>> check in on that story and right to our top story this morning. the first arrest in the san bernardino terror attack. enrique marquez, the longtime neighbor and friend of one of the shooters appeared in federal court late thursday and is now facing a list of serious charges, and we're learning more this morning about what police say was a dark history with syed farook. nbc national correspondent miguel almaguer is following the story. miguel, good morning. >> reporter: savannah, good morning. if convicted enrique marquez faces up to 35 years in prison. according to court documents he met syed farook, the gunman, back in 2004, converted to islam and a short time later was rad slides this, well before the deadly attack. enrique marquez faced a federal judge, charged with three criminal counts. while prosecutors say there's no evidence he participated in the attack that left 14 dead this month, they say marquez conspired to plan two other terror plots with gunman syed

in late 2011 the affidavit says marquez and farook wanted to attack the riverside community college library where they attended school. duo also discussed throwing pipe bombs from a second floor area above a cafeteria and then shooting people as they fled. the pair also discussed a plot to terrorize a southern california freeway. marquez told investigators they chose the spot with no exits, the plan for farook to throw pipe bombs on to the freeway, walking and shooting into cars. marquez would fire from a hillside shooting police and first responders. what kind of guy was enrique? >> he's what you've seen on tv. he's a dorky kid >> reporter: criminal complaint also charges marquez with entering a sham marriage. he was paid $200 a month to marry farook's distant relative. investigators say marquez bought and lied about the assault

the same ones used in the san bernardino massacre. he also purchased explosive scene. >> enrique marquez has blood on his hands. he was involved in a terrorist conspiracy. >> reporter: after the attack marquez himself called 911. he said that expletive used my gun in the shooting. operator, you said he used your gun? marquez, yes, oh, my god. he threatened to kill himself and the next day he went to the e.r. after drinking nine bottles of beer. in the criminal complaint, according to investigators on his facebook page. marquez wrote, quote, my life turned ridiculous, involved in terror plots, drugs. could go to prison. this before the president arrives in san bernardino today to comfort survivors and family members of the victims. savannah and willie. >> all right. miguel almaguer, thank you very much. let's turn to shaun henry, former executive director for the fbi.

so rare that you get to hear from somebody so close to the shooters. this is really a treasure trove of information for investigators. >> yeah. you know, the two main conspirators here are dead and the investigators talking to marquez, it's a key insight in how this really started, talking about how they became radicalized. who the they were following and how they were inspired. >> according to the affidavit marquez and farook had been planning terror attacks as far back as 2011, four years ago, and again in 2012, well before san bernardino. as you look back on this case are there points along the way where law enforcement might have stepped in and arrested these guys? >> i don't know that we see any red flags to shine a spot light on say, we should have looked here and it kind of shows the progression he was originally introduced to islam back in 2005 when he was 14 years old and then the slow radicalization, how he

red rick and this is really indicative of the challenges of identifying people who are becoming radicalized. >> according to investigators, he is talking, talking to them for 11 days. is that going to help his case? ultimately will that save him from jail time but maybe a lesser sentence? >> don't know about saving him from saving him from jail time. 14 dead americans, a long ranging plot. he's likely going to jail. the fact that he's cooperating will weigh in but i don't think it will excuse him from face the facts here. >> thank you very much. breaking news overnight in the presidential race. bernie sanders' campaign is in trouble for accessing hillary clinton's private campaign data. nbc's kristen welker is in washington for us. kristen, what more can you tell us? >> reporter: this breech happened hon wednesday when a computer glitch allowed people in bernie sanders' campaign to access a democratic donors' database for a brief period.

serious and could hurt sanders who is already struggling to catch up with hillary clinton. >> the blow to bernie sanders' presidential campaign comes on the eve of the next democratic debate and just a few weeks before the iowa caucuses, the democratic national committee immediately suspending access after accusing it of improperly accessing confidential data from hillary clinton's campaign on wednesday. the sanders campaign acknowledged the security breech to nbc news and the dnc official said it lasted for about half a hour on wednesday and believes at this point four people accessed the information. the sanders campaign blaming the soft wear vendor for a glitch that temporarily allowed access to the information, telling news the dnc is relying on an incompetent vendor who on more than one occasion has dropped the firewall between the various democratic candidates' data. according to "washington post"

isolated incident adding by lunchtime it was resolved and the staffer involved has been fired. the campaign maintains none of the information was downloaded or printed. now i want to underscore this one point. while the dnc says four people may have accessed the data, at this point the sanders campaign is holding one person responsible tell me that the behavior is, quote, unacceptable, and that staffer was immediately fired. it's unlikely there will be any criminal investigation. we reached out to the clinton campaign who told me just willie. >> kristen, later today the president conducts his end of the year press conference before going to san bernardino and then off to vacation in hawaii. that presser? >> reporter: willie, look. there's no larger issue for this terrorism and isis and expect that to take center stage during today's press conference where the president will again try to reassure americans that they are safe heading into the christmas holiday, but with criticism mounting that he hasn't been tough enough, the president will likely face pressing questions
