now, last month, the police union and the mayor and the police commissioner agreed to a voluntary pilot program where police officers would wear body cameras. but the thing is no volunteers stepped up. so the commissioner made the program mandatory. and the police union sued, saying the city had to bar gain with them on this matter. now that they are making it mandatory. but the court decision came down today. again, denying the motion by the police union. saying that the commissioner... the statute grants the commissioner power. the test pilot program will go forward. the court did say that still can be arbitrated and bargained. but that the test pilot program should not be stopped

minutes ago, talking about this. one from the aclu of massachusetts. called this a great victory. for police accountability. and a victory for civil rights. we still haven't heard anything from the police union yet or from the police commissioner yet. we expect to hear from those folks later today. in the meantime, the police commissioner has said that the pilot program for the body camera... test pilot for body cameras will begin next monday. that is the latest live here outside suffolk superior court. i'm byron barnett, 7 news. >> christa: this new hampshire man under arrest, charged with a creepy crime. police say that he exposed himself to students near lexington high school. >> sarah: the suspect is a registered sex offender. police say he has done this before. we are live with the very latest. >> reporter: the big question is why. i have been in contact with the police department this morning. why would this man come to lexington from manchester, new hampshire. they are still looking into it. and they are talking about

departments where they believe this man may have visited. now,s if this is the concord district court. the man expected to face a judge for arraignment shortly here. he may not have to show his face according to the judge. this, after allegedly exposing himself to students at lexington high school the last couple of days. 30-year-old jacob mobley-hall has been charged with three counts of open and gross lewd and lascivious behavior. mobley-hall exposed himself near the high school on a the same thing happened wednesday. they are seening additional charges. that is 7 in all for the 7 victims. now, the state of new hampshire says mobley-hall was convicted of similar charges in the granite state. that was back in 2008 and 2009. reporting live in concord, i'm jonathan hall, 7 news. >> christa: all right, thank you. more breaking news right now.

a massachusetts prep school has now been arrested. they say stephen bliss agreed to pay for sex with an undercover detective. officials say that he agreed to meet the undercover officer at a mcdonald's in worcester tuesday. that is when he was arrested. that man was facing several charges, including human trafficking. >> sarah: state health officials are trying to figure out why close to 50 birds were found dead or sickened. victoria warren joins use >> reporter: yeah. there are some cats that were sickened. you can imagine the folks that live in this neighborhood. they are concerned about this. they want to know if there is something in the environment that is to blame or if someone is doing this on purpose. dozens of dead or sick birds in a quiet dorchester neighborhood. and several sick cats. >> it is alarming. >> the animal rescue league investigating, saying they found 47 birds either dead or

lethargic or thrashing and uncoordinated. at this point, they don't know why. >> i hope it's not environmental. and then on the other hand, if someone poisoned the birds,... >> reporter: hazardous materials crews and inspectional services, among several agencies working on. this called out to bakersfield street. they don't know yet if it's environmental. manmade. or a toxicity issue. some neighbors, though, are drawing their own conclusions. >> somebody introduced something into the environment. and... >> reporter: reverend cynthia pape says her pugs are all healthy. saying if it was environmental, she would expect to see house animals sick, too. she says until this misindustry solved, she is not reing her dogs out of her sight. >> they are spraying on the... they are staying on the leash

could take time. the birds will have to be sent off to determine a cause of death. no new sickened birds were discovered so far today. and some good news about some of the birds. some of the birds are showing signs of improvement. live from dorchester, victoria warren, 7 news. >> christa: now the forecast. as we get closer to the weekend. a live look outside. you know what? things are looking a lot better out there than they were earlier today. a little here is danielle gersh. >> danielle:, yeah, the sunshine finally decided to join the party. that is going help those temperatures warm up. it is already doing. that here is a look at the three-hour satellite and radar loop. we started off the morning gloom with those showers. now we are starting to see the sunshine poke out. look what that's done to those temperatures. upper 80's in boston, norwood, bedford. and along the cape, in the mid-80's. a warm day. those dew points still in the 70's. it is also a humid day. i do think these numbers will

