>> reporter: he was indicted 6 months to the day after he drove his suv into this restaurant behind me. it is boarded up. still closed here in september. evidence that back in march. and many in town were wondering if this day would ever come. 6 months after an suv plowed through this packed newton restaurant the driver has been indicted. brad ford cassler who was behind the wheel that with 2 counts of motor vehicle homicide. >> the facts will come out. if it's through the legal system that's great. we knew when it occurred. we didn't know the circumstances. hopefully there can be closure. it's a loss for all concerned. tragic. >> reporter: gregory moran and 37-year-old eleanor mery both customers inside sweet tomatoes

crash. the once popular restaurant has remained closed since the wreck. those who know the restaurant owners say it's been tough on everyone this year. >> we've all tried to support the business that's boarded up. i hired this truck a couple times. a lot of support for sweet tomatoe. >> reporter: so cessler's license was revoked almost immediately after this wreck. he will be arraigned in court. live ; an intense fire breaks out at a home in hingham. brandon gunnoe is there with details about this fire. brandon. >> reporter: ryan, that's right. fire fighters are working on a hot spot. a little bit of hot spot out of thatatic. this fire started 2:00 this afternoon. flames tearing through this home.

around 2:00. this is a 3 family home. part of the street is closed as this investigation continues. what we're told is it's a 3 family home and the woman who lives on the top floor was moving out and she was in the process of moving which made it difficult for fire fighters to fight this fire. the movers noticed the fire and got everybody out and that's when this started. >> i heard a man yell get out then they all -- all the moving trucks there were 2 big moving trucks and they left and the fire trucks came. and we saw the fire coming out the window. >> reporter: now i just spoke top a city official from here in hingham. he tells me that 3 fire fighters were hurt battling this fire. all of them minor. one i believe has a cut. the other injured his ankle.

week. >> tonight on 7 a college student hit by a train. >> just started a few days ago and he's already dead. >> it's a tragedy on the tracks. >> anchor: a boston university student was hit by a rail train crossing the tracks. >> anchor: shock waves across the bu campus. the latest from steve cooper. >> school started a few days ago and he's already dead. very >> reporter: a 17-year-old boston university freshmen who police say was from china is struck and killed when coming in contact with a comuter train. >> this is a tragic horendous accident. >> reporter: happened under the mass pike under the bu dorms on buke street. the teen was alone and no foul play is suspected. >> i remember being a freshmen. everything is new and you're

gosh no one has a chance. >> reporter: the teen was hit by one train. it was the conductor of the second train that noticed the body. that train was kept at the scene by detectives for 3 hours in the middle of the night before the train was allowed to continue on. >> we are going to conduct a review and determine why the delay for the passengers was as extensive as it was. >> and as investigators continue to look for heart broken kids on campus. >> we felt really bad for his family and for him. class just started yesterday. >> reporter: because the victim's name hadn't been released school officials were urging students to let their parents know they were okay. the cause of the accident is under investigation. in boston steven cooper 7 news. >> anchor: pleading not guilty in the murder of his 19-year-old daughter.

without bail. investigators say he shot his daughter 19-year-old sabrina in july when she was getting back home from the grocery store. sabrina's aunt was emotional in court. >> i can't believe that some lawyer can defend a monster like that. i can't believe. he got in the courtroom laughing. i can't believe he -- he's a monster. >> anchor: prosecutors say da silva and his daughter had a strained relationship but reun i her murder. >> anchor: police in natick looking for a man caught on surveillance camera stealing a car. 3:00 in the morning on friday. anyone with information is asked to please call natick police. >> anchor: you can see that car flipped over on the side of the highway there. it happened near exit 23 in marlboro. both people are expected to be okay. >> anchor: and more news today a

to court facing a number of charges. police and witnesses say damien ta hada broke into a home on sunday and tried to break into 2 more. they called police. and before officers arrived this witness said ta hada tried to break into 2 more apartments. officers did arrest him after they saw him jump on a roof and into someone's home. an attorney for the man said he was running away from a fight. >> anchor: a quinsy woman accused of driving drunk facing a judge today. police say she ran into the back of a cruiser on 93 in boston early yesterday morning. the trooper inside the cruiser was taken to the hospital with minor injuries.

there are a couple of things candidates could do to help themselves. for donald trump goal number 1, 2, and 3 is be presidential. persuade the audience you're ready for the oval office. voters are starting to watch more closely now. give them something different to see. for hillary clinton the challenge is to be more personal and less overwhelmed by policy. we know she knows all the programs but somehow we do tip number 2 for the donald ignore the hillary. speak above and beyond her. tell us your foreign policy without worrying about hers. make the case for you not against hillary. tip number 2 for hillary clinton is try not to cough seriously. maybe it's just republicans who are trying to create a health issue. don't give them any ammunition. there will be a winner tonight

>> anchor: a loving dog getting a second chance right here in massachusetts. so his name is maverick and he survived a life of horrific abuse. at one point he couldn't walk. >> anchor: this determined dog is making a come back. more on maverick's road to recovery. >> his new back yard and stove. maverick the lovable 2 year old german shepard has gotten a second chance.

the foot doesn't seem to be holding him back too much. >> reporter: a thousand dog lovers wanted to adopt maverick after learning his story. >> that horrific. >> reporter: in july authority rescued maverick from his home. free of a line that kept him tied up outside. after surgery on his paw maverick has a woods to play in. tons of donated toys and a warm doggie bed inside the house. >> i would think he would be skittish and draw back from people. it's the exact opposite. he runs up to everybody and thinks they're there to greet him. >> reporter: maverick's previous owner was charged with animal cruelty. maverick has his own legacy. helped inspire a pet protection law signed by the governor.
