews and in both cases they are the ones who appeal to the u.s. supreme court those cases will indeed be affected by today's decision. the decision essentially weakening their conviction. in the blagojevich case, barely blip on the screen this morning for months the ek governor's lawyers had been complaining that effective honest services

was far too vague. until the appeal in the other cases was decided blagojevich sought to have his case delayed. judge james zagel refused time and time again. today after the decision came down, zagel stood his ground. when blagojevich's attorney aaron goldstein asked for a continuous delaying this trial so lawyers could comb through the 114 page supreme court decision, zagel had this to say. i don't think they declared 1346 unconstitutional and it would not change the nature of this testimony. john harris is testifying to the fact that you seem to be confusing facts with law. he went on to say the honest services law may not offer a lot of hope. i'm joined now by terry sullivan our legal analyst at the station. i wanted to ask you first and foremost, i wanted to ask you, what do you make of the decision today? what is it essentially and it is not tossed out. it's limited in scope honest services. >> well, i haven't even had a chance to read the whole thing,

as judge zagel points it has to be digested. 114 page decision. and we certainly know that in the skilling case and in the conrad black case at least that the justices were unanimous in saying that there had to be limits put on the honest services use. in other words, what they are trying to do is there are ways that people in business and government can make mistakes or is upizations and they think those were used that this section has to be used to criminalized mistakes instead of criminal conduct and that's the reason they are come to this con cliews today. >> it was too liberal of an interpretation over the years is what is said today. >> that is true. again, the just tseses were unanimous in that part of it. they said that conrad black case back here to the 7th circuit and then maybe to the district court to -- for a decision as to what should be done on that based upon their decision and also the skilling case is sent back.

>> what's interesting is justice ginsburg said it's in the cases of kickbacks and bribes that you can continue to use honest services. we will see this clause rear its head in this building again. >> without a doubt. now the question is how does this supreme court case affect other cases of the past like the streets and san cases. the governor ryan case. and many others like that. we don't know for sure how it will affect us. >> we were missing a big one. how does it affect defendant blagojevich today? >> that's what we were also unclear of. i wish i could tell you that it affects it a lot. but remember the government went back after they were afraid that something was going to be done by the supreme court. they went back and re-indicted the governor based upon other charges that did not allege honest services like fraud and bribery and things like that. >> it appears the case will continue. thank you so much for taking a look at it for us. i wanted to mention this morning after the u.s. supreme court filed its decision, here

in this courthouse, the lawyers for blagojevich filed a motion to continue rod blagojevich's case. what that means is they wanted to delay this case so they had a chance to review the document itself and see what it means from a strategic standpoint and basically what it means is what they are going to do -- the judge denied it. he denied that motion and beyond that, from that point forward he also went on to say that's the end of the story. the case continues. john harris went back on the stand. from that point the lawyers had since filed a second motion. they want the judge to take a second look at it for them it's all strategic. they don't want anything that has to do with honest services heard by the jury in the court today or from this point forward. at the dirksen federal building. julie unruh, wgn news. stormy weather last night left a trail of damage across chicago today with trees down, roads flooded and homes and businesses in the dark. wgn's erin mendez is live on the southwest side where falling trees did some big damage there. >> reporter: you are right. and the drone of saws and wood

chipper stretches from 55 to 52. if you question of the intensity of the storms, take a look at this tree this morning. lifted up an entire piece of concrete before snapping and then falling on top of this home here. since friday nearly 6,000 trees have fallen on chicago streets. >> lucky ones broke up to find them literally at their front door. 80-mile-per-hour winds flipping not only massive oak but the entire slab of concrete underneath. blocks away yellow tape marks precarious balance of power lions and tangled branches. comed losing to mother that iture. the phone hasn't range this much in year. >> it's been quite a storm here. we just keep going. we are going 24 hours. we have spotlights and whatever we need to keep moving. >> reporter: you can literally follow the trail of wood stumps and chopped wood to see the track of last night' storm. today marks 7th day the forest bureau has been working on

