it will accelerate in the next few days and that is good. not only will it accelerate but the 125-mile-per-hour winds slowly and steadily will begin to diminish. it will move over colder water surfaces so it will diminish and be far enough offshore to have no direct effect on the weather. but what will happen i think as we head through the next couple of days we will continue to see periphery effect from the hurricane and high pressure north pound the east coast with the winds to result in beach erosion. high tide and localized flooding. we still have the concern of flash flood issues. flash flood watch until 9:00 in the morning. the rain is moving from the south all day long. but not much in the way of heavy rain. steady light rain. the best news to share with you about this is any flooding

will be localized. as we get through the late night, the overnight and the day tomorrow the heavy surges of rain coming our way will start spread back to the west. the heaviest precipitation is tonight and tomorrow. steve rudin will join me with a full outlook for the weekend and much more coming up. jonathan: i'm jonathan elias. there are tropical winds through the area. this is an angry ocean. if visibility is cut down because the rain is coming down in sheets. while folks are weathering the

storm they were concerned about hurricane joaquin. it would be a two-punch they didn't need. all the rain we have had is causing problems. not here but back bay where the inlet is. brad bell has been spending most of the day there and no problem finding flooding. he joins us live. brad? prad: it's not just the rain. what it is, that wind is pushing the water up along the islands. we are heading to low tide and i can see that the water has gone down some. but what is concerning is it is still here as we approach low side. susan has seen it before. >> i feel bad for some of the people here. i know a lot of cars need to get up to higher ground. brad: at noon, high tide.

back bay inundating neighborhood. >> you can see the by bay spilling on the street. nowhere to go. it's coming on top of us. brad: unrelenting wind pounds the ocean side of the resort. the beach now closed. you can see why. the surf whipped up and almost reaching the boardwalk. the water surging higher. prompting a warning that the flooding could match that from hurricane sandy. >> we have to be smart and be respectful of nature. >> we know tomo our cared and -- to move our cars and secure things and keep an eye on the tide charts. brad: erin fitzsimmons lives in flood zone a. the first to get wet. she watches the rising tide from her porch. so far, no evacuations are expected. fitzsimmons says with joaquin tracking farther away she

expects to be sparedded major damage. >> concern to pay attention, yes. worried? not as much as i was when the hurricane looked like it was making a b-line for us. brad: back live, there is not much people can do to prepare for the flooding. this is a little bit of something. there is a board. in front of that is a sandbag at the house. i will show you here. this is a driveway. this is dry. the water starts at the sidewalk. down on the road it is eight. is deep or so. the real concern is midnight. the next high tide is supposed to be higher than noon today. will is the fear it could be high enough to get in the structures. head back to beach for jonathan elias to look there. jonathan: it is bad. the wind is gusting. in the last hour it has kicked up 10 to 20 miles per hour.

they are worried about the smaller boat, the kayak and the canoes and the stuff you left on a dock. not secured that may wash out to shore. they can't assume. they have to check. >> we look for a person in distress. joce: that is the mission of the coast guard. a station in annapolis told abc7 they were at the ready to deal with problems on the bay. not from joaquin but from this storm that could bring storm surge and coastal flooding. they tell me they do a hundred search and rescues a year and they anticipate they could do some this weekend. just not the kind you expect. the officer in charge of station annapolis expect calls of concern from people who see what look like abandon boats in the water. kayaks and the canoes that did not get locked down in advance of the storm.

they wash to the by a and have to be responded to. they scope it out and make sure no one is in distress. >> we will figure out position. from there we do a search pattern expanding out looking for a possible person in waiter. joce: that happens even if you don't know if someone is missing. >> we come up on a floating vessel, we will search. then we come one a determination to look at the boat and see is this something that looks like it drifted offshore? there s there evidence that someone was recently on it? joce: it's better to be safe than sorry. they have to do the checks but they warned us if the weather continues to look like this. the high winds, the rough seas they may not be able to get in the water. they don't want you in here either.

