police say pete castillo escaped to the dominican republic after shooting veteran steven perez. >> anchor: dan houseley live in boston. >> reporter: more than four years later the prosecutor admits that many memories have faded. but cell phone video that led to the shooting will be shown in it captured the theater district street fight that led to veteran steven perez being shot in the back and killed. his friend describing perez's dying moments. >> was he saying anything? >> no, his eyes were rolling. that was it. >> reporter: peter castillo is now coming to trial on charges of murder. he fled to the dominican republic where investigators had

castillo, fired a gun into young stephen perez's back and killed him. and you're going to hear what set off the chain of events that cost mr. perez his life. you're going to hear how silly it was. how it didn't make sense. >> reporter: castillo's defense lawyer says perez was shot only after a vicious fight where perez gave more than he got. castillo's defense says will hinge on the matter of intent. >> it's not whodunit. that's not going to be your issue. your issue is going to be, i would suggest, why? >> reporter: the trial was expected to last about a week. tomorrow the judge is going to take the jurors out of the courthouse and to the scene of the crime in boston's theater district. we're live in boston.