cleaning up the downed trees. a job expected to last for weeks. from the southwest side, erin mendez, wgn news. traffic is moving on the stevenson expressway again. after the storms forced authorities to shut part of it down. heavy rains left water several feet deep on the stevenson at pulaski. that's one of the few low spots on the expressway. crews ran generators all night to pump out water. from yesterday evening until early this morning, traffic on the stevenson was stopped and rerouted in both directions between central and lake shore drive. high winds and heavy rain did some damage in the suburbs. in oak brook, winds peeled parts of roofs off some buildings. the wind nearly yanked a traffic light out of the ground. if in other western suburbs there were flooded streets and downed power lines. damage from the storm also forced metra to close its station in south suburban

madison for repairs. former alderman ike carothers was sentenced to 28 montanez federal prison this morning. he was. to enrich himself. carothers cooperated with the feds and worked undercover to help nab other public officials. he admitted to using his political power to get personal home improvement. carothers said he was sorry and understood the damage he inflicted on his family and the city. carothers is the 29th alderman to go to prison in the last four decades including his own father. still ahead, there finally may be a deal to build a second wal-mart store on the south side. we were live with the latest. and later he is the host of the popular tv show no reservation. he has been seen on top shelf. he is here to talk about his latest book. and in medical watch, a whooping cough is at epidemic levels in one state. the advice that health experts

underway now in the perjury trial of former chicago police commander john burge. he is charged with lying about torturing suspects into giving confessions. wgn's muriel clair is live at dirksen federal building for us with more on-that. >> good afternoon. see no evil, hear no evil, speak no evil and it may have worked in the area 2 headquarters, but it won't work in this courtroom. now that's what assistant prosecutor david wright told jurors during his closing argument which lasted just a little over an hour. wiseman painted defendant john burge the former chicago police

lieutenant a liar who worked above the law. back in the 70s and 80s he lied about what happened then and he is lying now, wiseman told the court. burge is charged with perjury and obstruction of justice for allegedly lying in a civil suit when he said he never seen or participated in the abuse of suspects in his custody over the 13 days of this trial four -- and graphic detail told of being tortured. burge for more than two decades managed to wrap himself up in the code of silence, but wiseman said of burge he never envisionedded these four weeks where his conduct would be exposed in totality. now defense attorney was up next and right off the top he painted burge as a decorated police lieutenant and his accusers as lying gang bangers trying to get over. at the dirksen federal building, muriel clair, wgn news. well, a big victory for

supports of a new wal-mart store on chicago's south side. wgn's nancy loo is live at city hall with the latest. >> reporter: well, allison, there is a deal that spread fast through city hall which is why just a short time ago the zoning committee approved that proposed wal-mart and that is muse together ears of a lot of south side residents. >> we want jobs! we want jobs! we want jobs! >> reporter: and jobs are looking likely now with word that union leaders have reached agreement with wal-mart which will allow construction to begin on a second store in the city. the super store to be built in the pullman park neighborhood will provide hundreds of much needed jobs. under the agreement workers will earn at least $8.75 an hour and then get a raise of up to 60 cents after the first year. union leaders say it was worth

now because they have a lot of talent. remember one thing in a short series and that's going to be three games. anything can happen. the worst team in baseball can beat the best team in baseball over 162 games you can't hide anything. you will find out what each team has and what the deficiencies are. as far as the weekend series, flip a coin, we will tell you at the end how they did. >> you are right. the cubs can always pull it together when they play the white sox. >> north siders -- are you going to be talking to lou piniella over the weekend? >> i plan to. i always been a big supporter of lou piniella. when a lot of people were touting joe girardy i was touting lou pithalla because i thought that team was a team that could win. now it's worked out well for lou in that he won two division titles. hasn't worked out the last couple years but this year is far from over. like we got back in the race from nine and a half games back. there is nothing to say that the cubs can't get back in the race.

