good evening. as patriots prepare to square off against the seahawks in the super bowl one of their former teammates will not be in the field but in a prison cell. aaron hernandez is on trial for murder. police think he plotted the execution-style killing and say they have the evidence to prove it. here's the latest in our series "crime and punishment." >> reporter: it's a tale of two paths. one to glory, the other of greatness wasted. the new england patriots basking in the glow of sunday's super bowl versus the seattle seahawks in arizona, a game where legends are born and fortunes won. then the fate of former patriots star aaron hernandez. facing not fame but a jury in a massachusetts courtroom. >> you orchestrated participated in the killing, covered up the killing -- >> reporter: prosecutors say hernandez, pro bowl tight end who'd recently signed a $40

million contract threw it all away when he and two friends picked up an acquaintance a journeyman semi pro football player, at his home in boston in june 2013 drove lloyd to an industrial park, and participated in his murder. when prosecutors showed jurors pictures of the victim's body found a half mile from hernandez's home the mother rushed from the courtroom in tears.defense's argument their client is a victim. >> the police and the prosecutors targeted aaron from the very beginning. as soon as they found out that aaron hernandez was a friend of oudin lloyd's, aaron never had a chance. >> reporter: all part of a celebrity defense of sorts. the defense arguing, why would a young man with wealth and fame throw it all away? >> aaron hernandez was planning a future not a murder. >> reporter: the time timing of the trial could not be worse for the nfl. >> it has been a tough year. it's been a tough year on me

personally. >> reporter: its biggest game of the year on sunday after an unprecedented season of scandal and scrutiny. including the most recent deflate deflategate allegation. >> i didn't believe tom brady. the balls were deflated. >> reporter: which call into question the legacy of one of the greatest coaching quarterback tandems in nfl history. >> would not say that i'm mona lisa fido of the football world. >> is tom brady a cheater? >> i don't believe so. >> reporter: now this trial will surely grip the nation. the former tight end who pleaded not guilty was 23 at the time of the murder. a rising star on the biggest stage. >> and the tuls -- >> reporter: even scoring a touchdown in super bowl xlvi. >> touchdown! hernandez! >> reporter: prosecutors play a different picture. playing this surveillance video they say shows odin lloyd getting into a car driven by hernandez shortly before his

killing. this image of hernandez standing outside his basement holding in his left hand what the prosecution says is a gun. what the case won't include, text message records from oudin lloyd the night of the murder deemed ined a vible in court. >> there's a great deal of information the jurors won't see, won't hear. the texts. did you see who i'm with? his sister answers, who? lloyd answers, nfl, just so you know. what's the significance of that? "just so you know." prosecutors wanted to introduce that to say, he was warning his sister. i'm with the nfl guy, just in case anything happens. that would have been incredibly powerful evidence for the jury to see. and prejudicial. the judge ruled that it was too speculative to say that's why he was writing the text. >> this is not a slam dunk? >> i think most people watching this case think prosecutors can get a conviction here. but it may not be that easy. >> reporter: in court, hernandez

sits well groomed, well dressed, his demeanor gives no indication of the trouble he faces or the trouble in his past. espn's jeremy schaap said there were concerns over hernandez before he was drafted by the patriots. >> aaron hernandez became a fourth round rather than second or third round draft pick in 2010 because the league had looked into his background. and some people determined that they didn't like what they had seen. >> reporter: aaron hernandez was raised in a tough neighborhood in bristol, connecticut. and he had his share of heartache. >> his father died when he was 16. and that was very, very tough for him at the age that it happened. had a little bit of a tough upbringing. both because of that and even before that. >> reporter: aaron hernandez had one gift that made everything better. >> football was something that he really loved. i think it gave him a little bit of a reprieve from maybe some of the other everyday challenges of life when he was around football, he could forget. >> reporter: even in high school it was clear he had an unusual

talent and he started getting calls from colleges. eventually getting recruited by the university of florida. a bright future stretched before him, if he could only keep his demons at bay. >> he himself said that he had a history of getting into trouble. >> reporter: before he played a single game his career was almost sidelined forever. >> there are reports that airplane hernandez had an altercation at a bar called the swamp. >> reporter: a police report from the 2007 incident surfaced recently. hernandez had gotten into a fight with the bar manager over two drinks hernandez maintained he hadn't ordered. and guess who tried to comeo his aid? according to the police report college teammate tim tebow offered to pay for the drinks. instead, a authorities, hernandez punched the manager so hard his eardrum burst. >> he could have been kicked off the team and he wasn't. >> reporter: hernandez was never charged with the assault and his career quickly took off. by the time he reached the nfl even he insisted he got it he'd matured.

