in the newsroom, i'm ryan schulteis, 7news. police and crews on the scene at the ashland reservoir where they say a helicopter has crashed into the water there. police say the pilot is on shore and is okay. but the helicopter is still deep in the water, no word yet on what caused this crash. >> also breaking tonight, no charges in connection to a deadly police shooting of a area. officers shot and killed 26-year-old ussamah rahim last year in roslindale. the d.a. says the officers here had no choice. >> 7's byron barnett begins our breaking team coverage right now of the story. >> surveillance video of ussamah rahim entering a leaving a roslindale cvs store. police say the cord you see dangling from his left side was used to tie a 13 inch military style knife to his leg.

two other men were under surveillance for conspiring to behead a person in new york on behalf of isis but the d.a. says in june of 2015 authorities learned rahim changed his plans and announced he was staying in boston to attack police officers. so the d.a. says after rahim left the cvs and was about to get on a bus, boston police and fbi agents tried to arrest rahim. but ended up shooting and killing a heap when he came at them with his knife. >> mr. rahim continued his armed advance facing an active ongoing and continuing threat to himself and others the boston police detective fired one round at mr. a hen and an fbi agent fired an additional two rounds at him. all three rounds struck mr. rahim who collapsed with the

s. >> be 7's tim caputo continues our breaking team coverage now. >> yeah, attorneys for the family said the investigation was very pair that okay specifically about the actual gunfire by police officers, but they take particular issue with what led up to that gunfire. the family of ussamah rahim believes police may not have escalated to a shooting if law enforcement approached him differently. attorneys on behalf of the to let him go even though they didn't have an arrest warrant. >> commissioner evans said that law enforce am officers were under order to, quote, take him down, end quote. both of these stays are in sharp -reported directly afterorcement ussamah's shooting, claiming that they approached ussamah only with the intent to question him. >> reporter: attorneys for the aclu also questioned whether police acted too aggressively.

rubble. this powerful earthquake flattening buildings in several towns, in central italy, leaving thousands homeless, the epicenter was in the town where local officials have been begging for rescue equipment, blood donations and basic food and medicine for survivors, and in some mountain towns, it has been difficult for rescue workers to make it up the steep hillsides riddled with debris to reach survivors. the earthquake so powerful, people hundreds of miles away felt the rome. >> it was a pretty long time. we kept looked at what was going on and there were people in the hallway and kind of coming from there so it was certainly

okay. meantime, the italian prime minister says rescue efforts will continue over the next very crucial few hours. in the control room, i'm nick emmons, 7news. and new here at 6:00, vajths setting off explosives in salem. from this video you can see a crowd of people gathered before they start running away out of the frame of police say they set off an explosive and the boom was heard from a mile away. stat help identifying anyone who may have been involved. fallout from a controversial punishment, a former star athlete at east lawn high school convicted of expawflting two classmates. his sentence, two years probation. >> the punishment leading a petition to remove the judge from the bench. kelli o'hara in east long meadow with the story for us. >> that petition has more than 10,000 signatures. there's a lot of outrage online

not a lot of people have been happy with this publicment especially because the teen admitted to his crime to that judge. >> reporter: controversy in the court after a judge allows an accused racist to go free. >> to find him guilty at this point would slam a lot of doors. >> reporter: 18-year-old david becker, a popular soccer and basketball player at east long meadow high school, was charged with rape and indecent assault for sexual assaulting two female classmates while they slept at a house party this past spring. but last week idi the case was continued without a finding. despite the district attorney saying the teen admitted his guilt, the d.a. arguing this audio recording of becker should be locked up. >> this defendant has been given quite a few breaks already, and to put him on a college campus where there is a moderate to low risk that this could happen again i would suggest is a risk with at least the commonwealth is not willing to take. >> reporter: but it was when one of those victims read a letter read by the judge asking for

two years probation. becker isn't the first athlete to escape a lengthy jail time for a big offense. a california court gave rock turnery six month jail sentence for sexual assaulting a woman that caused a national uproar earlier this year. we did reach out to the judge. he declined to comment. as for that teen, if he keeps his nose clean for the next two years, his charges could be dismissed. kelli o'hara, 7news. and the sus alarming attack hides his face in court. he's accused of sexual assaulting a woman until the south end he was on probation at the time. dan hausle is live in boston with the full story. >> this suspect was on probation for a previous conviction. that didn't stop him from allegedly carrying out the crime but the terms of the probation did help police find their suspect. records ward rodriguez listened how prosecutors said they know

morning. the prosecution side rodriguez was wearing a gps bracelet around his ankle after a previous rape conviction. >> gps had him pinpointed to the exact area where the victim says the raven occurred. >> reporter: the prosecution says rodriguez was released last december after serving eight years on the earlier rape charge and she says he walked away from a drug treatment program three days before month's crime. a close friend of rodriguez said she had no idea he'd been in prison for rape. >> i'm upset what he did to that lady, but she have to suffer. you know, i'm a woman, so to me he can go to jail for 10, 15, 30 years to life. >> reporter: the prosecution says rodriguez forced a woman into a south end playground we raped her, robbed her of cash and a cell phone and took off, almost exactly what rodriguez was convicted of doing to another woman eight years ago. >> the young woman is walking alone to the bus at 6:00 in the morning. this defendant approaches her, indicates to her that he has a knife, that he will stab her if

her to a secluded area and violently rapes her. >> reporter: mayor walsh says he's glad the judge slatched a half million-dollar bail on the alleged rapist but knowing he's a repeat offender is troubling. >> i don't know enough to say that he came out and was reacted but certainly it's a situation we don't want to see happen anywhere. >> by the way, if you went to the sex offender's registry right now despite his conviction, you wouldn't find rodriguez's name there. because a recent state supreme court ruling changed the names from the public section of that list. each case has to be appealed by the registry. until then, the public can't see, it though police still can. we're in boston, dan hausle, 7news. also a dangerous drive in mendon, a school bus and car collide. we've got the video here from sky 7. police say the driver of the black car there on the left was trying to take a left on route 140 in mendon this morning crashing into a bus. 16 kids were on board the kids
