she went to a birthday party in southwest d.c. and slipped away to a nearby abandoned row house for a romantic interlude with a friend. three men burst in on them and they robbed the friend and told him to leave. they dragged 26-year-old smith upstairs where d.n.a. evidence indicates two men raped her and someone shot her repeatedly and set her on fire. >> her assaillant has been brought to justice. >> it brought relief but it reopened wounds from the loss of her daughter. >> she was beat and raped and shot multiple times. then set on fire. the images still appear in my head. >> tonight, hill is behind bars charged with murder. d.n.a. evidence linked him to the rape. the other suspect was shot and killed before he could be arrested. while she is pleased with the arrest, smith does not look forward to hill's trial.

and the rehashing of the details of her daughter's murder. but she says she does pray for a conviction. >> nothing would bring her back, but totally getting justice. for what has happened to latroya will make our family have some sense of peace. stephen: hill went by the name rico and suave is behind bars tonight. he will remain there at least until his preliminary hearing september 30. reporting live, stephen tschida, abc7 news. jonathan: thanks. the man chargedded with stabbing an miles per hour university student to death on board a metro will undergo a full competency evaluation because that is the order of a d.c. judge in the case against jasper spires. police say that spires stabbed kevin sutherland to death on the afternoon of the fourth of july and he was high on the synthetic drugs at the time and due back in court october ninth. kimberly: abc7 is getting more information on the melt row

train derailment earlier this month that caused commuter chaos for much of the area. we already knew that metro became aware of the track problem weeks earlier but didn't do anything about it. brianne carter is live at the smithsonian metro stop with what else she has learned from the report. brianne? brianne: you mentioned why this happened and talk about metro learning about it prior to the derailment. now we know what metro is citing as to what led up to all of that. that non-passenger train derailment that happened between this station here, smithsonian station and the federal triangle. new details into what led up to it all. these pictures show the damaged track and equipment after the august 6 derailment that according to a report released today was caused by human and equipment failure. >> someone needs to be accountable for sure. brianne: the report released said it happened when the rail fasteners failed to hold the train in place, causing the

train to spread and wheel axle to drop. operating the vehicle designed to inspect the track, detected a level black defect. level black means the issue requires immediate attention. according to the report, the operator deleted the problem so it was not addressed. the operator and a supervisor has since resigned. >> people mick mistakes. >> figure out the checks and the balances. they need to overview the whole system from soup to nuts and make sure it doesn't happen again because it's problematic. brianne: metro says it is still looking into how the problem continued to go undetected despite track walkers inspecting that area of the track on multiple occasions. >> i am concerned. that is why i've chosen to be drive in or mix it up. brianne: we understand all of this is still under investigation.

storm. rick scott declared a state of emergency and doing it ahead of a possible monday landfall. kimberly: a lot can change with a tropical storm or a hurricane between now and monday. so for the latest report on the storm and the tracks let's get to the meteorologist steve rudin. steve, if you plan to go to florida next week, would you change the plans? steve: i would deter that plan. and maybe do it later next week. we have a little bit of good news here with the latest forecast that just came down about five minutes ago from the hurricane center. 5:00 update has the winds at 50 miles per hour. wind gusts at 63. it is picking up speed moving to the west at 18 miles per hour. let me show you the track of the storm. latest track continues to shift a little further off toward the west. that is good news. notice how it will affect most of florida. maybe not as a hurricane or a tropical storm. just as an area of low pressure that is likely to drop areas of heavy rain along bringing gusty winds. it could impact part of our

child. this happened not far from an elementary school. maryland bureau chief brad bell is joining us live with the progress on the manhunt. do they have any leads on this, brad? brad: they don't. they are looking for the suspect. you see the black here? this is the fingerprint dust on there. the crime scene investigators just left here an hour ago. and as for the suspects, they took off running this way and that is the last anyone saw of them. with three violent suspects on the run, police bring in a bloodhound to track the getaway route. the officer with the assault weapon goes with the dog and the handler just in case. before long, the dog loses the scent. >> we only know three hispanic males leaving on foot with the faces covered. brad: the trio stabbed a man

