it is a little hard to watch, we should be honest with you. spring valley high school, columbia, south carolina. a school resource office, a sheriff's deputy locally there. it's under investigation after aggressively confronting a female student for allegedly disrupting class. students captured the disturbing incident on their cell phones. >> are you going to come with me, or do i have to make you? >> so you can see the officer flipping her backward in her chair there. it's unclear what led to that incident, but do you hear the officer ben fields ask the student to come with him after she refused multiple times. >> gosh. >> oh, that hurt. head. >> yes. >> like on her neck. >> the teacher in the classroom asked the officer to come in

the aclu and rich land black 2 calling it egregious and unacceptable and the sheriff says they fully understand the incident and they will address it once the investigation is completed. the school superintendent put out at statement writing student safety and always will be the district's top priority. the district will not tolerate any actions that jeopardize the safety of our students. pending the outcome of the investigation, the district has direct the that the school resource officer not return to any school in the district. the student was detained after the incident and later released to her parents. the charge was disturbing the classroom i think is how they define it had. again, we don't know the context before the video, but it's hard to imagine a context where that was appropriate. >> if there's a context that makes that an understandable incident, it is important and imperative that the sheriff's department give that context because unless that student was armed and there was immediate danger to al's point, to matt lauer's point this morning as well the other kids in that room

were terrified, and this is where this gets complicated when we have to say as journalists, where the context, blah, blah, blah, blah, blah. that's why you have investigators and they need to quickly answer some of these pressing questions. >> yeah. >> that's why i said it's hard to imagine a concept where that's appropriate. >> what's amazing, if you listen to the tape you don't hear anything. these kids are just terrified obviously and just riveted to their seats. >> and all they are doing is using their cell phones to record it and maybe that's their voice. important to note this officer ben fields had been brought up in a lawsuit in 2007 for excessive force. >> which they beat. >> which they beat and in 2013 there was another student who brought similar charges, also alleging that -- that the officer had been targeting african-american students, and that case is still pending, so, yes, there perhaps was some kind of history though the officers have said that, you know, they

>> there's another spoon around here somewhere, i'm sure. let's take a look at the weather going on across the country where we're still talking about the rain, kind of still the remnants of what was hurricane patricia. the heaviest of the rain though just off the coast of florida, especially right over the eastern gulf of mexico but the rain that we're going to see today caused maybe some troubles. we'll be back through the midwest where we could end up with a couple of inches of rain through the day today. tomorrow a washout in the northeast stretching up into boston but it does exit fairly quickly so by the time we get into thursday morning the rain should start to pull away. as much as 2 to 3 inches of rain through southern indiana and western north carolina could end up with a couple inches of rain. as for the northeast, new york city, about an inch and a half and parts of new england could see about 2 to 3 inches through >> good morning. cold with a mix of includes and sunshine today, and it will be cool this after, 53 to 57, light and variable wind. and then tomorrow, our attention focuses on this weather system

taking a look at the headlines whole foods is recalling two samp many after it tested fori listeria including wisteria chicken sal aid and a deli pasta salad sold in stores in the northeast. no confirmed illnesses reported. anyone who was purchased the salads is encouraged to throw them away or return them to the store for a refund. walmart wants to jump into the drone game hoping to compete with amazon and other retailers. walmart is asking the u.s. government for permission to begin testing drones for at-home delivery. officials say they have already begun testing indoor tests and wants to test drones outdoors

the country to let kids be kids for one special day. halloween is just a fantasy for edgar ryan. he's been here at the children's hospital in philadelphia since august. so long all he dreams about is sleeping in his own bed again. >> because you miss home. you missing with your family. it's hard. >> edgar's brothers came to visit him on his 13th birthday as he recovered from a traumatic brain injury and received treatment to his lungs and stomach after an incident at beach this summer. his mom still can't bring herself to talk about it. she only has thanks for the team that saved his life. >> i cannot say enough thanks, you know. i'm without words. >> feel better, okay. >> the hospital is filled with families searching for a reason to smile. so many the hospital's child life staff decided halloween was the perfect time to do something.
