and murder of his math teacher colleen ritzer. eduardo says his grandson was a quiet kid with a beautiful soul. the grandfather details a family history of mental illness affecting philip's grandmother and aunt long before philip was born. he says the illness came on suddenly. >> first she had a nervous breakdown. >> reporter: then a family friend got emotional on the stand. >> how long did she stay with you at that time? >> about three weeks. >> reporter: the chisms lived with her on and off in tennessee as philip's mother and father split. she said the father was not abusive but was unfaithful. through it all, philip was well-behaved, though craving a more normal living situation. >> the needs of the children came first. then everything else. she did struggle. >> reporter: witnesses said he saw that normal living situation with his best friend tanner, who considered chism a brother. he spent days with tanner's family. chism described as

treated his mother. in the weeks before the family left tennessee. >> for a while, it was really hateful. how philip treated his mother. >> there was a time where his mother addressed it with him. >> reporter: also taking the stand, several danvers high school students who remember philip chism as a new kid who was doing a good job of fitting in and making friends. then they say suddenly, in the days before colleen ritzer's death, he became very quiet. he even stopped smiling when he would score a goal in soccer. tomorrow the jury will go on a view of the murder site at danvers high school. the school is dismissing students early to accommodate the trial. live in salem, 7 news. >> christa: now the case of the boston marathon bomber. attorneys for joek tsarnaev are back in court argue for a new trial.

penalty phase. >> reporter: christa, the judge didn't rule on any motions before him in court today. the hearing just wrapped up. he will rule at a later date. however, tsarnaev's attorneys are arguing that a change in the law should change their client's sentence. dzhokhar tsarnaev's lawyers back in court. they want the marathon bomber's death sentence thrown out. prosecutors argued that kind of reasoning couldn't possibly be what was intended. tsarnaev was not in court. he is imprisoned at the super max penitentiary in colorado.

to continue to protect tsarnaev's attorney-client privileges. they say prosecutors have tried to get logs detailing who has visited the convicted killer behind bars. the prosecution has been trying to seek information about a visit between tsarnaev and his sister. the defensest says tsarnaev's lawyers say that that visit be protected. the prosecution is also asking for $0 million in restitution for his victims and to cover the cost of the trial. they acknowledge that he it. but they say any money he may come into should be forfeited. >> jadiann: thank you, jen. a marine from new bedford has been found guilty in the in a death overseas. joseph pemberton was convicted of homicide in the philippines. pemberton will serve up to 12 years in prison for killing jennifer laude, a transgender woman in a hotel last year. police say they went to that

her to death. pemberton admitted to choking her. but then he tried to revive her. the death sparked protest and called for u.s. troops to leave the country. >> christa: new details now in the weapons stolen fromp a an armory in worcester last month. a dorchester woman is behind bars in connection with the crime as well. ashley bigsby had pictures on her phones of a stolen handgun an assault rifle and initially told them she knew nothing about the robbery. the f.b.i. is offering a reward for the six guns that are still missing. >> jadiann: 7 news now turning to the weather. we have some cloudy skies above boston. as we take a live look outside over the zakim there. a chill in the air. we are bracing for some wet weather as well. meteorologist jeremy reiner standing by with the forecast. >> jeremy: the radar showing a scattering of showers. some neighborhoods, it is just dry with clouds. others cities and towns have seen the rain-drops. one batch up through the new hampshire seacoast and through the merrimack.

e-mail threat about a bomb. report tt e-mail named five middle schools in cambridge or upper schools as they are called in the city. the scare sent school officials into motion. alerting the safety and security team who worked with cambridge fire and police departments to search the schools for any explosives before students arrive. no bomb was found. >> of course, we have to take it seriously. that is what life in 2015 is like, unfortunately. >> reporter: parents received e-mail alerts and phone calls about the scare. this comes a few weeks after a similar bomb scare in cambridge last month. >> you don't want to take any chances. >> reporter: many parents choosing to chemotheir children at home until they knew it was safe. >> it is probably a hoax. we decided it is not worth the risk. we waited until we were told it was cleared. >> reporter: cambridge police and school officials decided to place an officer in each of the five schools listed in the e-mails. as well as increased patrols. parents are still concerned.

