confroation. >> the story developing tonight. justice department launching a formal investigation into the incident. >> the deputy involved is on leave right now and we've learned police arrested a second student who objected to the girl's treatment. ryan schulteis is here with more on the latest. >> ryan: one student said it started when the girl refused her math teacher's question to hand over her cell phone. a classmate video shows the confrontation unfold inside a columbia, south carolina, high school. a student who witnesses say was asked several time to leave the classroom refused. then was taken down by a school resource officer. and as this video from another student's camera floor. >> way too far. i don't think a woman should be handled like that. >> reporter: while others job. >> the force was a little excessive but if the student supposed to do -- >> reporter: the young

were arrested for disturbing school. the school district and sheriff's department are investigating and the justice department opened a separate civil rights inquiry. the resource officer had been with the sheriff's department wince 2004. he was sued in 2007 along with several other officers for excessive force but was exonerated. that case is still penting as a new round of investigations begins. again officer fields has been placed on leave while continues. ryan schulteis, 7 news. >> we're following breaking news closer to home. a massachusetts man arrested you have in exeter, new hampshire, accused of choking a 5-year-old girl. solomon martinez is charged with two counts of second-degree assault. he allegedly choked a little girl placing hi hands around her neck.

years in prison if convicted. >> also on 7 two men accused of using scare tactics to pull off a robbery in dorchester. police say they were' wearing masks and carrying that fake gun. let's go to dan hausle. he was there when he firsted a gun today and dan is live in dorchester. >> reporter: police say these men had more than trick-or-treating on their minds. yes, the gun may have been fake but the robbery was very real. unmasked. boston police surround a man and hold up a white mask just like the one two suspects used to cover their faces while allegedly robbing a man on the street near the savin hill t. stop. police say kostya ragin and andronique dossantos of dorchester were stopped nearby. investigators say they were' hiding these white masks in their clothing. ragin had this very real looking replica gun. >> the victim stated both suspects wearing a mask and didn't see their faces.

>> reporter: suspects stayed out of sight in court. one of the men pointed a gun at him and said give me your money and your cell phone i. then the pair grabbed a bag from the man and took off. police later spotted the suspects and found the masks and fake gun on them. the suspect's defense lawyer said they questioned the identification and arrest. >> talk to you about costia. >> no, get off my property. >> any idea why he was -- >> that is the welcome he got at ragin's home in need hem. >> a woman was floored when i told her he had been charged with robbing a man wearing a halloween mask. >> you know, she would be with my son but this, i'm shocked. >> reporter: the judge ordered men held on $2500 and $3500. miss say all they got away

the memory of boston's longest serving mayor alive. the family has chosen b.u. to house the official thomas m. menino archives. that will display the accomplishments the mayor made in a his 30 years of public service. kimberly bookman is in the control room with a look. >> reporter: mayor menino's legacy is long but when people remember him they talk about his efforts to revitalize boston neighborhoods. he worked with b.u. to help others learn how to plan and govern great urban cities. now his archives will be available to anyone interested in learning about his work. he always did things his way. that is why it seemed appropriate at mayor's funeral that the service concluded with the frank sinatra song and the family of boston's longest serving mayor is allowing people to get a look at his public and private work done only as he could. >> tommy was the teacher and a mentor and the i think

>> stepped up security for paul ryan. he is being followed by security wherever he goes even walking through capitol hill. he is the favorite to become next house speaker. lawmakers will be voting day after tomorrow. dimples we're following breaking news. >> hear about the deputy involved in the classroom video. >> school resource officer was seen dragging a student out of the classroom. we've limped to the press conference here and we understand there is a third video that has not been released and that shows that student according to the sheriff's department hitting the school resource officer right before the confrontation. we saw two other angles from different videos. there is no word exactly when that is going to be released but this angle shows the officer dragging the student out of the classroom. the math teacher asked her to leave the classroom. she won't. they had to call the school resource officer.

records interviewing passengers, crew and rescuers as they search for answers off the coast of canada. five lives were lost when a tour'sboat sank. >> 21 people on board were rescued. today we're hearing from one of the first people who reached the survivors. >> when we got into calm waters, there were looking at the seals. looking at the seals and seen a big wave. >> he was one of the first rescuers who arrived after a whale watching boat capsized sunday. the captain was overcome with emotion as he described how survivors told him the boat was picked up by a large wave and tossed upside down into the water. >> it brought them up like it and they fell over. they tumbled. >> reporter: when frank pulled up he says passengers were in a state of shock.
