now, last month, the police union and the mayor and the police commissioner agreed to a voluntary pilot program where police officers would wear body cameras. but the thing is no volunteers stepped up. so the commissioner made the program mandatory. and the police union sued, saying the city had to bar gain with them on this matter. now that they are making it mandatory. but the court decision came down today. again, denying the motion by the police union. saying that the commissioner... the statute grants the commissioner power. the test pilot program will go forward. the court did say that still can be arbitrated and bargained. but that the test pilot program should not be stopped

minutes ago, talking about this. one from the aclu of massachusetts. called this a great victory. for police accountability. and a victory for civil rights. we still haven't heard anything from the police union yet or from the police commissioner yet. we expect to hear from those folks later today. in the meantime, the police commissioner has said that the pilot program for the body camera... test pilot for body cameras will begin next monday. that is the latest live here outside suffolk superior court. i'm byron barnett, 7 news. >> christa: this new hampshire man under arrest, charged with a creepy crime. police say that he exposed himself to students near lexington high school. >> sarah: the suspect is a registered sex offender. police say he has done this before. we are live with the very latest. >> reporter: the big question is why. i have been in contact with the police department this morning. why would this man come to lexington from manchester, new hampshire. they are still looking into it. and they are talking about

departments where they believe this man may have visited. now,s if this is the concord district court. the man expected to face a judge for arraignment shortly here. he may not have to show his face according to the judge. this, after allegedly exposing himself to students at lexington high school the last couple of days. 30-year-old jacob mobley-hall has been charged with three counts of open and gross lewd and lascivious behavior. mobley-hall exposed himself near the high school on a the same thing happened wednesday. they are seening additional charges. that is 7 in all for the 7 victims. now, the state of new hampshire says mobley-hall was convicted of similar charges in the granite state. that was back in 2008 and 2009. reporting live in concord, i'm jonathan hall, 7 news. >> christa: all right, thank you. more breaking news right now.

a massachusetts prep school has now been arrested. they say stephen bliss agreed to pay for sex with an undercover detective. officials say that he agreed to meet the undercover officer at a mcdonald's in worcester tuesday. that is when he was arrested. that man was facing several charges, including human trafficking. >> sarah: state health officials are trying to figure out why close to 50 birds were found dead or sickened. victoria warren joins use >> reporter: yeah. there are some cats that were sickened. you can imagine the folks that live in this neighborhood. they are concerned about this. they want to know if there is something in the environment that is to blame or if someone is doing this on purpose. dozens of dead or sick birds in a quiet dorchester neighborhood. and several sick cats. >> it is alarming. >> the animal rescue league investigating, saying they found 47 birds either dead or

the supreme judicial court agreeing with the superior court's conclusion that sean ellis was unfairly tried. ellis was convicted of first-degree murder. he spent 22 years behind bars. he has been free on bail since 2015 after that superior court decision. also on 7: worcester police investigating a deadly shooting that happened outside of a bar. one victim has died. a second is in the hospital. this happened near gallagher's pub on west boylston street. officers have not said if any suspects have yet been identified three massachusetts state troopers have now been suspended without pay. they work at the department's armory. and they are off the job as the department investigates the transfer of weapons from the armory to an outside vendor. the state police say the vendor was state-approved. but the transfer itself is being investigated. the attorney general is assisting the state police with that investigation as well. city officials declaring a stage three water emergency in worcester. this means restrictions on any

left for dead. >> christa: well, thanks to a huge show of support, it looks like freeway is getting another chance. here is nancy chen with the story. >> reporter: christa, that one-year-old husky was badly injured. he will still need several surgeries in order to recover. but thanks to a good samaritan and generous on-line donations, freeway will now have the chance to get back on his feet. even with a broken leg and pelvis, freeway has plenty of energy. just a week ago, this one-year-old husky was hit along revere. >> you left them to die. >> reporter: a driver headed in the opposite direction pulled over and carried freeway to safety. >> stayed with him. gave him water. made sure until somebody could give them help. when i got there, he was pretty bloody. didn't walk, screening, howling in pain. >> reporter: the husky was rushed to a local animal hospital.

every time a new charter school opens in massachusetts, it takes funding away from regular public schools in that area. this year alone, charter schools will take more than that's not right. instead of draining even more money from neighborhood public schools and giving it to charters, let's devote public resources to all of our students... not just a select few. don't lift the cap on charter schools.

boston police patrolman's union has been denied. and that means the body camera pilot program in boston will go forward. now, last month, the police union in boston, the may beyond the police commissioner all agreed to a voluntary pilot program for body cameras. but no one in the police department volunteered. the police commissioner made the program mandatory. the police union sued, saying e and by making it mandatory, it was a violation of the police union contract. however, this court's decision today says the commissioner has significant authority over matters such as deployment. in this case, there is no different than decisions regarding uniforms, weapons, duties, and assignments. a few minutes ago, we heard from a couple of advocates for body cameras on police in boston. they were obviously pleased with the court's decision.

with the judge's decision. we are cautiously optimistic. the program has not yet begun. until the pilot program begins, we are still heading our breath. >> this is a great moment for police accountability, police transparencey, and for civil rights in boston. >> reporter: and we just got a statement from the police union who indicated the president of the boston police patrolman's union, pat rose said they are disappointed in the ruling. but they will, in fact, work with to make sure that the pilot program does what it is supposed to do. now, the court ruling also said that this still could be bargained. this still could go to arbitration. but that the police union has no right to stop the test program. no word yet from the mayor or police commissioner. we expect to hear something from the politician commissioner later today. in the meantime, the pilot program, according to the commissioner, will go forward starting on monday. live here outside suffolk

crews were able to rescue a majority of the riders last night. but more than 30 people were stuck overnight because of dangerous conditions. >> we were there almost ten hours in the cable car. the cables failed at 2:30 in the afternoon. it was just before midnight when they finally got us out of the gondolas. that was quite an experience. >> christa: authorities say they have found what they believe to be items of interest at a site california. where they have been digging for a missing student. kristen smart has not been seen since 1996. after she attend a college party. authorities are not saying exactly what the items are. smart's parents are still hoping that they will have closure. >> i really would rather have her alive and full of energy. and be part of our family than not be here. but it adds some closure.

in the case strongly suggest that smart's remains may be buried in that area. and police in southern california under fire after a rough arrest was caught on camera. you can see them wrestling with the suspect. he is on the ground there. after he allegedly took some medical supplies from cvs. some people in the community are saying this is a case of excessive force. investigators also say the suspect try to grab an officer's gun. one of the officers suffered a broken hand during that altercation. >> sarah: you have heard the saying. find a penny, pick it up. all day long you will have good luck. not easy to do when there is millions of them. a track or the-trailer car rig unstamped pennies toppling over on a highway in wilmington, delaware. on thursday. 40,000 pounds of the copper coins ended up scattered on the road. crews spent 13 hours cleaning up that huge mess. >> christa: ahead on 7: if off
