latest. reporter: forilly and his family, the last few days have been heart-breaking. >> it hurts, you know, when somebody goes and kills your dog like that for no reason and knew it was my dog. >> reporter: the keene new hampshire man says on saturday he let his dos out for a few minutes including his precious chihuahua pomeranian teddy. the dog wound up wandering away and peeing on the neighbor's lawn. he says it didn't make the neighbor very happy and all hell broke loose. >> the neighbor tell me he just kicked the dog like a football and he's laying there with his tongue hanging out. and i walked out and started calling the cops. he did say where it is, sorry, nothing. just stone cold. >> reporter: police ended up charging toby to usually a man running for city council, for animal cruelty for the dog's death. >> i was peacefully working on property when, you know, this dog got out of the house and

the dogs are rather nasty and intimidating. >> did you kill the dog? >> you know, i can't comment now. >> reporter: police have charged with you animal cruelty and the homeowner says you kicked his dog to death. >> that's correct. you know, i've been getting death threats from people as far away as new mexico. that's why i'm here at the police station right now. >> reporter: but for laplante, he just wants justice. >> i want something to happen to him. i don't think it should be a misdemeanor. and towsly in due in court on those charges december 10th. kelli o'hara, 7news. a man in a courtroom today charged with attacking another man with a knife. 46-year-old michael fitzpatrick appeared in a hospital gown, accused of stabbing the victim during an argument last night outside of a home on broadway street. fitzpatrick and the victim were both taken to the hospital with injuries but are expected to be okay. a man in fitchburg is arrested for allegedly exposing himself to people earlier this week. michael boyd, who you see right there, is charged with disorderly conduct and open and gross lewdness.

he was arraigned yesterday morning and is die back in court in december. maine. a family says their toddler died after visiting a p.e.king zoo at a local fair. -- petting zoo. >> 20-month-old colten was his parents' pride and joy. he died monday. his father john guay says he was exposed to e. coli at the petting zoo while visiting the fox oxford county fair. >> over here we've got pigeons. >> reporter: mark anderson is a vet at a different local fair and says he wants to prevent future parents from the same tragedy. >> they've got to wash their hands when they come out of that petting zoo, you know, they may pick up fecal material in there, and so many of these decembers are fecal oral and spread. and we want the kids and their parents to be aware of that, and that's why we have these hand wash stations and all the signs. >> reporter: the reality is like 2 1/2-year-old cayden love hugging the animals. >> there's one coming over here. he's been here since he's been

born. >> he looks like he really enjoys it. >> yeah, he really like the animals. >> reporter: but most parents aren't aware of the associated risks. >> you wouldn't think you're gonna catch a disease and you could lose your child coming to the fair. >> reporter: the state cdc confirm as second little boy, who was also at the oxford fair, is in hospital with symptoms of e. coli. his condition sun known. experts say although what happened to colten is rare, parents can't be too careful. >> what happened to these two toddlers is so rare. obviously if this was an every day occurrence or close to that, we wouldn't have petting zoos. butt an extremely rare enter and i think it gives us all pause. >> so far the oxford county fair has not released a comment on the incident but officials are warning parents to make sure their children keep their hands away from their mouths. in the newsroom, 7news. also on zen, controversial comments from a presidential candidate.

>> the remarks were made about the campus massacre in oregon. kim casey joins us now with those details. >> you'll recall that the shooter asked students one by one to state their religion. ben carson says he would not have cooperated, that he would have fought back. >> i would not just stand there and let him shoot me. i would have said, hey, guys, everybody attack him. he may shoot me but can't get us all. >> carson's comments are spark a lot of backlash but republican candidate donald trump says he supports carson easy comments. >> i thought it was -- [ inaudible ] trump also sent out a tweet saying ben carson was speaking in general terms as to what he would do if confronted with a victims, not fair. this come on the same day an oregon district attorney came out on the attack praising the acts of officers who saved lives that day.

the selfless acts of these officers that they made in responding to the scene they had little regard for their own personal safety and they saved many, many lives that day with their heroic acts. >> president barak obama will reportedly be heading to oregon he will be meeting with the families of the victims. in the newsroom, i'm kim khazei, 7news. covering more news today, an 11-year-old facing a first-degree murder charge. the boy allegedly shot and killed his 8-year-old neighbor with his dad's shotgun sunday morning. the victim's mother says the shooting happened after that boy asked to see her daughter's puppy, and she said no. the 11-year-old suspect has been at a juvenile detention center in tennessee since the incident. >> we treat them all like they're in here for murder and we don't have any -- have a lot less problems when do you it that way. >> we're in business to help a kid get straightened out before they're 18. but on this case it's a little bit different.