>> you couldn't get his attention? >> it has been organized chaos. i will tell you that. >> this has been some dangerous l. >> nutty yesterday. >> harkens back -- you are right and shawn. that thing yesterday harkin back to that august 4 derecho. that was the one that came through with 12,000 cloud-to- ground lightning strikes august 4, 2008, about two years ago. that was the first time the crowds at wrilgly field were sent to the lower level to escape the rain, lightning and wind and this thing yesterday was comparable in the scope of coverage. it reached into every corner of our viewing area. look at some of the rainfall totals that have occurred for the month. now that we had yesterday's rain, the latest outbreak of severe weather and that came in three different waves but you can see from here in the city to well, that's another city site, wilmette and naperville all in on awfully big rain totals and temperatures at this point very warm still downstate

but gone are the 90s in our area. these are the rains that have come down in the last couple of days at munster, hammond, elmhurst and lombard. a lot of power still out across the metro area and 78 degrees a far quieter beautiful day going in chicago. we rained out some of that moisture. 78 not only at o'hare but midway. 80 at this hour. kankakee. 80 at chicago heights. plot of the temperatures and the dew points right here which are down about ten degrees from those tropical levels yesterday. we had dew points of 75. dew points measure moisture in the air. that's two inches of water those storms had to sweep into their concentrated rain shafts. gorgeous day in hinsdale and then we show you the rains again. the storms have moved off to the east. see them right there? now the storm systems that are developing all the way from new york down into the ohio river area south of us mark the perimeter of this gorgeous air mass that will spend the next two days in. 250 severe weather reports

rimming this blast of hot air that has held sway in the southern mid west the last couple of days. we had 80-mile-per-hour wind gusts in those storms yesterday at hometown, pontiac, portage, indiana, 78-mile-per-hour gusts at sugar grove and yorkville. these were just the straight- line winds that came down and here is the corridor of heavy rain which totaled over three inches of some areas. storm watch is in effect to the east of us. there are heat advisories in these yellow areas but it's a far quieter day in the nation's heartland as we sit at 78 here and 81 at st. louis where it was 96 yesterday. what a change. 70 in rhinelander. gorgeous day. dew points are down in the 60s even the 50s. gives you an idea where night time lows will go in a cooler locations tonight and then triple-digit heat indices that have prompted warnings and advisories in recent days are out of here. temps are warming out to the west of us. that's a sign of things to come. we will get hot and humid this

weekend again and bring more storms not clusters. north wind at eight, no storms, 54% humidity. dew point 06. heat index at 57 and water at 71. high mold spore counts and moderate grass and weed pollen today and our report from gotlieb hospital and dr. joseph lea staff. here is where the storms have gone. the ones that raked the area yesterday. there are lined in a line right along the south plank of this gorgeous air mass we are in and show no sign of coming back until late tomorrow night. and saturday when we will grow hot and humid. reason they evacuated the areas is because of the little bubble of high pressure that sits over us. winds tonight are light if they blow it ought to be east, southeast as night goes on and then the south winds lock back in and up comes humidity and it will be muggy this weekend with temperatures flirting with 90 degrees. you will see in this two day rain plot as we sit right here in a nice open area we pushed all the big storms to the

on the medical watch today, restoring vision to people blinded after their eyes were damaged. italian researchers say they used stem cells from the blind patient to restore vision. treatment worked completely in 82 of 107 cases and partially in 14 others. stem cell transplants offer people whose eyes were damaged by chemical burns often caused by using heavy duty chemicals at home or at work. procedure is not for patients

with damage to the opt ck nerve or macular degeneration. california medical experts say whooping cough is reaching epidemic levels. five babies have died since january. and doctors are treating a record number of cases not seen in 50 years. ken reports. >> reporter: two month old nathan will thank his mother later. just receive the whooping cough vaccine. disease most deadly to infants. >> and then gradually it gets worse where the coughing comes in these spasms,. that can be really distressful to watch. >> the doctor with uc davis childrens hospital has treated children with whooping cough. >> the kids cough, cough, cough and they don't inhale. they are exhaling. ujust cough, cough. sometimes they turn blue because they don't get enough oxygen. >> whooping cough comes in cycles with some years worse than others. today the state department of

