here's what's >> bri: good morning, everybody. expect areas of ice for this everybody. expect years of ice for this morning, and melting on the way for this afternoon. >> breaking news, we're learning ben bill cosby has been charged with sexual assault. from the da in pennsylvania. >> i'm here today on behalf of the district attorney, with me is chief john norris and chief sam galin. we're here to announce today charges that have just been filed against william henry cosby. these charges stem from a sexual assault that took place on an evening in early 2004 in mr. cosby's home in montgomery county. mr. cosby is charged with

this is a felony of the first degree. in cosby's attorney has been notified of the charges, and he's expected to be arraigned this afternoon. when we have a specific time for that, we'll let you know, and that's going to be at the magisterial district judge's. the charges are filed as a result of new information that came to light in july, 2015. the statute of limitations in this case is 12 years, and after determining that the statute of limitations regarding criminal offenses yet expired the investigation was reopened. the chief of police, and montgomery detectives and prosecutors from our office, our team reviewed the initial investigation, and interviewed

the case and from other alleged victims. the evidence shows that mr. cosby established a relationship with the victim after meeting her through her work, associated with temple university's basketball program. through the course of their association, the victim came to consider mr. cosby her mentor and her friend. on two other occasions before the incident, leading to the criminal charge in this case, mr. cosby made two sexual rejected. on the evening in question, mr. cosby urged her to take pills that he provided to her and to drink wine. the effect of which renders her unable to move or respond to his advances, and he committed aggravated indecent assault upon her. now, a prosecutor's job is to follow the evidence wherever it

means whenever it comes to light. when theut federal judge, edward breno unsealed the evidence and we learned about other allegations of other victims under similar statistics, we opening this case was not a question. rather, it was our duty as law enforcement officers with a sworn obligation to uphold our constitutions and to uphold the law. today, after examination of all the evidence, we are able to seek justice on behalf of the victim. now, going forward, we ask that anyone that has any information regarding any similar incidents with mr. cosby come forward.

mr. cosby's home in cheltonham in 2004, and there's one charge filed, aggravated indecent assault in the first degree. >> reporter: is there any indication that she would be willing to testify in trial. >> she indicated that she'll be willing to cooperate. >> reporter: [ unintelligible ] i didn't speak to her and can't give you an answer to that. one charge, indecent assault, and there's a statute of limitations as to that charge, within 12 years, and that's the charge that we filed. there are separate sections of that, and it's one charge. >> reporter: can you describe

does that play into the charge? >> the charge is aggravated indecent assault. and the breakdown of that statute is number one, a person commits some type of vaginal penetration, digital penetration, and the person does so without the complainant's consent. that's one, and second, the complainant is unconscious, or the person is unaware that the penetration is occurring, and the person is impaired and administering drugs or toxicants for preventing resistance, and that's the breakdown of the

>> this is the central charge in the case. it's aggravated indecent assault. a felony of the first down, and that's where. we're not looking at other charges at this point because this is the charge that we have the ability to go forward on under the statute of limitations. >> reporter: does it become complicated for the prosecution that the victim continued to have at least a social relationship with mr. cosby after the incident? >> i'm not sure what you're referring to at this point. there's investigative materials that we have gone through, and we have looked through a lot of evidence in this case to make the determination that we have. when you look at the case, there is a number of aspects that are undisputed in the case. and that has led to the charges

today here. there's not a question in terms of pills being provided to her, and there's not a question as to the occurrence of what went on, of the digital penetration, and we have gotten that from statements, from depositions, and that led us to today, and the filing of charges of aggravated indecent assault. >> reporter: can you say anything about the decision not to prosecute him 10 years ago, and why you were able to make this decision, and why in the past they weren't? >> i'm not going to look at the past and look at that point. it's not time to monday morning quarterback. we have exam indithe examined the evidence in this case, and made examinations

evidence is strong enough to proceed at this point and we're proceeding with the charge of aggravated indecent assault. >> reporter: can you say what opened the door to this investigation? >> there were a number of aspects, but if i can refer you to the affidavit of probable cause, which is extensive, and i don't know how far everybody has gone through, but there were specific questions in that regard to using quaaludes. and i think that that has been widely reported. and that's a significant factor in making a determination. the detectives followed the evidence, where it led them. we examined all of the evidence that we had available to us, and made this determination because it was the right thing to do. one more. >> reporter: do you believe that it was quaaludes used in this case? >> if you look at the affidavit of probable cause, and

the inclusionary aspects of the case, what we know, pills were provided. there's inconsistencies on what type of pills they were, and there was also wine that was provided. we then go to the reaction of the victim. frozen, paralyzed, unable to move. a person in that state cannot give consent, and therefore, the aggravated indecent charge. >> all right, you heard it there. bill cosby has been charged with sexual assault, more than a decade after a former temple university employee said that the comedian drugged and violated her at his home in philadelphia. it's the first criminal charge for cosby over his behavior with women. >> a major development.
