na >> christa: we begin here at noon with a developing story. investigators trying to figure out what led to a deadly rollover there were six people inside when this van crashed. and this was on 495 this morning. >> sarah: at least one person was killed. the other taken to local hospitals. john cuoco is live in merrimack with more on what police are saying. john inst >> reporter: well, state police believe the fact that most of these men were likely not wearing seat belts played a big role here. if you take a look behind me. the highway has opened up. the accident has been cleared.

massachusetts state police say this van had six men inside when it flipped over. and was sent rolling off 495 north in merrimack thursday morning. one man was killed in the crash. the five others were taken to four different area hospitals. state police believe it is likely that most of these men were not wearing seat belts. we are told the group were on their way to work when the van somehow went off the highway. near the exit 53 off-ramp. within the accident debris that spread across the pavement, were construction equipment. like hand tools and ladders. crews cleared all that from the road before towing the van from the scene. traffic was down to two lanes for hours, but the highway opened back up just before 10:00. and state police say they will likely be releasing more information on this crash at some point today. for now, we are live in merrimack, massachusetts, 7 news. >> christa: we have more breaking news at noon. crews coming to the rescue of

feet. below ground. let's go to victoria warren. she has more for us. >> reporter: christa, just a short time ago, they pulled this man out of the trench. everyone on site here, so thankful that this man is going to be okay. we have some video of the moments after he was lifted out of the ground. technical rescue teams raced to cambridge once they learned this construction worker was 30 feet below ground and couldn't get himself out. they worked to stabize loading him into an ambulance. he was in the trench and hurt his leg while crews were lowering a beam. his leg was cut. the bleeding was quickly controlled. it did take some time to set up the rescue. they needed to set up a system of pulleys. then everything went as planned. typically, that worker in the trench would have used a ladder to get himself out. so the man was brought to the hospital. again, we are told he is going to be okay. osha is on scene.

first place. live from cambridge, victoria warren, 7 news. >> christa: more breaking news, this time out of texas. police are responding to an active shooter situation at a high school in alpine. right now police are eadvantage waiting students as they search for two possible shooters. right now cnn is reporting that one person is dead. the shooting apparently happening inside the school's band hall. we will be continuing to follow the latest details and let you know it becomes available. >> sarah: more breaking news now. the u.s. olympic committee and u.s.a. swimming have suspended four members of the 2016 u.s. olympic swim team. ryan lochte is suspended for ten months. three other swimmers will be suspended for four months. this comes after the four claim they were held up at gunpoint by a man at a gas station in rio. it was later revealed lochte made up much of the story.

deadly drive into a newton restaurant now facing criminal charges. the driver who plowed through sweet tomatoes killing two people was indicted by a grand jury on wednesday. this afternoon, the middlesex district attorney is talking about the decision to charge the driver. steve cooper spoke with her and he joins us live in wakefield with the very latest. >> reporter: and sar remarks these are actually three copies of the indictments. the three charges that bradford castler is facing chance to talk to the district attorney about why it took six months for those charges to be filed. we are getting our first look at copies of the three indictments handed out by a middlesex county grand jury against a 55-year-old bradford castler of newton. he is the driver prosecutors say plowed his s.u.v. into sweet tomatoes back in march, killing two customers. 7 others were injured. the district attorney late

details on why it took so long for the charges to come out. >> did it take an extra amount of time? i mean, six months to get an indictment? >> no. you know, as i think we have seen play out in many of these cases, over the last few months, just seeing cases, a year, six months, whatever, across the state, we want to do this right. >> reporter: c not have prevented the tragic accident. his attorney was suggesting there might be a health issue here. do you know anything about that? >> that will play itself out as the case unfolds. >> reporter: are you saying this is more than a tragic accident? >> if things play out, we will

present information to this court. >> christa: that was steve cooper reporting. also today, a deadly shooting that happened overnight in dorchester. boston police say a 20-year-old man was shot and killed around 8:00 on ripley road. witnesses say he was standing outside. that is when someone just simply came up and started shooting. a woman saying that she is the victim's sister, clearly distraught at the scene. yelling that somebody in the crowd must have known something. and she was also heard yelling at police officers her brother's body from the ground. police up in new hampshire arresting a 20-year-old thomas ford, jr. after he robbed a convenience store and attacked the store's 81-year-old obstruction of justicer. officers say this happened at hahn's food mart in manchester yesterday. ford now faces several charges. >> sarah: the new england

