decision not to pursue charges against the officer in this case investigators say wauwatosa police officer joseph mensahs account of this june 23-rd shooting is backed up by what we see on this short video were freezing the video right before shots are fired, but police chief barry weber says mensahs use of force is justified. investigators say officer mensah was patrolling madison park after it had closed officer mensah approached jay anderson, who appeared to be sleep semi-automatic firearm on the passenger seat. after viewing the gun, the officer took out his firearm and ordered anderson to put his hands in the air. anderson, meanwhile, allegedly lowered his arm toward the gun at least three times. officer mensah then fired his gun, shooting anderson. " i have watched that video at least 20 times and i was able to watch it in slow in motion forwards backwards frame by frame, i could take as much time as i needed. the police officer had

wauwatosa police chief barry weber says officer mensah underwent counseling and has been cleared to return to duty. as for anderson-- an autopsy shows he was intoxicated and also revealed marijuana in his system. live in tosa dc fox6 news the family of jay anderson junior extremely disappointed in the district attorneys decision not to charge officer they say they'll continue to fight... "i feel sick to my stomach knowing he will be back on the force but my daughter will never get to see her dad again. it's not right." attorney jon safran says he is pushing for federal criminal civil charges against officer mensah. he has already contacted the us attorney's office to investigate. you can watch the entire dash camera video of the anderson

com and the fox6 news mobile app. we've also posted the news conferences. just find this story on our home page. marquette police investigating an armed robbery near campus last night. we're told a suspect entered a business on wells and implied he had a weapon and demanded money from the register. the suspect then took off. the employee was not injured...and milwaukee police are also investigating. dodge county officials are investigating a possible homicide in fox lake they're calling it a suspicious the latest. we're told that deputies are looking for a dark blue 2016 dodge ram pick up truck in connection with the case. neighbors believe a man may have shot and killed his girlfriend and then took off. police and deputies were called to the scene sunday night. a neighbor tells fox6 he thinks he heard the gunfire. i heard a pop and that was about five minutes, ten minutes before i left but i didn't think anything of it because of the hunting season around here. police say they are not releasing any further information on the case right

ongoing investigation. if you have any information -- you're asked to give them a call. a hearing on wisconsin's transportation budget is taking place today. and state republicans -- are fighting amongst each other over how much to spend. governor scott walker wants to slash spending on major projects. two g-o-p senators released a memo from the nonpartisan legislative fiscal bureau that shows, if wisconsin does every road project on its "wish list," the gas tax could go up by 28 cents per gallon. called that "fear mongering" because no one is proposing such a big tax hike. vos thinks the state needs to spend more on its roads. today's hearing takes place in madison at 10 a.m. governor scott walker posted on twitter that he will not support increases to the gas tax or vehicle registration fees without corresponding decreases in other state taxes. meanwhile - the governor also announced on twitter that he is overseas visiting u.s. troops. he's part of a delegation of governors invited by the

connection with a deadly warehouse fire in california. and a judge declares a mistrial in the case against the former south carolina police officer who shot and killed walter scott nicole is in the newsroom with the latest. charleston officials are asking for calm in response to the mistrial decision. the jurors deliberated more than 22 hours over four days before announcing they could not reach former officer michael slager was charged with shooting walter scott five times...as he fled from a traffic stop in april of last year. prosecutors say they'll try him again. slager also faces trial next year in federal court on charges of depriving scott of his civil rights. and in oakland, california -- 36 people now confirmed dead after a warehouse fire over the weekend. we've also learned that murder charges could be filed in connection to the fire. authorities believe