health issued a warning, 2010 is shaping up to the worst epidemic 50 years. >> in 2010, we now have seen about four times the number of cases that we saw last year at this time. >> in the first half of last year there were 219 cases of whooping cough in california compared to 910 cases this year. five infants have died and 600 cases are under investigation. while 9 opercent -- 90% of children are vaccinated they are still vulnerable until six moneys of age. the doctor calls the vaccination rates among adolescents and adults pathetic. >> even though we think of it as a childhood disease, it's being transmitted from adolescents and adults to the more vulnerable children who then suffer the consequences. >> that was ken pritchard reporting. a spokesman for the national senders disease control say at this point only california is reporting an epidemic of whooping cough cases. however, tracking cases can be

>> al-- >> and allison. >> great to be with you. >> i'm lee and i'm steve. >> together we were the clever cleaver brothers. >> with allison. >> tom skilling did a great job of getting rid of the rain. >> thank god for that. >> we have a great barbecue recipe you make at home and something steve and i call summer time steak salad. >> the first thing is the dressing. it will go over salad. >> take your time. >> we will go with a quarter cup of olive oil. reverse salad dressing where there is more oil than vinegar. >> all right. >> vinegar than -- more vinegar than oil. >> that's what he meant. >> soy sauce. we don't put a lot of soy sauce -- soy can be salty so you want to be careful with that. >> how about a taste of freshly grated ginger out of the jar. >> listen at home if you want to use the fresh ginger take the bark off and put it through a cheese grater and get nice fresh ginger. we want to be easy and simple. >> place that right in there.

>> right, right. >> come on over here. time to barbecue. >> we will go with some beautiful skirt thing. i want to show you something. we aren't cooking with charcoal or gas. we were cooking with these new things we found called the flame disk. >> i love that. >> cool. >> it's really cool. it fits any size grill any style grill. >> that is cool. >> what's neat is you have great time convenience and light it and it's quick to light. >> how long does it last? >> great question. >> 45 minute. >> that's long enough. >> cook anything you normally do on a charcoal grill. another convenience because there is no charcoal to get rid of. >> why weather do you find those? >> i know they have them available here in town at jewel. >> okay. >> and actually at target. >> cool. >> it is called barbecuing simplified. >> when everything is done you see we have onions and peppers and beautiful fresh veggies and hit them with barbecue sauce right before they are done. put that barbecue on too early

>> he was both head coach from 66 pfer to '68 later became a chicago bulls broadcaster. >> he is the man. >> absolutely. and you are the man. >> on a day like this, yeah. >> congratulations, tom, you are the man. >> look at this. gorgeous day. we have sunburn times that actually are measurable because of sun. it isn't raining. 17 at 1:00. 43 at 4:00. here is the high pressure that is doing it for us. pushed rain out of the area. low pressure out in the plains comes back in and we start the cycle again. humidity coming back but that's a day and a half away. few thunderstorms can come in with the humidity as early as tomorrow night. here you can see this is a two day rain forecast we were in great shape so gorgeous weather and light lake breezes the next few days. started showing you this before. see how we stay on the edge of the jet stream. you are asking why this storm pattern is persistent. here is why. this jet stream pattern took up residence two or three weeks ago and stays there.

we call it a ring of fire pattern. so there is a slight risk of severe weather north and west of us tomorrow and that expands into this area again on saturday and saturday night. these won't be all day rains. the next ten days, look how the orange and reds and warm air expands into this area. we can be flirting with. 0 and then a buckle in the jet stream brings nice pleasant air down. monday and tuesday right there. gorgeous weather, and then the heat resurges again later next week. hydrate before the taste of chicago. >> that's a good idea. hydrate before the taste or anything else you are doing outside because look at temperatures on saturday and sunday. monday, tuesday gorgeous weather back again. 84 and 79 respectively and cooler each day by the lake. winds are blowing off the lake. so gorgeous weather. nice day today, too. all right. >> gorgeous day today. >> is it. enjoy it. >> take advantage of it. >> okay. >> thank you. >> and thank you for joining us.