but for right now, it is hot and humid out there. high temperatures this afternoon, going to be in the low 90's. so it is going to be a hot day. we are going to be close to record heat in boston. our record is actually 93 degrees. so, it lab close one. we set that one last year. high school football tonight. temperatures in the mid-80's. it will be a warm one. lots of water if you are heading out there. for the next two days, heading into saturday and sunday, we will lower the heat. watch for the chance for showers e then again on sunday morning. more on that coming up in your forecast. >> sarah: the patriots heading out west without tom brady who is currently serving a four-game suspension. >> reporter: good afternoon. well, tom brady out of sight. certainly, not out of mind for pats fans. he took to the radio last night to talk about a life in suspension.

as the patriots get ready to take on the cardinals in arizona sunday night, their quarterback tom brady will take on a new role as he begins to serve his four-week suspension. >>. >> i'm going to try to be positive about that. and spend some quality time with hi family and pick my kids up from school. and do some things that i want to have the opportunity to do in october, november, and december. and for the years to come. >> reporter: brady laid out his game plan during his weekly appearance on westwood one radio last night. >> a territory for me. i'm really just trying to focus on the things i can control. and trying to stay in great shape and be prepared for when i get the opportunity to play in october. >> reporter: until then, brady may spend time relaxing with new friends. he recently pooed pictures from his latest ugg campaign with a possible new friend, jeff bridges. one of the ads telling customers to do nothing with tom brady. it is clear brady will keep busy until october 3.

the supreme judicial court agreeing with the superior court's conclusion that sean ellis was unfairly tried. ellis was convicted of first-degree murder. he spent 22 years behind bars. he has been free on bail since 2015 after that superior court decision. also on 7: worcester police investigating a deadly shooting that happened outside of a bar. one victim has died. a second is in the hospital. this happened near gallagher's pub on west boylston street. officers have not said if any suspects have yet been identified three massachusetts state troopers have now been suspended without pay. they work at the department's armory. and they are off the job as the department investigates the transfer of weapons from the armory to an outside vendor. the state police say the vendor was state-approved. but the transfer itself is being investigated. the attorney general is assisting the state police with that investigation as well. city officials declaring a stage three water emergency in worcester. this means restrictions on any

water unless customers specifically ask for it. there is no washing cars or filling swimming pools. no watering lawns or plants except with the watering can and a first offense can land you a $200 fine. >> sarah: more news today: survivors of the tragic car crash at the sweet tomatoes in newton are reacting to word charges have been filed in the case. the 55-year-old bradford castler has been charged with two counts of motor vehicle homicide. restaurant in march, killing two people and injuring 7 others. now survivors are recalling the traumatic experience. >> missed me by about a foot. it was real close. broke my back. cracked the risk. some internal stuff. ptsz. it was tough. still going through all of that. >> sarah: sweet tomatoes remains closed since the deadly crash six months ago. the d.a.'s offers has not said

s.u.v. a developing story out of north korea. officials say they have conducted a successful nuclear test. this is their fifth atomic test and the second one in the last eight months. there are reports that this was also their largest test to date. hours after the test, there was a 5.3 magnitude earthquake near the test side. president obama responding that any provocative actions by north cry yeah would have consequences. >> christa: hillary clinton is in national security experts today. donald trump heading to a religious summit in washington. and all of this as those critical swing states are still up for grabs. donald trump taking his message to the conservative value voters summit in washington today. in ohio, his education speech pushing school choice largely focused on hillary clinton. >> she refused to take accountability for her failed policies in the middle east.

