more broadly here i think there can be a disconnect with this. in the end we had eight people. why can't we just have eight justices on there and be good with that for a while. >> the reality is the vast majority of supreme court cases do not divide along ideological lines. the vast majority of cases end up with either a six / three, seven / two, eight / one majority or if they are a five for splits split, they often are unpredictable majorities and minorities. in other words, you may have a
9:35 am
minority voting with a liberal justice in the majority and vice versa but that said, there usually are about half a dozen major constitutional cases that come before the us supreme court every year that divide the court along five / four conservative liberal lines indeed we have a number of cases like the immigration case a public sex sex reunions case affirmative action that will very likely lead to a liberal conservative split this fault or i'm sorry this spring and into next fall so that would mean you would end up with a four / four ruling by the supreme court, which essentially means there is no holding by the court in the lower court's ruling would be the law of the land in the circuit when the geographical circuit where that us court of appeals sits. >> and both sides could get burned for however this goes forward. we have about a half minute left so when we hear these presidential candidates and one of the questions national media always asks us what you have a litmus test, do you think that's

potential nominee? >> we certainly want the senate to have an open mind about the nominees, but at the same time it is reasonable of the senators to expect the nominees to explain there their judicial philosophies, and it is reasonable of the senators to be concerned if you have a nominee who might be well outside the mainstream. i really think it a despair for the senators to probe into the substantive background of the nominees. i understand why we don't like to have that a litmus test but we really do need to find out what the nominees believe before we give them a lifetime appointment to the us supreme court. >> thank you. i appreciate the insight. when we come back,

9:39 am
that in itself is not that unusual. he does these types of things all the time and has been doing it for a long time and it's so called the full grassley when he travels to all 99 iowa counties every year but this one struck me as particularly unique. here is where he held the town hall in the marengo public library. the library was built back in 19 oh five. they got a $10,000 grant from andrew carnegie and the library's website says that way back then that town paper said marengo was the smallest town in the country to get one of these $10,000 grants. i thought then made an interesting and historic background because we found this on the front door letting everyone in town of this would be the place or grassley's town hall and that is where it all started to sink in. there we were standing in a building 111 years old listening to an 82 -year-old iowa senator and what was one of the first things he talked about this

chances are when you hear the word final, you think of that weirdly shaped little accessory we have in the kitchen don't door ajar for cooking maybe you think of the dirty one you have in the garage one when it's time to put oil in the garage but final has a whole different meaning if you work at of the iowa at the iowa state house. lawmakers have officially moved past their first final, their first self-imposed deadline where most of the bills have just survived to have a chance to become law later in the legislative session. let's bring in our next guest. he also, since he is here, has survived the final peer chas

democratic state senator from newton. what is it like? >> it's the deadline to give your bill does not come out of a committee, it is dead for the year so everybody that has bills out there. they're in for the lobbyists in and the bills at legislators have you want to get a full vetting of it in your subcommittee, go to the full committee you can relax once it comes out of the full committee, but until it gets there you don't know that it's going to go on until the end of session. >> but everyone of you both in the house the senate democrats republicans both you all think your ideas are the best. >> absolutely kick it so you're all just collision crash course and it's up to the chairs to put on the calendar right? >> ride. there's only so many things we can do or want to do and it needs to be a full vetting because what i think is great i may be missing some of the else's idea that it's not such a great idea. >> her first bill was what? >> my first bill was to take the license plate of the bumper of a dump truck and put on the tailgate so we would quit knocking them off when they dragged the trailer back out of the dumper dumped the ben.
9:44 am
it pretty much past 49 to one. one person decided not to vote on that. >> was there an education process? how did you find out about the need for this? >> it was brought to us by some associate general contractors. it was one of those things with where they break the plate light when they're in a construction site and they needed to move it up so they didn't have to worry about getting a fine for not having a license plate. pretty simple but it had to go through the process. >> and had another bill you were trying to get through here. it didn't survive final but it may not be dead and we will get to that but you understand this is something you learned about at home. >> it is drug endangered children. it is a process to get children out of a home where they're in danger right now. we want to get the family on a process for the kids can come back. >> are you talking drugs or what's that? >> yes methamphetamine and things like that. it is unintentional by the parents, but they've got an addiction and we don't want the
9:45 am
addiction would be unintentionally harmed. we want to get them on a path into and the parents in the right direction so they're making better decisions going forward. >> third dhs may kind of go check this out but you can go in there naked so to speak because you don't have law enforcement with you. >> the challenge right now, that is part of it and this track that i have it's kind of over extensive. you could also go into an apartment building in something may not be done in your apartment but at it's done over here and it's not clear enough to say these kids are fine, this is the apartment you're worried about, don't mess with this so we've got some whittling down to do. >> have you had incidents? word where does this come from? >> this came from the jasper county attorney's office attorney's office and some sheriffs deputies where they've had instances where they would've liked to have done the process of removing the children to get the parent some help but were not able to do it at that time. there is a process that may be going on over here and the deputies may not know about it.
9:46 am
groups that are part of this. >> was their controversy behind this? >> i don't think it's controversy. i think it's just trying to do the right thing. we do not want to inadvertently take children away from well-meaning families. that is not the purpose of this. this is to ensure that children who could be in danger can be removed out of that setting. >> as i mentioned, this specific bill did not make it through this final deadline. >> right. >> but as with anything, it is not dead until the session is don. >> right. >> so there are other vehicles to kind of maneuver your wake he way. >> the easiest way, this is in a certain section of code and someone else is working on a bill in that section of code, you can amend this bill to that section of code. so if we get this perfected and all the sides come to an agreement on this, we can go to the floor when this bill comes up and i can produce it as a