>> you get changed by the patriot way. now that i'm a patriot, i start living like one and making the right decisions for them. >> reporter: in a league where winning is everything, nfl teams have been known to take chances on players with unquestionable talent and countless questions of character. >> bill belichick, somebody who's always looking for a way to win. and i'm not saying that character isn't a factor in their decision-making. they've shown eagerness or at least willingness over the last years to take chances on guys who'd had serious run-ins or more minor run-ins but certainly not the first thing that gets considered when someone's signed. not only by the new england patriots but by just about anybody. >> reporter: for his part bill belichick vowed to vet his players more closely in the future. after hernandez's arrest. >> we learn from this terrible experience that we'll become a better team from the lessons that we've learned. >> reporter: tonight not only is his character in question so too is his freedom. which he could lose for the rest

of his life. >> under the law, in massachusetts, if you are part of a group of people who together are committing a murder all of you are equally guilty of the crime. >> reporter: if we needed a reminder how poorly timed this case is the judge issued to the jury today giving them permission to watch the super bowl, but warning -- >> if his name or this case is mentioned on television screens or computers if you're watching it on computer or anything, just walk away. it's vitally important. >> reporter: this sunday while some of his former teammates play for glory, the jury may be able to watch the game but hernandez won't. he'll be in solitary confinement inside a seven foot by ten foot prison cell. >> i think this trial, people think about and they say, what a waste. this guy had everything. why would he throw it all away?

sued by her former nanny, her family's supposed dirty laundry being aired in court. here's my "nightline" coanchor juju chang. >> reporter: mariah carey's voice launched her status at a musical diva. with hits like "you'll always be my baby." but now the woman who's been taking care of her babies is accusing the star of being a diva at home. hernanny of four months filing a lawsuit against letter and her husband nick cannon just weeks after the couple filed for divorce accusing the couple of fourthing ingforcing her to work 100 hours a week and failing to pay overtime. her duties were feeding, babying, and comforting the couple's 3-year-old twins. she also claims she was fired after mariah got mad at her for being too affectionate. a tendency she alluded to in an interview. >> unfortunately i have to have nannies but i'm hands-on. i fired nannies like this but i

hate doing it but i have to. if they try to make themselves in the baby's mind than me. >> reporter: for carey, these are her miracle babies. after suffering miscarriage these babies were born thanks to fertility treatments. >> it's just love. it's a beautiful place to be. >> reporter: for working moms that love can often be tinged with jealousy when they feel the nanny is getting too close to their babies. >> the reality is your child should be able to love and receive love from all kinds of people. they don't lose by having more people loving them. >> reporter: but that wasn't the only issue. the nanny claims she was not compensated for jetsetting around the globe with the singer, toting her kids. no glamor more like real life nanny diaries. >> i need you to xerox recommendation letters. also introduce french food into his diet it might enhance the study of the language. >> celebrities are used to getting told yes all the time.

they're used to people going along with what they want. and it may work a little differently with a nanny. >> reporter: in the lawsuit, simonette decosta claims she was on call 24 hours a day with no entitlement for breaks meals, even sleep. and carey would call in the middle of the night. >> in general you need to get five hours of uninterrupted sleep, we need to be paid hourly. >> reporter: anita rogers runs an exclusive agency british american household staffing. >> if it's a job 100 hours a week, it needs to be 44 hours at a specific hourly and that hourly cannot be under minimum wage. that's the law. then it needs to be time and a half. >> reporter: being a celebrity nanny often involves demanding work. even if you're living the high life. carey's nanny was paid over $6,000 a month, roughly $80,000 a year. a representative for mariah carey told abc news they don't comment on frivolous lawsuits. this isn't the first time a nanny has caused a stir in

high-powered circles. rupert murdoch's nanny sued the billionaire and his now ex-wife, calling their home a war zone. a judge dismissed the case against them. >> before you start, like anything, with any job, but especially domestic staffing you have a watertight contract. >> reporter: anita rogers says discretion is the key when hiring nannies for the rich and famous. >> you don't want your nanny telling the nanny in the park your dirty secrets. it's terrible. >> or even your clean secrets. >> none of them. >> reporter: she says a well-trained nanny should know what she's in for. >> a professional nanny knows all cleaning related to the children, packing related to the children, is their job. a babysitter goes home. a nanny has to do everything. cooking, cleaning organizing ironing. >> reporter: that said, being a nanny to the stars is no easy job. from angelina to gwen stefani, high-profile moms lead

unpredictable lives and can be demanding bosses. >> the best thing we advise at british american household staffing is hire two or three nannies. because a work/life balance is the wisest thing to give your employees. >> reporter: along with demands come the perks. which is why some potential nannies to the stars are willing to pay top dollar to attend this nanny school. >> we are not training babysitters. we are training fantastic, certified, professional nannies. >> reporter: at the english nanny and governess school in chagrin falls, iowa nannies learn cpr, cooking, even handling horses. >> if a nanny's not comfortable around a horse the children will pick up on it the horse will pick up on it. >> reporter: the tuition, $10,000. once hired they can make that back almost immediately. and much much more. so how much can celebrity nannies make? >> i have people making exorbitant salaries. $250,000. >> there's been stories where the family actually pays for the

my "nightline" coanchor dan harris is a man who knows a lot about plenty of things. but proudly admits football isn't one of them. so for those who only watch the super bo f for the extracurriculars we asked our in-house expert to investigate what else there is to see and do while the game is on. >> reporter: given how much time i spend instagraming pictures of my cats and my new baby you might suspect i'm not a big football fan. a fact my colleagues on "good morning america" confirmed this morning. >> is that the sport you played? >> reporter: no matter how big a fan you are, there are many big questions swirling around sunday's game that nobody can answer. for example, will richard sherman, who i'm told plays a for the seattle seahawks, make it to the big game? his girlfriend is due any minute now. >> i think he's going to be a