and keep it on your phone. alison: moving on to the latest on the deadly shooting. on an oregon college campus. today they revealed chris harper mercer dropped out of boot catch and started to study mass shooters. lauren lister live in oregon with a closer look at the investigation. lauren? lauren: ten are dead, including the shooter. six patients remain in the hospital. abc news is learning identity of the victims today. three of the deceased women, lucera, rebecca and kim. the gunman apartment complex today guarded by police. and the residents remain on edge. >> it was scary when you first heard about the shooting but different when you found out that they live next door to you. >> a.t.f. reporting seven guns recovered from the place where he lived with his mother.

six from the place. family of the victims bracing for the worst. >> the families are currently living through the nightmare and the most personal way possible. lauren: the governor expressing pride in the community. this i'm proud of how the roseburg community pulled together to care for and comfort each other in this horrific crisis. reporter: the suspected shooter identified as 26-year-old chris harper mercer is seen here in the myspace photo. he allegedly opened fire at the umpqua community college late thursday morning. >> multiple gunshot wounds. reporter: police officers facing off with autobahnman. >> exchange shots with him. he is in a classroom. reporter: but today, tales of herorism. he charged three of the gunman trying to save who he could. he is out of surgery recovering from seven gunshot wounds in the photo from the go fund me page.

>> we are learning more about the gunman. the army confirms he served a little more than a month in basic training in 2008 before being discharged. no word on why. authorities are looking for the motive. the cool is closed. lauren lyster, abc7 news, roseburg, oregon. back to you. alison: thank you. president obama speaking out about gun control tonight. we'll take a closer look at that coming up at 5:30 today. leon: education secretary duncan is stepping down in december. duncan is one of the few member of president obama's original to be net members still in office. he sent an e-mail to the staff saying it's time for him to return to chicago with his family. the white house says that president obama has to let the deputy secretary of education dr. john king take over in duncan's position. coming up on "abc7 news at 5:00" -- pushed by the rain. look at how quickly the spill

alison: new developments tonight in one of three case against jesse matthew. today the man charged with two murder in charlottesville found out he will be spending the rest of his life in prison for another crime in northern virginia. our northern virginia pure row chief jeff goldberg was in court and live in fairfax with the story. jeff? jeff: alison, a very dramatic court hearing. the family members of morgan harrington and heather graham and jesse matthew sitting together in the first row of a

packed courtroom. in the trial in june, jesse matthew entered a guilty plea after he was implicated by d.n.a. evidence. today he got his punishment. three consecutive life sentences in prison. jesse matthew senior had nothing to say to reporters, and neither did his mother where the prosecutor detailed the attack on a woman in fairfax ten years ago saying on that night, matthew was hunting for a victim. calling him a cruel and a savage sexual predator who raped and attempted to murder the woman known as r.g. >> for him to treat r.g. in manner he did was despicable and vile. i'm glad he got three life sentences. jeff: defense attorney calling matthew kind, considerate and

shy, gentle giant. saying matthew was a victim of poverty, racism, alcoholic father and had been sexually assaulted as a child but the judge handed down the maximum punishment of three consecutive life sentences. at that moment, debra carr began screaming and crying in court. "no, no, no," she said, yelling "i hope you rot in hell" exiting the courtroom. >> there are no winners here. there is loss and pain all around. jeff: the real hero in the case, she said, was the person who testified at the trial in june. >> she did it for herself and more hannah and morgan. jeff: before handing down the sentence the judge asked matthew if he had anything to say and he shook his head and said, "no, sir." he will be spent back to charlottesville to await murder trial of hannah graham and morgan harrington to take place in 2016.