near 90. and if we do get to 92 in boston, it will be really close to that record we set last year. 93, the record for us today. and worcester, the record, 90 degrees. probably not going to get there. another thing that we will probably definitely do today, is add another 90-degree day to the year. we have seen 20 so far. probably going to bump that number up to 21. on average, we should only be seeing about 14 of those a year. dew points, earlier today feeling gross. by tonight, those dew points will drop down into the mid to upper 6's. not saying it is going to feel totally comfortable. going to feel sticky. not quite as bad as it is out there right now. we will watch a couplele of fronts over the next couplele of days heading into your weekend. the weekend looks dry for the most part. we have a chance to see some scattered showers throughout your saturday. and your sunday. overnight tonight, into tomorrow, we will watch this warm front. and this is going to bring us a chance for some showers overnight tonight into tomorrow morning. and then this cold front moves

left for dead. >> christa: well, thanks to a huge show of support, it looks like freeway is getting another chance. here is nancy chen with the story. >> reporter: christa, that one-year-old husky was badly injured. he will still need several surgeries in order to recover. but thanks to a good samaritan and generous on-line donations, freeway will now have the chance to get back on his feet. even with a broken leg and pelvis, freeway has plenty of energy. just a week ago, this one-year-old husky was hit along revere. >> you left them to die. >> reporter: a driver headed in the opposite direction pulled over and carried freeway to safety. >> stayed with him. gave him water. made sure until somebody could give them help. when i got there, he was pretty bloody. didn't walk, screening, howling in pain. >> reporter: the husky was rushed to a local animal hospital.

without life-saving surgery, freeway would have to be put down. as days went by and no owners stepped forward, they started a go fund me page. she asked for $6,000 and quickly reached the goal. the kennel has a strong message to the person who hit this young husky and didn't stop. >> you didn't hit a squirrel or, you know, a raccoon or... he is a big dog. you are not going to tell me... from his over your hood. shame on you, the person that hit him and didn't stop. >> nancy: the dog will be put up for adoption as soon as he recovers. nancy chen, 7 news. >> christa: still ahead, an ad for a mattress sale in texas under fire. why many are calling it

the most tasteless thing i have ever heard. in the video, you see two piles of mattresses. they planned to have the mattresses depicting the once standing towers in new york city. >> it is offensive to everybody. it should be offensive to americans. and as an american, making the video and especially living in san antonio, i don't know how you could perceive that as not being offensive. as funny. or a creative marketing. that is not what it is. >> reporter: now miracle mattresses will donate 30% of the sales this weekend to the 9-11 foundation. miracle mattress released a statement from its home office in houston apoll joy aing to all 9-11 victims and their families. a selfless act. a kentucky teen giving up his shoes to help a homeless man.

every time a new charter school opens in massachusetts, it takes funding away from regular public schools in that area. this year alone, charter schools will take more than that's not right. instead of draining even more money from neighborhood public schools and giving it to charters, let's devote public resources to all of our students... not just a select few. don't lift the cap on charter schools.

>> christa: breaking news this afternoon at 12:30. decision day for boston police regarding body cameras. a judge ruling this pilot program for officers to wear the cameras while on duty will continue. >> sarah: after the city and the police union spent the week arguing about this issue. byron barnett live now with more on the ruling. byron? >> reporter: yeah. well, this was a 19-page

boston police patrolman's union has been denied. and that means the body camera pilot program in boston will go forward. now, last month, the police union in boston, the may beyond the police commissioner all agreed to a voluntary pilot program for body cameras. but no one in the police department volunteered. the police commissioner made the program mandatory. the police union sued, saying e and by making it mandatory, it was a violation of the police union contract. however, this court's decision today says the commissioner has significant authority over matters such as deployment. in this case, there is no different than decisions regarding uniforms, weapons, duties, and assignments. a few minutes ago, we heard from a couple of advocates for body cameras on police in boston. they were obviously pleased with the court's decision.

