flurry of motions in advance of tomorrow's sentencing hearing for chism and here is one of them upsetting the family. it asks the judge to only allow statements from family members. people can give victim impacts statements. philip chim was just 14 when he attracted and strangled his teacher. the jury convicted him of murder, aggravated rape and armed robbery. he murdered koll even ridser in a danvers high school restroom in october of 2013. strangled her, used a box cutter. i speak briefly to chism's lawyer about her controversial motion which the judge denied this afternoon. why limit the victim impact statements? >> it's the law. >> reporter: so there you go. a very brief comment indeed. chism was not in court calling ridser's parents were. they left the court without saying a thing. they're expected to make a

sentencing and of course perhaps we believe afterwards as well. the state wants two consecutive sentences guaranteeing chism at least 50 years behind bars. we understand nine family members and friends will give their impact statement tomorrow. the judge says he will let them talk as long as they want but they have to speak directly to him and not to chism. i'm jonathan hall, 7 news. >> jadiann: wareham police making a robbery arrest. 16-year-old alvin fill bert faced armed robbery charges. he held up the gas station with a crowbar. he was arrested yesterday while walking in wareham. >> adam: a nurse at a v.a.hospital in pennsylvania is aus cooed of showing up to -- accused of showing up drunk. she was' called for an emergency surgery. police say there is video of him stumbling through the

in to help with an emergency apendictry. >> patient safety is paramount. we made sure there were no unsafe situations for the parents. >> adam: the nurse was responsible for preparing the patient. prepping the material in the o. r.and monitoring the patient's vitals according to court papers. the man said he had 4 or 5 beers at a casino before he was called in. >> jadiann: controversial happening in arizona. the state is one of eight that has a law in place to exclude homosexuality court study. teachers are in the allowed to discuss it at all. even in sex ed classes. students are saying it's just not right. >> makes you feel unequal. it doesn't make you feel like you are on the same playing field as your peers, you are opening up four lgbt youth, we're not giving them all their options to protect themselves. >> jadiann: supporters call this a giant gap in curriculum. one that comes with serious health consequences.

raising eyebrows with its gender neutral bathrooms. officials say it's part of an effort to make sure all students and staff members feel accepted. what once served as two separate restrooms can be used by anyone in the building. >> it shows another identity is legitimate. >> i was -- >> reporter: the idea came from zoe wagner who said students come from all walks of life. >> there is a transgender population and there is a population of student that don't adhere to the gent gender binary. >> reporter: the single unit restrooms are located in the library. >> this is not, you know if you are transgender you have to use this in any way possible. it's to asecond option. >> reporter: not everyone who uses the space is on board with this just yet. saying it'll tie time to get used to. >> a lot of people don't agree with this. so i feel like it's just different.

says if the change can make an impact on one person then it's worth it. >> we have a responsibility as the adults in this building to make sure that our students feel included, feel safe, feel accepted and i actually felt ashamed that before. >> jadiann: roosevelt high is the first public school in des moines to restrooms. >> adam: a young boy in missouri told that he can't attend his charter school because of the color of his skin. the boy has been at the school for three years and whether his family moved out of st. louis, sate law told them that african americans outside of the city can't attend city schools. the law was supposed to stop seg gauges but the boy's mom says it's discrimination if our neighbor had the same age kid they could come to the school if they were aany other race besides african american in and it doesn't sit feel. we teach our son about equality. that is not teaching our kids anything cause it's based off race.

>> here you can't see him but his head is down. and he is driving very slow so i'm afraid he is going to veer over into the westbound lanes. >> reporter: simpkins yelled at the driver to get his attention. the driver speeds up and is totally out of control. >> i thought he was going to run head-on in a car coming westbound. >> reporter: he is able to talk the driver into pulling off. >> pull over, pull over. >> reporter: once into a parking lot he convinced the driver into giving up his keys for the safety of all. >> i think i saved lives that day. not only somebody else's life but i think i saved this guy's life. >> reporter: sheriff's deputies arrived but because the driver had taken the keys out of his ignition, hes wasn't charged with driving under the influence. >> we had some good citizens that were in the area and number one, didn't get hurt. but number two, were able to take steps to get this guy

>> adam: a two-year-old dog near death tossed out like trash in korea but she is getting a new lease on life. >> jadiann: the dog was headed to the butcher until the good people stepped in to rescue her. they're working to heal her. sara french has the story. >> reporter: buried in a trash bag in korea a 2-year-old dog who had been raised for her meat. >> they consider it often a delicacy so they pay a lot of money for it and so there is a market for illegal dog meat. >> reporter: richard's family rescued several dogs from abusive backgrounds but this could be the saddest case. the butcher thought her meat would be rancid so he literally through her in the garbage. she couldn't move at first,

this is happening on mount pleasant avenue in roxbury. boston police are on the scene. we don't have any word of any injuries at this time or why this happened but we'll follow this as the story develops. >> adam: after nearly a year in space, astronaut scott kelly is a few days away from coming back to earth. he held his final news conference from the international space station. the i.s.s.today. the 52-year-old astronaut talked about what he plans to do when he gets back home. >> i'll go to the astronaut crew quarters at the johnson space center for several hours of medical tests that end at about 3:00 in the morning. and then i'm going home and jump in the pool. >> adam: he heads back to earth on tuesday to end nasa's longest space flight. he will land in kazakhstan then home to houston. we're debating what would you do if you were in space for a year and -- i said cheeseburger. >> jadiann: i find it interesting that he wants to get in water which has a

we got a nice dose of warm weather. feels a little bit like spring has sprung. >> adam: but it came after some wild weather overnight. no doubt. strong storms leaving behind a trail of damage across the area including this scene in cambridge. a car crushed by a tree. heavy rain, strong storms bringing down trees and power lines in many areas. >> jadiann: route 9 closed for most of the morning in both directions. power line feel near the natick mall. the thunder woke up a lot of people. it did me and it didn't just make me up gracefully. it was a jolt. >> adam: it led to some extensive cleanup efforts across the commonwealth. let's go to canton right now. close up led to a close call for a police officer. they had to jump out of the way when a telephone pole almost hit them. dan hausle live in canton with a look at what happened there, dan? >> reporter: a barrier blocks the street. it turns out for good reason. you can see one of the
