good morning, everyone. we begin with the federal budget battle taking center stage right now on the senate floor. >> just days away from the rollout of obama care, one conservative senator launched his all-night talk-a-thon in protest. tahman bradley from washington has more. >> reporter: as republicans move to defund obama care, president obama is fighting back. even bringing in help from the man he calls his secretary of explaining stuff. president obama brought in a big gun to sell obama care. >> when you have universal enrollment, you can manage your costs better and cut inflation down. >> reporter: former president bill clinton made the pitch with just a week left before one of the health care law's biggest changes goes into effect. on october 1st, millions of americans will be able to shop for coverage through insurance exchanges. the uninsured must sign on or face a penalty. the opponents of obama care are

worried that health care costs will skyrocket. overnight, the obama administration released new numbers on what the law will cost consumers. they say six in ten americans may be able to find coverage more less than $100 a month. and premiums nationwide, will be about 16% lower than originally expected. >> the most important thing, obviously, just to get people enrolled in this. >> reporter: many of the health care law's elements are already in effect. children can remain on their parents' insurance until they're 26. and those with pre-existing conditions are guaranteed coverage. but republicans aren't sold. on the senate floor, a marathon speech by ted cruz, in defunding obama care. >> i'm going to venture to say most members of the united states senate are at home in bed asleep. while america lives the nightmare. >> reporter: senator cruz and others are threatening to shut

down the government in order to defund obama care. but the administration indicates those health exchanges will start next week no matter what. john and diana? >> tahman bradley, live in washington for us. thank you. senator cruz talked about a lot of things to pass the time, other than obama care. >> that's right. he was quoting the hit reality show "duck dynasty" at one point. and he read his children a bedtime story, "green eggs and ham." one of his staff members took a picture of this of them back home in texas. a moderate tone being set by the new leader of iran. hassan rouhani here in new york for the u.n. general assembly. but they did not meet face-to-face. rouhani explained why last night on cnn. >> translator: iran could have allowed it to happen. but i believe we didn't have sufficient time to really coordinate the meeting. >> rouhani tells cnn he accepts

the holocaust. calling it a great crime against the jews by the nazis. a major change by iran's previous president that refused to acknowledge that the holocaust happened. firefighters are battling a major fire at a warehouse. witnesses say they heard several explosions from inside the building. a fire official says the warehouse is an old tomato packing plant that's been around since the 1950s. the fire apparently started in a storage out building used to house old equipment. new this morning, a first of its kind investigation linked to the deadly crash of the asiana airlines flight at san francisco airport. federal officials looking to see if the airline met its legal obligations following the crash. among the obligations is providing a range of services to family members of those who were onboard, including a toll-free information line and transportation for loved ones. kenya has begun to mark three days of mourning following

a terror attack at a nairobi mall. kenya's president say 11 attackers are in custody. and security officials say some attackers might still be inside. it was an emotional homecoming for one north carolina woman who survived the attack. with sobs so heavy, she could hardly speak. she collapsed into the arms of loved ones. she said she didn't think she would see again. even though she is safe, she struggled to describe the awful moments inside that nairobi mall. >> i was eating on the terrace. and you just heard an explosion. it started calling out. it was just -- >> she hid out for four hours before finally being rescued by security forces. now, she says she's just happy to be back home. a developing story from pakistan. a rising death toll after a powerful earthquake. the magnitude 7.7 quake struck

yesterday afternoon. it created a new island a off of pakistan's southwest coast. it forced the evacuation of office buildings in pakistan's largest city. the death toll now over 200 people. it is expected to climb. nearly 400 people were injured. a report from one hard-hit area, said 90% of the houses there were destroyed. police in oklahoma say they've recaptured the last two of eight inmates who escaped a transport van that stopped at a hospital. six of the inmates were found shortly after the escape. the van and the shotgun left inside were recovered. police say the inmates were left in locked compartments in that van. but they kicked out a partition and were able to get to the front of the van that apparently had been left running. a couple of forest fires outside of los angeles that have forced people out of their homes. the first one erupted near a busy freeway at cajon pass. lighter winds, cooler temperatures that's helping fire crews battle a 250-acre forest

fire in the san gabriel mountains. it's about 70% contained. and crews have a couple miles of fire lines to dig before they believe that blaze will be surrounded. showers and thunderstorms will stretch from the ohio valley to georgia and the carolinas. central florida will see another day of downpours. and in the central elevations of montana and wyoming, snow accumulations. maybe one to two feet possible. >> highs in the northeast will range from 50s into the 70s. farther south and west, in the 80s and 90s. hot spots will be new orleans, dallas and phoenix. amazon releases two new kindles. the ceo tells abc what's different about the tablets. real-life rampage. a college student under arrest, for re-creating a controversial and popular video game. and mystery solved when two women vanished 40 years ago, no one knew what happened. but a recent discovery may have just solved the cold case.

screen. that starts at $139. on wall street, the stock market's losing streak hit four days in a row. yesterday's losses were light. the dow closing down 66 points. the s&p 500 shedding 4 points. and the nasdaq finishing in positive territory. investors are worried about the looming debt ceiling deadline. it's the season for retailers to stock holiday staffer levels. target hiring 70,000 workers. jcpenney on par with 2011. walmart and kohl's hiring slightly more than last year. if you purchased something online and regret it. a law in california gives young people a chance for a do-over. it allows anyone under the age of 18 to remove online content they have posted. it protects teens from being haunted by impulsive decisions. the law doesn't cover images and information that are posted about a teen by other people. when we come back, caffeine

governor jerry brown yesterday. when it takes effect, the paparazzi could face a year in jail and a fine up to $10,000. pope benedict speaking out for the first time since he stepped down as the leader of the catholic church. he released a letter in which he denied covering up for sexually abusive priests. benedict became the first pope to retire in 600 years of church history. u.s. army recruits are facing new restrictions on their tattoos. under the regulations, soldiers will not be allowed to have tattoos that show below the elbows and knees or above the neckline. soldiers who currently have tattoos in those banned areas will be allowed to keep them. that old wisdom that coffee stunts a kids' growth, may be true after all. researchers in switzerland say caffeine may be slowing the development of adolescent brains. three cups of coffee showed to be enough for brain slowdown in

checking our top stories now. republican senator ted cruz has launched his own protest of obama care. he's spending more than 12 hours talking about everything, from the revolutionary war to "green eggs and ham." crews are battling a major fire at an old warehouse near san diego. they heard explosions coming from inside. it's the first of three day of mourning in kenya, where the death toll from the terror attack stands at 72. investigators say more bodies are likely trapped in that collapsed mall. heavy rain in the southeast. milder temperatures in the midwest. two feet of snow for the higher elevations in the west. going to be sunny and pleasant here in the northeast. and finally this morning, the horse that's making money in a rather unusual way. >> he's not winning races or helping make other racehorses. oh, no. he's got a brush in his mouth. and he's painting. we get the story from greta cruz