live in fairfax, jeff goldberg, abc7 news. leon: okay. thank you, jeff. update for you now. the rain here, the heavy rain calling a chemical spill in the potomac river that quickly made its way to the frederick county water intake. sunday is expected to get there. latex spill from the paper mill. the department of environment has not detected any health risks related to the spill yet but they are still conducting tests. alison: earlier, doug was telling us how this is worse than a nor'easter. what we're seeing in a lot of ways. doug: right. nor'easters last about 24 hours. with the same effects the relentless wind and the pounding surf and they move on. but this one is sustained five day of the winds at the same direction and high speed doing the rough surf and everything else. rough effects. start with hurricane joaquin. it's weaker now than it was last report. five miles per hour but it

puts us in a category three. 125-mile-per-hour winds. moving north at 7-mile-per-hour. it will accelerate slowly. water is the engine and the fall for the tropical storms. the farther north you go this time of year the water is cooler. so we aren't going to worry about the direct effects. but this will continue to feed in the busting winds to the coastline. the big effect locally, maryland, delaware, the north carolina beaches is the erosion of the sand dunes, the beach erosion. a lot of mess. the communities will have to flooding but the biggest concern is what is happening in south carolina. moisture is flowing. tropical moisture out of the hurricane into south carolina, north carolina. over the next few days the storm will move away and the moisture will come out of the tropical atlantic. enough moisture to cause flooding.

32 in annapolis. 31 in arlington. chilly temperatures. that is the story. as far as the floods, steve rudin has the story and there is a lot to tell. steve: with the heavy rain tonight and tomorrow morning we have a flash flood watch up for the d.c. metro area. this is not until 8:00. this includes the district, arlington, alexandria and fairfax. all of southern maryland until 8:00 saturday morning. show you what is going on with the live doppler radar. a wet rush hour commute. if you expect someone home on time, expect delays. the traffic is backed up quite a bit. heaviest rain north of d.c. more to come moving through the overnight hours. a bit of a lull in the action. notice across virginia. this is the break. this is going to move ahead in the next few hours. more rain to come late tonight and tomorrow morning. this is the future cast.

the rain breaking up. well west around charlotteston and ohio. for us it will settle down as we move through early morning hours tomorrow. rainfall totals as we head through the day tomorrow into sunday. around two inches in the d.c. metro. less amount toward north and west. the real jackpot area look at columbia. they could look at nine inches of rain. nearly a foot by charleston, sunday at 2:00. with the seven-day outlook. brighter skies ahead. sunday 40% chance of showers. sun makes a return on monday. lower 70's tuesday, wednesday, thursday, friday. it will feel great right now reag national airport wind chill factor in the upper 40's. leon: wow! we haven't had that since spring. doug: hopefully the rain will do exactly what steve says and move the heaviest rain out

leon: "7 on your side" consumer alert now. about 40 wal-mart employees now are out of a job. the super store laid off the employees at the headquarters in fentonville, arkansas. in a letter to unaffected ceo's blamed the changing retail and the customer landscape. they will get 60 days of pay and benefit. in addition to the two weeks of pay throughout the year they spent with the company. alison: the district department of consumer and regular la story affairs says it has no -- relatory affairs says it has no choice. they are evicts people to keep them safe. but the problem for the residents where in expensive d.c. do they find another

place to live? sam ford looks at their plight. sam: the 13 family still left in the 30-building unit are angry and worried. >> it's not right. in two weeks we will be on the street and it's getting colder. sam: they learn the city is condemning the building and they have to find other homes. the place has problems. broken windows. mailboxes that don't lock. ask the maintenance man. >> repairs are done with the sink and the toilet and stuff like that. >> they have two toddlers. >> no a.c., no heat. i have to use the tub to wash dishes. the toilet doesn't flush. >> they have deemed the building unsafe and say it must close by october 12. but the folks don't get subsidized respect. they -- subsidized rent. they are the d.c. working poor. they are paying half that and take consequences.