with the judge's decision. we are cautiously optimistic. the program has not yet begun. until the pilot program begins, we are still heading our breath. >> this is a great moment for police accountability, police transparencey, and for civil rights in boston. >> reporter: and we just got a statement from the police union who indicated the president of the boston police patrolman's union, pat rose said they are disappointed in the ruling. but they will, in fact, work with to make sure that the pilot program does what it is supposed to do. now, the court ruling also said that this still could be bargained. this still could go to arbitration. but that the police union has no right to stop the test program. no word yet from the mayor or police commissioner. we expect to hear something from the politician commissioner later today. in the meantime, the pilot program, according to the commissioner, will go forward starting on monday. live here outside suffolk

some of them are showing signs of improvement. in dorchester, victoria warren, 7 news. >> sarah: now turning to your forecast. we get closer to the weekend. a live look at the zakim bunker hill bridge. it is definitely sunnier out there than it started out this morning. temperatures creeping back towards that 90-degree mark. the humidity on the rise as well. here is danielle. >> danielle: yeah. we started off the day muggy. overcast. now those temperatures close to 90. 87 in boston. 83 down along the cape. it is really that sunshine that you saw that has helped boost those temperatures. here is the radar loop. we started the day versus now. things looking pretty good out there. lots of sunshine. those dew points are still in the low 70's. it is very humid out there. i think these will drop a little bit heading into this afternoon. and evening. though it is not going to be totally comfortable. still sticky. not quite oppressive out there. this afternoon, high temperatures in the low 90's. so in boston, that 92 degrees will be really close to our

>> christa: the paum administration has listed ms-13 as an international crime organization. >> sarah: covering more news today: the every yea issuing a el to turn on or charge their samsung galaxy note 7 smart phones onboard a plane. officials are also asking people not to put the phones in any checked baggage. samsung recently recalled the phones because of the risk of the battery exploding. the company has stopped selling the phones for now. more than a hundred tourists are safe today after being rescued from gondolas dangling over the french alps. this all started yesterday

crews were able to rescue a majority of the riders last night. but more than 30 people were stuck overnight because of dangerous conditions. >> we were there almost ten hours in the cable car. the cables failed at 2:30 in the afternoon. it was just before midnight when they finally got us out of the gondolas. that was quite an experience. >> christa: authorities say they have found what they believe to be items of interest at a site california. where they have been digging for a missing student. kristen smart has not been seen since 1996. after she attend a college party. authorities are not saying exactly what the items are. smart's parents are still hoping that they will have closure. >> i really would rather have her alive and full of energy. and be part of our family than not be here. but it adds some closure.

in the case strongly suggest that smart's remains may be buried in that area. and police in southern california under fire after a rough arrest was caught on camera. you can see them wrestling with the suspect. he is on the ground there. after he allegedly took some medical supplies from cvs. some people in the community are saying this is a case of excessive force. investigators also say the suspect try to grab an officer's gun. one of the officers suffered a broken hand during that altercation. >> sarah: you have heard the saying. find a penny, pick it up. all day long you will have good luck. not easy to do when there is millions of them. a track or the-trailer car rig unstamped pennies toppling over on a highway in wilmington, delaware. on thursday. 40,000 pounds of the copper coins ended up scattered on the road. crews spent 13 hours cleaning up that huge mess. >> christa: ahead on 7: if off

it was this morning. right? >> christa: definitely cloudy back then. back then. makes it sound like we are talking about a decade ago. >> danielle: it's friday. it looks nice out there. it feels really humid. those dew points in the 70's. that is the oppressive category. and it's hot, too. temperatures in the upper 80's. then we will climb into the 9's very soon. and we will be close to records this afternoon. 93, the record for today. in boston. set that last year. 92 is where we are thinking we are going to get. in worcester, hot day as well. probably won't get the record, though. we have had 20 90-degree days this year so far. on average, we only see about 14. after today, we will bump that number up to 21. those dew points in the 70's. but i think by this afternoon, later this afternoon, and this evening, they will drop down into the mid-60's. it is not going to be comfortable.