>> soap kind of stepping back on this in our earlier in the show we were talking about this whole supreme court nominee fight. everything is so political and i remember when your name first surfaced about running for state senate i was checking with people in jasper county and i know you know this, but they were people frankly who did not know which party you were. now that you're part of this you had out yourself so you out yourself as a democrat and are working at the statehouse state house so what is the atmosphere? we just finished a caucus contest here that is obviously very politically competitive and divisive. what is it like to be then in the legislature? was the atmosphere? >> i think it goes back to being mayor. >> you are mary newton. >> right. campaigning is one thing but we were sent up there to govern. i think if you govern and try to do the right thing you're going to get through this. i have not been very political in the past because i've always

recently that we think it adds if you're wondering why bernie sanders or donald trump has such a following, go to the grocery store and stop people and ask them what do you think about the government what you think about politicians and just stand back and listen. we found for examples that i think add to some of this distrust and unhappiness right now. let's do number one. iowa's lawbreaking legislators. if you speed, if you drink too much or maybe you popular smart aleck neighbor in the mouth, you are going to get in trouble, right? if iowa legislators break the law, they often don't. we have had six straight years that they have chosen to break their own law by not figuring out in-kind how much money schools are supposed to get. that screws over schools as they try to make their budget. legislators could just get rid of that law or change changes would or change it so it
9:52 am
punishment for the legislators who break the law. instead, they don't do anything and they just ignore this law. number two, the supreme court vacancy? republicans think that because barack obama won't be president next year, then he should not get to pick a replacement now for that justice who died on the job. so another words president should only get to use his presidential constitutional powers the first three years on the job but not for the final year on the job that voters elected him to do. number three, this presidential picking process. iowa democrats that up this obscure procedure where on caucus night some of the counties end up way more heavily than some of the other ones and candidates don't count if they are not viable in a particular precinct and in some cases you use coin tosses to break a tie.
9:53 am
reasons for all of this but those ideas do not make a lot of sense to some people. number four, these superdelegates, this is mostly on the democratic side but party vips like governors or members of congress, they can get designated as one of these superdelegates so in a place like new hampshire you had bernie sanders throttling hillary clinton on primary night. he got almost twice as many votes as she did, but because of the superdelegates when you have add them in, it means we could have essentially at high in delegate support from the night. in all four of these cases, the parties, the politicians, they all have their own reasons and for the way they do things the way they do but not everyone trusts their decisions, nor do they trusted their motives. next on inside his as quick

want so, let me get this straight -- u.s. cellular has the phone you're looking for, a network that's built to give you coverage way out here where the other guys don't, and 6 gigs for only $40 a month. that's a lot less than verizon and at&t. so, why on earth would you ever go with one of those other guys? switch to u.s. cellular now and get 6 gigs of data for $40 a month plus get $300 back.

time for insider quick pics. here are some must-see tv debates we think everyone would have to watch. our first matchup number one, bill clinton versus bernie sanders. the former president taking on the man trying to stop his wife from becoming president. that could be good. number two, bill stowe versus any school superintendent. you have the metro water czar who you know once more state money for water quality efforts and you have school administrators trying to hold onto whatever share of the money they can get. number three, marco rubio versus ted cruz. these two rivals one to be the future of the republican party. saban do this. let's have them also do this debate in spanish. number four, steve king versus nick ryan. iowa's republican congressman