and woman in their own home in front of a very young witness. >> i hear crying. somebody was crying. brad: that was 8:20. a neighbor who doesn't want her face shown tells us for some reason the victims went outside to the parking lot. when they went back to the ground floor apartment they walked into an ambush. >> as soon as they entered the apartment, i heard the scream. blood everywhere. i called the police. >> the man is critically injured and the woman suffered non-life threatening injuries. according to the witnesses and the police sources an 8-year-old girl saw the whole attack. >> sad that the little girl has to see it happen. >> a shock. never been close to this. certainly be keeping a closer out on it and who is around.

brad: for what happened in here police tell us they do not believe it was a random crime. they believe the suspect likely knew the victim. we are told it's a possibility it's gang related. brad bell, abc7 news. kimberly: two days after the deadly attack on two journalists in roanoke, virginia, there is visible signs of the scene that the horrific shooting are now gone. new wooden planks have been installed on the bridge water plaza deck. businesses in the area reopened today. we are hearing from the husband of the sole survivor of that attack. vicki gardner. her husband spoke to abc news. tim garder says he was watching on tv as his wife was shot in the back. tim: the surgeon said a few more centimeters she wouldn't be alive or walking. he shot three times. he missed twice.

she doe to the ground. kimberly: -- doe -- dove to the ground. kimberly: garder said he tried to keep shooting her but the gun didn't work and he took off. jonathan: at this hour, the d.c. police are out on the street in full force part of an all hands on deck push to fight back against a surge in violent crime. part of the proposal to make the streets safer that is meeting a lot of resistance. d.c. bureau chief sam ford is joining us with why the plan to fight back is getting the pushback. nobody would have thought they would get this pushback? sam: it depends on the details. as they say. the devil is in the details. they used to have these all the time. this is the first this year. another tool in the city's effort to fight growing homicides including as you were mentioning a plan the mayor unveiled yesterday that has drawn some opposition. after what some call summer of

crime, bowser's plan to stop rising murders in the city, 103 at last count, met with the boos and cat calls yesterday. the $15 million 13-point safe plan gives more funds for security cameras and would allow police to search home of parolees convicted of violent crimes. >> we should do all we can to make sure they have no access to a gun. sam: searching of homes of people not charged with anything new set off a number of people. >> what is the criteria in place to make sure someone who is letting a friend over family member will have the ability to have their home searched as the home of a felon? >> there are a guns in the city. the guns are in a lot of people's home. sam: anticrime activist martin molten supports the plan. >> it's thoughtful and she has been listening to people in the community across the city. >> i will not be shot down

hour they provided me a copy of a court order from the past april. judge allowed for continued release. the first visit in july went without incident. but yesterday on the 4000 block of warner avenue in hyattsville fled from the department of health employee following him. how the residents are feeling very nervous. >> i heard and i made sure the doors were locked up. >> the residents are frighted and frustrated and they want to know how a convicted sex offender in the care of the state department of health could go missing in the neighborhood. >> how did he just escape like that? >> no guards with him? >> the maryland state correctional officers are looking for norris. they used a bloodhound along the b.w. parkway with a retake warrant issued for the

capture. >> that is crazy. that is alarming. we have kids in the neighborhood. it's dangerous. mike: at the elementary school they were aware of the manhunt and they held a lockdown drill with the students and the staff in morning but because they received no instruction by the police to do otherwise, the children were allowed outside for recess. no matter the age, the residents want norris back in custody and they want an explanation. >> this is scary, too. especially when you have kids. >> take a look at the screen. norris is 5'7". 170 pounds. last seen wearing a black track jacket with white stripes down the sleeves. blue jean and new balanced sneakers. he has a lengthy and a violent criminal history including decades of battery, rape and assault going back decades. if you see him, police urge you to call 911.

