a local man is suing fontbonne academy. >> when the school found out he was gay his offer was rescinded. dan hausle live outside the court house. reporter: this is a case that pits the right of a school to practice and promote its religion against a man's right against sexual orientation discrimination. matthew barrett and his husband head to court to claim a milton catholic school shouldn't be able to pull a job offer simply was barrett is married to another man. >> i can remember sitting at the table, just sitting there, like what just happened to me. i couldn't believe it. >> i was brought up catholic. half the neighborhood went there and we all talked to -- everybody talked to us and said it will be fine. it's a great school and then this happened. reporter: barrett's lawyer says the school violated

the job offer. he answers the school is covered by exceptions not to hire people who might interfere with the school's religious message. >> it doesn't matter if it's food director or religious director. it's not necessarily mr. barrett's message we're talking about. it's the message of the school that's being interfered. reporter: barrett says he wants the school to change its policy for future hiring. >> what i want to do is see that this doesn't happen to the next guy, to the next man. that's what i want. reporter: the judge offered no timetable for a decision. he can decide for bun side or the other or decide this is a matter for a jury to decide. dan hausle, 7 news. a legal loop hole has the potential to lead for a new trial for boston marathon bomber. they are arguing the supreme court ruling on

eliminate after the death penalty convictions their prosecutors got under the old definition. they are now asking for a new trial. meanwhile prosecutors did ask the court to force tsarnaev to pay restitution to the victims in the marathon bombings. the judge said the department of prisons normally collects the money starting at $25 every three months. prosecutors want the right to attach money that might come to tsarnaev in the future. a dangerous drive, an mbta bus and tractor trailer collide in boston. the bus driver was taken to the hospital with minor injuries. no passengers were on a cambridge middle school receiving a threatening message saying someone planted a bomb. officers patrolling a cambridge middle school after police received an anonymous e-mail about a bomb.

police officers heard that baby crying in a hole underneath a pile of debris. now police are asking for the public to help identify that baby's mom. >> i know what i was hearing. as i was digging in the it. reporter: it helped that he's the father of two young daughters and knows the difference between a cry of hunger and pain. >> the cry that i heard as a father was more of a cry for help, i'm hungry but not like i'm injured. reporter: stlch's officials say the baby is doing well. their 911 call answered by deputies, colette and david perry, colette pulling her out of a two foot wide hole filled with debris. >> the hole was filled with dirt, vegetation and asphalt. >> they still don't know who the baby's mother is, where she gave birth and why she didn't take

police officers in memphis fighting crimes with an unique game plan this holiday season. the officers responded to a burglary where the little boy's x-box was stolen. >> something needed to be done to cheer up that little boy and now their actions are going viral. reporter: you see on the news what police often encounter while on the job. 11-year-old campbell is proof that have it's not all bad. officers replaced the x-box stolen sunday during a burglary at his family's home. >> when we asked the child if he's going to get a new x-box for

direct copy of it. >> perfect imprint of that. nothing like that around here, pete. >> nothing like that. we had a few pockets of drizzle. 44 in boston. dew point reading about 36. a southeast breeze about six miles an hour. highs today, we just made it above freezing in nashua. thank goodness that precip was not steady. it was only spotty. otherwise i think we would have had some freezing issues and glazing on our roads. highs made it into the 40s up near nashua. still below normal, 48 in nantucket. 44 in boston. the current readings have not moved. we do expect them to be nudged a little bit higher into the mid 30s at least north and west of 595. this is one of those situations where that cold once its entrench add cross southern new england, it's really tough to erode. across southeast mass, just a change of the

temperatures may rise into the 50s tonight. right now it's all rain across the south shore and down in the islands too. moderate rain up to a quarter of an inch in nantucket with a couple waves of moderate rain going down through there and the vineyard. this is reaching out at least to mashpee and falmouth. steady rains through brockton and avon. it's still spotty north of boston and in the city too it hits and moves. i think it will get a little steadier through the course of this evening. that fog lifts up tonight and grows and after midnight it may be shut off. look at this at 3:00 in the morning. by morning at 8:00 or 9:00 it's still in a little bit of a lull and we start to break up some of the rain, but another wave coming into low pressure means we'll renew the rain for the evening and it could come down moderately as a new low pressure system starts to arise.

the map. it looks like it will intensify across northern new england. tap some cold and bring snow down to the mountains so it is more significant. for us on thursday it means falling temperatures and a lot of wind too. all told i'm still optimistic of about as close to an inch of rain. some places only get about a half an inch, an inch will be the top most limit on this weather system as we continue this relatively dry pattern. 49 for a high in boston, upper 40s for the north shore but bedford about 44ish and nashua 43 tomorrow and then on thursday a weird thing happens, our warmest the morning. then in the afternoon we see these drop back from the mid 50s and upper 50s across southeast mass and we struggle through the 40s in the afternoon and then drop once the sun sets into the 30s. again accompanied by quite a bit of wind. thursday's going to feel cold. occasional rain tonight,
