fix a problem. and that's when the train started moving, swiping the driver. there he is, 52-year-old david vasquez of canton. he was cut on the leg but not seriously hurt. the t eventually pulled the plug on the third rail, but only after the train drove right through several stations. it finally stopped between north quinncy and jfk. passengers say everything stopped and went dark. one woman says passengers in the first car knocked on the operator's door and realized no one was there. >> some people were trying to break the windows. most of the people were trying just to open the doors. and some other people were trying to call and see what's going on. i know people called the mbta to say what happened. but we really didn't hear anything. >> reporter: an estimated 50 passengers on that train. everybody is ok. again, the train's driver was treated for his injury but he's out of the hospital now. and the investigation continues. live in the news room i'm kim

>> also on 7 new developments in the philip chisholm trial. >> he's accused of raping and murdering his math teacher. >> reporter: well, basically all of this unfolding late this afternoon in the courtroom after weeks of the judge telling this jury that this would pretty much begin their deliberations by tomorrow afternoon. everything very much up in the air tonight with another delay by the defense. >> this issue got raised at a point, really, well into the trial. >> reporter: it was a last minute motion that threw the judge for a loop. lawyers for philip chisholm asking to call an additional witness to the stand to discuss brain scans trying to bol ster they are argument the teen was

>> this would be evidence that philip chisholm had legitimate severe mental health systems >>. the could not ken sus says you don't use these scans for diagnosis. >> reporter: it turns out the judge, who listened to the doctor in the trial, was not impressed with his opinions on brain scans >> the problem with the doctor is i don't believe him. i just don't believe him. >> reporter: by late in the afternoon it was motion denied which is just about when the judge learned chisholm's lead attorney had suddenly sum down with a stom ik bug and would be unavailable for closing arguments friday. a twist in the trial that insensed the prosecutor. >> there's a human cost to every delay in this case. that is all i will say. for once, i'm listening to the voice inside my head that tells me not to say everything i'm thinking. >> reporter: as of now everything in the trial is on hold until monday morning at 9:00.

she actually felt it. today. an officer charged in the death today. you can see office yer william porter walking into the protesters. he testified that he did not know gray was hurt until the end of his police ride. porter said he tried to help gray once he saw how seriously he was injured. porter is the first of six baltimore police officer dz charge -- officers charged in the death of gray in april. gray's deaths sparked riots. >> hundreds of protesters in san francisco carrying signs and chanting at city hall last night. they're calling for the city's police chief to resign and arm ofersers with tasers after police shot and killed a man last week. the family of mario woods says he should not have been shot. >> my friends and i should be for. n this commission and this

debate, but a time to decide. >> the family is asking for federal authorities to investigate that case. >> an associate of former subway samaritan jarod fogel sentenced today for producing child porn. a judge sentenced russell taylor, the former director of a charity started by fogel to 27 years in prison. he sent photos and videos to fogel who was sentenced for trading in child porn and having sex with underaged prostitutes. >> major changes are in store for yahoo. they are splitting into two companies. they've had trouble keeping up with competitors such as google and facebook. analysts say the ceo is not the only problem. >> yahoo's problems are much bigger than a handful of entrepreneurs could help solve. she wants to save core yahoo. her legacy will be tied to

the winter and go over the potholes. >> no salt or sand out there. no potholes yet so we're all good driving around. even throwing the top down here the last couple of days featuring milder temperatures. cooler side. recoverying to 58 this afternoon in boston. back down to 58 in the city. near 51 in norwood. cooler on route 2 and portions of southern new hampshire. you get north ever nashville where temperatures are in the upper 30s and lower 40s. and winds are calm. we've had locally dense fog form. but note the wind direction city of boston out of the south. that breeze helping to warm it up early they are afternoon and hold temperatures up above freezing overnight tonight. in fact, many towns above the 40-degree mark.

patchy fog has formed into orange. satellite and radar composite quiet through the afternoon. saw sunshine returning this afternoon. now seeing more clouds. patches of clouds mixed back in. with a little bit of low level moisture in place, not out of question to see that patchy fog and patches of low cowdz overnight tonight. but i do expect it to remain dry and that any low clouds we have early tomorrow morning breaking apart for a mixture of sun and clouds for the afternoon. temperatures back close to 60 for the afternoon. 40 to 46. with the wind overnight. patchy clouds around. and here are the numbers for your friday. 60 in boston. 62 in norwood. saturday's forecast temperature-wise a rinse and repeat forecast here. maybe a degree cooler in a couple of towns. that should be about it.

notice much a difference between friday and saturday. sunday, you could notice a difference. especially if you live along the coastline from boston points north. high pressure nosing in. here. if winds turn on shore i think across northeastern massachusetts we may hold into afternoon. the further south and west you go, the better chance of seeing temperatures well into the 50s. that's stale bof average for this time of year. the average high at 43 . pattern. here is the pacific. another monster tomorrow barrelling into the west coast. some of that energy will tra verse the country, dip down into the southern plains. this will create severe