update. 5:00 update on the tropical storm erika. this is where she is located now. this is puerto rico. it is going to slowly drift toward the west at around 15 miles per hour. make that 18 miles per hour. it will eventually make landfall. it will move over cuba to slow things down a little bit. notice as it moves across florida this isn't until monday, tuesday, wednesday next week. it will lose the characteristic as a tropical storm and becomes low pressure. but still rain and gusty winds. if you have travel plans or have family there, they will be in for a rough go for a good two or three days. here is forecast closer to home. wonderful. perfect. hardly any clouds tomorrow. we may see a pop-up shower or a thunderstorm. but don't worry about it. only 20% chance. the beach forecast shows the temperatures around 80 for

former president george w. bush dancing in a school rebuilt in the aftermath of hurricane katrina. the former president is visiting gulf coast one day ahead of the tenth anniversary of the catastrophic storm. now there were protesters during the former president's visit that didn't like the government response. in this case, that school's library was rebuilt with funs from laura bush foundation for american libraries. for many, rebuilding in new orleans was not an option. approximately half the city's population had to evacuate during the storm and never went back. d.c. bureau chief sam ford found some of those one-time evacuations who came to the d.c. area and ten years later they still call d.c. home. sam: katrina may have happened ten years ago but it's like yesterday for violet lee of maryland. >> at that time i had a 2004, two-door honda. we had eight people in that car. sam: rory now of ashburn, virginia. >> crowded with three cats, two dogs, four kids and a mom

and a dad. sam: and warren murphy who now works in d.c. but stuck on the new orleans street back then. >> they were running, scatters, left and right, trying to figure out which we way were going to go. sam: among the evacuees flown from fema to d.c. where they stayed at the d.c. armory. the women leading the families out by car remember how kind people were along the highways. >> realized he gave us four brand new tires. free. and $20. sam: for the man who told lowe there was no gasoline available in the town. >> he looked inside, saw my parents and saw the kids and went take my car. just take my car. i have a full tank of gas. wherever you can, you can return it. >> i was like no, sir. i can't do that. i can't do that to your car. sam: murphy stayed in the superdome two weeks remembers the worst. >> seeing people commit suicide, seeing what people got, the females got raped.

bitten and stayed sick. a west nile diagnosis has not yet been confirmed. the spraying will begin this coming tuesday. kimberly: a suspect is now in custody of the murder of latroya spill. hill is behind bars. smith was rapedded before she was shot and her body was set on fire. another suspect is at large and a third suspect died. jonathan: d.c. police have all hands on deck as they try to reverse a rise in violent crime. every available officer will be assigned to street patrols. there have been 103 murders in district since the beginning of the year, two less for the total of all of last year. kimberly: metro says this month's train derailment was caused by human error and equipment failure. in a report released today, metro says the fasteners failed to keep a rail from

spreading. it says an inspector had detected the problem in july but mistakenly deleted the information from his report. maryland school superintendent is resigning. she took the job in 2012 is moving on to be the president and the ceo of future ready columbus, a non-profit that focuses on early childhood education. the maryland state board of education appointed deputy superintendent jack smith to replace lowery or an interim basis. jonathan: still ahead for us here at 5:00, how community members took action after a suspicious van showed up in the neighborhood. kimberly: plus the act of kindness that has a local police officer becoming a viral star.

roz plater is there live with what we have learned. roz? roz: we are at the site where the crash happened. we are told he was an avid cyclist and killed half a mile away from home. timothy holden had a distinguished career as a captain in the navy seals and went on to serve as the director of counterterrorism and force protection for the navy. he launched a second career working as an executive for several high-tech companies. the police tell us the crash happened at 6:1524 morning and was biking eastbound on massachusetts avenue when he was struck by a car traveling in the same direction. police are still investigating how and why it all happened. his family is heart broken by the loss. >> it's an extremely difficult
