fewer people are using public transit across the d.c. region. the american public transportation resource says 18 agency set records last year but d.c. was not one of them. it had one exception in arlington's art buses which saw a 1.2% increase in passengers. crime is a family affair, a father and son arrested and accused of taking advantage of homeowners. police say paul frank and his son posed at tabor's and overcharged and did not finish the job. right now officers are looking for frank who is wanted in connection with those crimes. >> they are not filled in like they said they would be.

tom: the guys who came to her door last month said they would make the driveway look nice. they didn't. >> i felt ripped off. tom: they say that the frank family was running a scam. >> they didn't have the right product and it wasn't done appropriately so i basically through $280 out the window. >> she is not the only one. say that paul, ace and spanky claimed they were using sealant but were actually using black paint mixed with gasoline. police say they scammed folks out of $6,000 and tried to get them to pay more. >> it is disheartening. you hope you are helping out somebody, a father and son. >> police say although they are staying in laurel, ace is from wisconsin. maggie says she hired guys in the past with no problem that

oven but a lot worse. richard: it was worse, inside the bmw was brian o'donnell who police say was intoxicated. >> that guy was lucky. richard: lucky because when the car hit the tree, he was patrolling around the corner. as the officer approached the scene he saw the front of the car fully inflamed and as he got closer it got hotter and hotter and look at the damage to the history. richard: o'donnell apparently didn't move but the officer jumped into action. richard: -- >> i-8 got his head and pulled into a safe distance. richard: which is when he smelled alcohol. >> i can see from the burning that took place if he did get out he would be a goner. richard: he says he is not a hero. >> i was in the right place at

kimberly: a consumer alert tonight. kia is recalling more than 200,000 of its suv's. it covers both gas and electric the echoes from the 2014-2015 model years. the recall will start march 24. the montgomery county board of appeals rejected plans for a 16 pump gas station at the cosco. neighbors concerned with noise and pollution fought the project for five years. one or number said his decision was easy learning his -- learning there were 25 gas stations nearby. this week, a bipartisan group of senators traduced legislation to end federal restrictions on

kimberly: it is kind of a disappointment when st. patrick's day weather is so great. eileen: but that hasn't stopped a lot of people from getting out to celebrate. and if your celebratory plans take you to the day sunday the weather will be nicer. let's get a look at one of our cameras, it is 11:51 and it is sick -- 56 degrees. as the cold front slides through it will drop temperatures but not all that much. we are already on the brighter

side of things with our live super doppler sweeping in motion and nothing in radar. after a lot of rain today between a half-inch to an inch we picked up an inch in garrett county where the temperature is 42, 54 in silver springs. 67 -- .67 inches of rain in a boys maryland. the soccer fields will be squishy tomorrow. at this hour we do have some fog i'm still noticing. some improvement there although it looks like culpeper has dropped to 3/10 of a mile. any bump that is out there now will be improving significantly within the next hour or two as the wind is starting to pick up and that is drawing in the dry air and that will be greeting us tomorrow.

48 in hagerstown, 58 in gaither. overnight, after the front slides through temperatures will fall into the 40's but you can see the area of low-pressure spinning over the northeast and here is that cold front sliding in and that will deliver us with quieter weather conditions tomorrow. you may hear the wind out of the northwest, breezy and cool tomorrow with highs in the lower 50's so average for this time of year but maybe a little bit on the cool side for some but at least the wind will help dry us out. monday it looks really nice 60 degrees and early-morning showers are not out of the question otherwise by wednesday it will be a bit cooler with highs in the upper 40's and 50 degrees for thursday and friday i chance of rain showers.

from smoking in their own home by a judge are appealing that decision. investigator joce sterman dug in and found a surprising new reaction. joce: for edwin gray, a story spread like the smoke is neighbors claim this's -- seeping into the house. >> everybody is shocked. >> surprised that a d.c. judge granted a temporary order banning them from smoking inside their home. his neighbors say it is causing them harm. >> everybody in washington, d.c. should be concerned. joce: while many support great is surprising number agree with the judge. >> i think it is perfectly reasonable what is happening in the courts, what is not reasonable to say -- there is nowhere to go except your home.

>> district leaders need to allow alternatives because of nuisance issues, landlords are public housing restrictions, he is fighting for the right to let private establishments permit smoking if they choose for people over 21. >> there is a good reason not to allow it in public but no reason to prevent it on private property. let's take a deep breath and get real. if it is going to be legal it has to be legal. kimberly: we contacted the mayor and chairman mendelson's office to ask about the potential to ever allow places like ours so people with kids or restrictions have a place to go and we have not got a response. meanwhile, we are told there are plans for a citywide smoke in to raise awareness next month.