>> the 11-year-old's bond is set at $500,000. at least two people are shot in a craigslist crime. authorities say a father and son in michigan went to a home to buy a vehicle they found on craigslist. when they got there, the house was abandoned. three men allegedly jumped them. one of the buyers then pulled out a gun and started shooting. police say that man had a license for the gun, two of the alleged attackers are in the hospital and police are still a new jersey priest allegedly accused of crossing the line accused of taking his sports a little too seriously. police say he pointed a gun at an 8-year-old boy for wearing a cowboys jersey. the priest says he'll recover but worried about the boy who has to deal with all this chaos. >> i believe i will be vindicated of these charges and that my reputatio will not be harmed by the people who know me.

>> musket was never loaded but the county prosecutor says whether you're joking or not, you cannot point a gun at someone. jersey. dozens of people now getting tested for hiv and hepatitis after their flu shot may have put them at risk. investigators say a nurse used the same syringe over and over again and now the clinic is trying to track down any patient that could have been affected. >> people who monitor infectious disease in mercer county new jersey say it's something they've never seen here before. a breach on how to give a flu shot safely. >> both the needle and syringe wherever you receive the vaccination should be used once and only once. >> reporter: at a clinic hosted for 67 employees at a local office, that practice was not followed. new jersey health department investigators are looking into why a nurse changed the needles after each vaccine but continued to use the same syringe. dozens of effected people came to this health center to get their blood tested for hepatitis and hiv. >> we feel it's important that

they are aware of their health status and that they understand what the risk is and what the potential is. >> several employees were very upset with what happened. one of them told us having to now wait for test results is giving her incredible anxiety. another man wanted to know why they weren't notified of the breach until late friday when the clinic happened wednesday. >> shortcut. everybody in a hurry. everybody so much in a hurry. >> reporter: effected patients said their employer would not let them give interviews to us but others in town could not believe this happened. >> you never know what anyone is carrying. >> reporter: the company, total wellness that contracted the nurse for the event, sent a statement to nbc which reads in part, total wellness is dedicated to ensuring all participates receive any and all appropriate screenings, care and counseling until this matter is resolved. >> officials say that the risk for infection is low, but they are recommending employees be tested for some diseases. no word on if any action is being taken against that nurse.

caught on camera, police are releasing new video of the jewelry heist from a wild police chase in england. six men used pick axes and sledge hammers to smash their way into a jewelry store stealing 45,000 dollars wto of watches, they rode away on scooters later ditching those for a van. police tracked the six thieves down and arrested them all. a man trying to escape from police in australia drives his car right into the ocean. police had been following him for almost two hours through sand dunes until he drove straight into the water. officers then pulled him from the surf and arrested him. police arrested a suspect in connection with a smash and grab burglary at a gun shop last month. the burglary happened in september, and you can see in this surveillance video the car actually smashes flight that gun shop. that's how they got inside. it happened around 2:00 in the morning and at least 25 guns were stolen. police are still investigating. a police chase straight out the wild west. police say two men left on

horseback after a fight at a rodeo in mesquite, texas. when they tracked the men and horses down, one surrendered but the other decided to take off on his horse. officers eventually did track them down and tased the man for resisting arrest. one woman was rescued from a helicopter who was stuck on a hike. you can see the rescuers harnessed her in so she could get out safely. the woman had dislocated her hip after falling on some rocks while hiking. still ahead, a dining hall dilemma, a college student very upset when he isn't served his meal of choice. and then at 6:00, we're following breaking news, an invasion of privacy at winthrop high school. at least 10 students now under investigation. and the coast guard close tend toking the search for a missing crew on a cargo ship there. but victims' families still

a dining hall dilemma an all caught on camera. a student at university of connecticut is facing criminal can charges after an alleged food fight on campus. now, police say the student initiated a shoving match with a dining hall manager. >> witnesses say it all started over mac and cheese. nancy chen has the story. >> reporter: it was an altercation over bacon jalapeno macaroni and cheese. uconn student luke demanded it from workers in the student union sunday night. >> two spots behind the line in the mac and cheese line and so the kid had a beer and then they confiscated it away from them and then that's when it started. >> reporter: the video shows the

colorado and rain coming into portland, oregon and also up into washington. a different hurricane, i don't usually go out to the pacific. this is hawaii, this is the central pacific region, okay. so get that right. oho is a hurricane with winds of about 105 miles per hour. but it's interesting to note where oho goes as -- is it like oh no for oho, up into the british columbia? we'll see. right now it looks like it will weaken to a depression. but this is an odd path, crosses from the central pacific to the eastern pacific. it will keep its name but it's a very, very odd thing for any tropical system. tomorrow about 60 degrees. 64 though metro west. and this rainshower activity coming to us on friday most it late morning and early afternoon. and then it passes off. we might see a few renegade showers into the evening. that's our wettest day of the next few really. looks like the weekend will stand tall with a lot of sunshine, cool weather on saturday, then on sunday, about 70 degrees.