>> christa: today the head coach bill belichick shut down those questions. dan, he did not seem to be a fan of your question about that. >> yeah. what a big surprise, huh? well, yesterday, jimmy garoppolo tried to avoid causing any controversy, spouting phrases like "it is what it is." and "straight on to arizona." he did raise eyebrows when he without tom brady there. coach belichick didn't want to add any fuel to the fire. that wasn't the only subject he didn't want to talk about. jimmy garoppolo stirring up a bit of controversy with his comment wednesday that things are running smoother at patriots practice now that it's just him and brissett taking quarterback snaps. some have taken that to mean sharing snaps with tom brady before his suspension was a problem. coach bill belichick refused to weigh in on the topic. when i asked him about garoppolo's comment.

the former secretary of state lashing out at donald trump after wednesday night's commander in chief forum. >> last night was yet another test, and donald trump failed yet again. we saw more evidence that he is temperamentally unfit and totally unqualified to be commander in chief. >> nancy: clinton announcing a meeting tomorrow of a bipartisan group to focus on isis. >> we should make it a top priority to hunt down the leader of isis to justice, just as we did with osama bin laden. >> nancy: during wednesday's forum, trump criticized military leaders. >> the generals have been reduced to rubble. they have been reduced to a point where it's embarrassing for our country. >> nancy: clinton responding with harsh words on thursday. >> that is how he talks about distinguished men and women who have spent their lives serving our country.

>> happy thursday to you. i'm danielle gersh in for chris today. 76, the temperature in boston. dew points, not too far behind those temperatures. in the upper 60's. another muggy day. those winds out of the east at 7 miles per hour. it is going to stay pretty humid today and tomorrow. it is pretty gloomy out there as well. heading into this afternoon,

sunshine. that will warm those temperatures up into the upper 70's. some spots in the up. 80's. to our southeast, we are still seeing the remnants of hermine spinning off the coast. that is part of the reason why we are seeing gloomy conditions still. tomorrow, more sunshine on the way. and this afternoon we will start to see more sunshine as well. but it's really kind of a gloomy week. dew points in the upper 60's for today. heading into tomorrow, really the same story. another muggy day on the way. mid to upper 6's we will see the humidity drop, though, for saturday and sunday, as we head into the weekend. the drought monitor just updated today. and pretty much the same story. we really needed the rain. extreme droughts still stretching across the eastern part of massachusetts. up into new hampshire as well. we need any rain we can get. we have a couple of chances heading into the next couple of days. and into the weekend to see that rain. but at the most, a passing shower or storm. no big rain-makers on the way here. the first chance will be overnight tonight.

into tomorrow. behind the front no, cold air. it is going to be warm tomorrow. temperatures near 90. more sunshine, too. the next chance to see a passing shower will be saturday night into sunday morning. early sunday morning. again, these are not looking like huge rain-makers for us. for today, upper 70's into the mid-8's inland. that sunshine peeking through this afternoon. look at our overnight temperatures, though. into the low 7 through the overnight hours. this is pretty much where temperatures should be averaging. for highs during the day. tomorrow, near 90. if we get there in boston, this will actually be our 21st90-degree day of the year. on average, we should only have about 14 of those. so heading into the weekend, tomorrow, near 90. saturday and sunday, though, temperatures pleasant. monday into the 70's. then looking nice next week. still above normal.

year, six months, whatever, across the state, we want to do this right. >> reporter: castler has been indicted on two countsle of motor vehicle homicide and one count of operating to endanger. his attorney told us castler's health and physical condition could not have prevenned the tragic accident. >> his attorney was suggesting there might be a health issue here. do you know anything about that? >> you know, that will play itself out as the case unfolds. record included three accidents since 199, plus a speeding ticket since 1991. >> if things play out, we will be presenting information and obviously, the defendant will be presenting information to the court. >> reporter: when will castler answer to the indictments? no specific arraignment date has been set yet. the district attorney telling us late this morning that she expects he will be facing a judge sometime in the next