i don't know. what do you do? >> reporter: the extra security will be in place throughout the rest of day. that is the latest here in cambridge. kris anderson, 7 news. >> jadiann: it is one of new england's most notorious murder cases. eddie o'brien was sentenced to life in prison without parole for killing his friend's mother. he hasn't spoken publicly for nearly two decades until now. cheryl fiandaca has the interview you will only see here. >> reporter: did you kill janet downing? >> absolutely not. >> reporter: eddie o'brien was 15 years old when he was charged with killing his best friend's mother. >> is the defendant guilty or not guilty? >> guilty. >> reporter: convicted, o'brien has always maintained his innocence. but hasn't spoken publicly in nearly 20 years. until now.

didn't kill janet? >> very adamant. if you really look at the evidence, you will see the truth. >> reporter: what is the truth? >> the truth is that i didn't do anything. >> reporter: that is all his lawyers will let him say about the case. refusing to let him discuss the evidence or talk about the woman he was convicted of killing. janet downing was murdered in the summer of 1995. inside her home. the mom stabbed more than 90 times. her teenage son who was o'brien's friend found her body. o'brien, a former altar boy and the grandson of the city's long-time police chief, lived across the street from the downings. he became a suspect after police doubted his story that he had been mugged the same night as the murder. in court, prosecutors said o'brien had cuts on his hands and d.n.a. evidence linked him at the crime scene. i asked him why he never took the stand to defend himself.

and off gun! >> reporter: couple calling out a man who confronted them. >> it escalated really quickly. it wasn't something we were prepared for. >> reporter: the couple ran quincy restaurant. they say he became angry when he thought they were making fun of him after making comments about him smoking in his car. when the coupling drove away, they say freeman followed. >> he was tail-gating us. swerving around. honking. drove up next to us. rolled down his window. >> reporter: then he became confrontational. getting out of his car. even trying to fight. at one point, going back to his car to get the pellet gun. thanks to a person living nearby, the situation quickly stopped. >> the reason he stopped was because the neighbor was right there. and he instantly got on his phone.

>> christa: protesters taking aim at a historic hunt in the blue hills reservation. the deer hunt continues today. the state says it is necessary to control an out-of-control deer population. opponents think this is an extreme measure. a two-day deer hunt at blue hills reservation has animal rights activists fired up. they stood in protest outside the entrance with signs that said "stop the slaughter. this is murder. animal graveyard." >> no hunting in our park. report tt department of conservation and recreation granted hunting permits for years. >> it is horrendous. the whole thing is horrendous. >> they found there was an average of 85 deer per square mile. put that into perspective. a healthy herd hovers around 6-14 deer per square mile. you can tell right away that we need this here. >> reporter: the hunt will take place in the 7,000-acre

not all bad. officers replaced the xbox stolen sunday during a burglary at his family's home. >> when we asked the child if he was going to get a new xbox for christmas, he said, no, my mom doesn't have that kind of money. all the money she makes goes to pay the bills. >> reporter: officers talked about the gesture which went viral sunday thanks to this facebook video. >> this house was burglarized not too long ago. >> reporter: he was more concerned about his mother than the stolen xbox which impressed them the most. >> just to be able to alleviate some of the stress to. help their family in this time, by christmas. it was really overwhelming feeling. it is about helping out the community as well. >> reporr: something one

the officers bought him three games along with the xbox and the store then donated that extra controller. you have to have that one. >> christa: absolutely. a great story there. grammy award winner pink raising awareness and adding a new title to her name. she is now a unicef ambassador. she will help spread the word about the programs to end world hunger. pink visited haiti to get a look at what unicef is doing there. >> you can watch stuff on the news but to be able to see the kids and spend time with these beautiful little ones and see what's going on firsthand... it's inspiring and motivational and it just makes it more real. you know? >> christa: a number of celebrities have served in this role including audrey