the storm is bringing strong rains and wind. you can see the surf of behind me. that is not a happy ocean. it's angry and kicked up. there is flooding on the inlet. on the back side they have seen the water creeping up. it has been a problem here. how long will it last and what effect will hurricane joaquin have on the area infy? the guy with the answers is the chief meteorologist doug hill who joins us from the weather center. doug: your conditions will stay like they are tomorrow, sunday and good part of monday as well. the latest information on hurricane joaquin down a bit to. top winds 125 miles per hour. all the models have taken this well out to sea. that is good news for even on the east coast. locally we have rain. good news here as well. look at the bottom of the screen. in the past 20 minutes a back edge out of the areas down i-95 toward richmond. as the rain moves through, we

will get a break from the rainfall. the next area of rain showing up is farther south in north carolina. as we get the next few hours, west of town might pick up more rain. everything is winding down. what will not wind down are the strong winds along the coast. the beach emotion. that will continue. as we get through the next couple of days we see the hurricane move out, an upper level storm system over florida. that will work with the hurricane to keep funneling more moisture in. part of south carolina may wind up between 10-14 inches of rain in the next couple of days. we have a nod watch in effect through 9:00 in the morning. it looks as though it could be dropped early. that is good news. total rain for sunday for the past couple of days between two and three inches here. feeling good about things weather wise locally. if you want good weather, we

will navigate the next couple days. by the time we get to tuesday, wednesday, thursday, sunshine and a warming trend. back to you. alison: we're getting there. thank you. by the way the weather is canceling a lot of events across the area this weekend. in virginia, the oktoberfest celebration will not be happening tomorrow. in maryland takoma park street festival is canceled. all events of grass fields are off until further notice. >> every man, woman and chld is america. how can you with a straight face make the argument that more guns will make us safer? leon: president obama making a case for gun control in the wake of a deadly shooting at oregon college campus yesterday. but tonight the big question is whether anything will happen this time around.

we had this discussion over and over in this country. seen your political report -- senior political reporter scott thuman. this is the 15th time he has spoken after a mass shooting. is there any way or reason to think this time around is different? scott: skeptics will say no and they have good reason. the president is handcuffed. it's not just a partisan issue. you have to have congress on board. the president relies on the body to pass gun control differences. the measures have to be universally liked by a lot of people. the gun lobbyists, as we know, a lot of people oppose it. the president was asked what can you do differently other than come out and make the speeches every time this occurs? this is his answer. it's interesting. president obama: i get a lot of letters after this happens. do something. okay. hear is what you need to do. you have to make sure that

anybody you are voting for is on the right side of this issue. if they're not, even if they are great on other stuff for a couple of election cycles you have to vote against them. scott: the president is saying it's up to you the voter, you have to change who represents you in congress and that is the only way to effectuate change. he talked about the republicans a lot. of course, they are blamed for a lot of the stronghold with the gun lobby. at the same time if you look what happened after sandy hook. leon: or didn't happen. scott: exactly. the president assigned a blue ribbon commission headed by joe biden to look into it. you have to capital quickly on emotion for legislation to happen. you can't wait 30 days. leon: but nothing happens quickly in this town. it's not possible. that is why there are executive orders in these things. is there are any options with the executive order on this? scott: very few. he has his team scrubbing books looking to work around

the tracking coming into line it will stay offshore. that is good news for everyone so it leaves us with the concern tonight for the possibility of flash floods. the flash flood watch remains in effect across the region and the west and the southwest until 9:00 in the morning. based on the latest tendency we noticed on radar we wouldn't be surprised if they didn't cancel part of the area out of the flash flood earlier than 9:00 in the morning. the reason is the rain has not been heavy. it has been light to moderate. there is a break developing south. that is good news. if we look farther south we have more areas of rain from the another lan tick ocean. this area of -- from the atlantic ocean. this is emanating from the western side of the hurricane but it looks to past west. so it looks like we will get period of rain tomorrow and then gusty winds and cool temperatures. we'll be doing just fine. beaches will cont
