pond this afternoon where they heard that splash and then saw the vehicle go into the water. they knew they had to do something. screams filled the air at spy pond in arlington as suv dipped below the water. the man who swam to the drivers aid feared hope was miraculously her head appeared above the surface. another man also got into the pond. the 68-year-old woman did not know how to swim. she was very, very scared and had taken into water and she knew she was dying. she just figured this is it. dan frasier and his friend visiting from australia say they didn't think twice. she is just let me pull hire and she was floating on her

water and just like as hard as it was to pull her in it was wonder if will to see her floating. she was sinking a little bit and it was, i just took over from dan and pulled her into store. shore. the harrowing rescue happened after police say the woman mixed up the gas and break pedals on lynn wood road, drove through a fence and into the pond. police credit the good samaritans with saving the woman's life. opened up that car and helped the assist the woman out of the car and got her to shore. we credit them with helping save this woman's life. >> anchor: the woman was taken to the hospital with hypothermia. the good samaritan says he would have done it all over again. every life is precious and i think this is a time when a lot of people misunderstand the real worth and value of every life. >> anchor: and tonight that woman remains hospitalized.

it's 40 feet. it may be brought out tomorrow. live in newton, alex deprado, 7 news night team. >> anchor: new at 11:00 a convicted child rapist freed after nearly 30 years behind bars is arrested again. this week families in weymouth said they wanted richard gardner out of their neighborhood after he was released on parole. he moved to boston and now days later he is back behind bars. amaka ubaka spoke to the mother of one of his victims. amaka isve end. well, kim, richard gardner was arrested here at the shelter around 5:00 this evening for a violating his parole. i spoke to the mother of one of his victims and she says this has been an ongoing nightmare that's continued for the past 20 years. richard gardner is once again behind bars. the convicted child rapist arrested here at the shelter on south hampton street on a fugitive from justice warrant.

had a strong reaction after learning from 7 news that gardner who was convicted of kidnapping and molesting her 11-year-old son back in 1988 was finally off the streets. if he would come into a window in the middle of the night and kidnap a sleeping child at knife point, he is a danger to any child out there. the u.s. marshall's office in rhode island issued a warrant for gardner after they say he violated the term of his parole but exactly how he violated it is still under invest he was released earlier this month and went to stay with his parents in weymouth. that caused an uproar in the neighborhood. gardner was originally sentenced to 190 years for his crimes against children in the late 80's and early 90's. but received a shorter sentence on appeal only serving 27 years. i was very glad to hear that he has been apprehended and he is no longer on the street and a danger tore children. this week when gardner moved out of weymouth officials said he was in suffolk county

into this evening as they try to figure out why that 33-year-old suspect would open fire on officers. that we can come together and be the light in that darkness. >> reporter: with the to perring madonna statue looking on the community came together for a candlelight el to ray for two officers shot just steps below the shrine in a home in east boston. it's important for the community to come together and show our support and respect. police commissioner william evans and other top pass brass community rally around us on this one. dozens of neighbors came, some with more personal ties than others. it hits home for me. my bother was a police officer that was killed in the line of duty in 2005 in swansea mass and they were there for my ma'am leand myself and continue to be there until this day for us and so it's the least i can do for them. >> reporter: officers rick cintolo and matt morris remain hospitalized. both had additional surgeries

remain in critical condition but commissioner evans said she has spoke when both. they are in good spirits. i have to tell you they are very thankful to fellow officers because they give them the credit for their lives. >> reporter: the officers were shot by 33-year-old kirk figure rowia who was armed with an assault rifle and wearing a bulletproof vest. figueroa was killed by other responding officers. we don't know what sparked it and i think as they continue to investigate and talk to a am assuming extended family they wi investigators removed evidence including what red sox like at least one gun case. why he fired on officers wednesday night remains a mystery. police may be closer to finding that answer. we took evidence out of there that hopefully will try to put the puzzle together because i would hope that's not a rational mind that would do something like that. >> anchor: almost immediately after that police tape was removed and this road was reopened neighbors came down to the house, put some candles out

more news tonight. not guilty pleas today from two suspects accused in last woke's home invasion in the town of orange. plate knee smith and joshua hart are facing murder charges. prosecutors say the two suspects killed 95-year-old thomas hardy, then stabbed his 77-year-old wife joanna fisher while they were watching tv in their home. the pair arrested in virginia last weekend. >> anchor: a topsfield baby sitter pleaded guilty to kidnapping and torturing a two-year-old girl. abigail hannah admitted to taking the toddler from her hamilton home in the middle of the night, shaving her head and burning her with cigarettes. the girl was spotted on the side of the road of hannah was sentenced from five to seven years prison and ten years probation. >> anchor: patriots return to gillette this weekend and it will be a happen ihomecoming for tom brady. his first home game since returning from a four-game suspension. his teammates know the fans will

look at that hole. that's in the hole right above the casket of a military veteran. a man visiting a loved one says the ground just gave way. >> anchor: it happened without warning and his leg fell through with dirt up to his knee. brandon gunnoe live in lowell for us. brandon? >> anchor: adam and kim they filled the hole in. it's so deep into the cement we can't show it live to you right now but the man who fell into the hole said the grave is deteriorating and one veteran deserves better. this hole in the ground is a veteran's gave th of i felt like down on the ground i had to pick myself up. i was quite surprised it. took me a minute to think about what's going on. it happened in lowell tommy foster was visiting his 's grave when the ground gave way. the hole was bigger than a five gallon pail and you can see the top of the coffin was literally nonexistent at this point. it all rotted away and the remains were just in the bottom of the vault. the veteran resting here passed away in 1970.