>> christa: more news now: a marshfield man will be spending ten years behind bars after pleading guilty in connection with the death of his infant daughter. ryan barry pleading guilty to manslaughter charges after his five-month-old daughter died of an opioid overdose. back in 2011. police say barry and the child's mother ashley sere poisoned their child by feeding her baby formula laced with opioids. >> sarah: a deadly explosion at a home in franklin. officials say a gas leak is to investigators say an elderly couple died when something ignited the gas that had been leaking into the home in october of last year. fire officials do not believe it was intentional. >> christa: a common problem in westwood. it happened again. as yet another box truck ends up getting stuck under the east street bridge. the truck couldn't make it all the way underneath the bridge yesterday. the passenger hopped out and then tried to guide the driver away from that area.

have shown you, has been a problem spot for years. ripping the tops off of trucks and causing collisions. as you see there. that height of the bridge will be raised, though, in the next few years. >> sarah: now at noon, las vegas police under fire after a murder suspect escapes from an interrogation room. all caught on camera. the suspect back in custody, but changes are being made to keep it from happening again. >> we are very aware that mistakes were made. surveillance video of a suspected killer alonzo perez. amazingly, police were not. the cam remarks the only thing catching perez, working to break his handcuffs and get free. >> he torqued it to the point, using some of his body weight, that it snaps the hinges. >> sarah: perez is free to plan his escape. at 12:30 p.m., police reentered the room, in the noticing the broken handcuffs and the walkout. the camera is still on.

>> reporter: 40 minutes passed without anyone watching perez. it is time a suspected killer uses to make his escape. watch here as perez hops the desk and clipse toward the ceiling. >> puts it up against the wall. climbs up on the chair. knocks out a few ceiling tiles. climbs into the rafters. exits the building. i won't say that he wasn't seen. he wasn't seen by us. unfortunately. agencies worked to find perez for four days. he was arrested on tuesday just after 8:00 p.m. the family of mohamed robinson murdered, and the reason police arrested perez in the first place relieved. still they echo the same question. why was no one watching and wondering the same thing about the officer in charge at the time perez escaped. is he still on the case? >> yes. it is his case. i wish it hadn't happened. but it did.

we are not perfect. the police are simply not perfect. >> sarah: of course, policy changes are now being made, the police say. >> christa: a girl from north carolina is recovering after a shark attack. and a warning for you. you may find some of these images graphic. the girl was attacked while swimming off of myrtle beach. on labor day. she is now recovering from 39 puncture wounds . she has 25 stitches. she is expected to make a full recovery. last year,ht carolina coast. a man in florida getting arrested after his yacht washed up on-shore in palm beach. the 63-year-old man admitted he was drinking when he missed the palm beach inlet and then ran aground. ran into the beach. beach-goers spotted the 72-foot yacht named time-out. just floating there at the shoreline. the suspect was charged with boating under the influence. >> sarah: a kansas man serving a life sentence after committing a crime for a

normal. keep in mind, august was the warmest on record. i talked about how it's muggy out there today. it is going to stay that way into tomorrow, too. those dew points staying pretty consistently. in the mid to upper 6's throughout the next two days. so tomorrow, with that heat, we are also going to be dealing with the humidity. it will be hot and humid. a day you definitely want to stay hydrated throughout the day. here sa look at the satellite and radar. still gloomy out there. part of the reason for that, the remnants of what was herm our southeast. i think by tomorrow, we can finally stop talking about this. we will get some more sunshine around. the drought monitor updated on thursday. extreme drought: still basically for everyone inside 495. up to manchester. and pretty much all of the state in a severe drought. we need any rain we can get. over the next 7 days, we are probably not going to see too much of it. we have a couple of chances for rain. one actually comes overnight tonight. into tomorrow.

passing shower. then tomorrow, more sunshine. behind this front, the temperatures are going to be really warm. and then near 90. saturday night into sunday, a stray shower passing by. really, that is it. the weekend looks really good. if you have weekend plans, you are in good shape. for today, temperatures inland will climb into the mid-80's. then the overnight temperatures tonight, into the low 70's. it is going to be very mild through the overnight hours. for tomorrow, it is going to be a hot day, a humid one. if you are heading to fenway tomorrow night, jason aldean and kid rock, it's going to be hot. temperatures in the upper 80's. the 7 on 7 forecast, again, a possible stray shower overnight tonight. into tomorrow morning. tomorrow is a hot one. near 90. saturday and sunday, though, looking really good. in the low to mid-80's. then next week, less humid monday and tuesday.
