announcer: now "abc7 news at 4:00". on your side. jonathan: we begin with danger at the diner. michelle: a hummer slams into it during the lunch rush. both catch fire. it's the silver diner in tysons. this is cell phone video from the scene. jonathan: it was immediate action trying to save the people inside that s.u.v., as you were seeing in the video. jonathan: that all happened on fletcher street in tysons. both directions were shut down while firefighters responded. kevin lewis is on the scene for us this afternoon. michelle: kevin, even more startling here, some say this was no accident. kevin: yeah, absolutely. a number of people we talk to say the driver of the hummer was a former employee of the silver diner. police tell us they have been made aware of the allegations as well but haven't confirmed them yet. take a look at the scene here. the burnt remains on the hummer remain in front of the silver diner. that is where it came to rest. we are told -- and take a look

help substantiate what i'm saying -- that the hummer ran in the front three times, hitting a man in his 70's in front entryway. we heard he had trauma to lower half of his body. at some point then the hummer started to smoke. and then orange flames were seen emitting and shooting through the roof. customers had to use a knife or some sharp object to cut the seat belt and get the driver out in time. they then dragged his body across the parking lot and pinned him down until police arrived. police then cuffed him, took him to a hospital because he had burns on his face. this was more than chaotic inside of the restaurant. this was the height of the lunch hour. we talked to a number of witnesses. here is short medley of what they had to say. >> i said, "oh, my god. this guy has just ran into the building." >> it scared me to de

would blow. he didn't stop. >> sounded like a bomb going off. people were screaming. the people next to me in the next booth fell over and passed out. kevin: fairfax county police tell us four people in total injured. the driver of the hummer, that man who was pinned up against the vehicle. the third person injured witnesses told us was one of the men trying to get the driver out of the hummer. the hummer was still moving around and one of those individuals got hurt in that process. the fourth person did not get taken to the hospital. minor injuries for that person. we are told all four people expected to survive. but i will tell you from everyone we talked to, the man pinnedded against the silver diner in his 70's, it sounded like his injuries were severe. live in tysons, kevin lewis, back to you. michelle: thank you. take a look at the video. this is the moment that police rushed a hijacked metrobus at a gas station. the driver in court in

police say keith loving took over the bus and ran over anthony payne. payne died. today, stephen tschida is outside the courthouse. those who knew payne are especially devastated because this is a man who was just doing his job when he became a victim. stephen: that is right. right now 30-year-old -- the 30-year-old charged with second-degree murder in this case, keith loving is appearing before the judge. we have video of just what went down yesterday in northeast d.c. according to charging documents which were just released investigators maintained that loving hijacked a bus with the needle-nose pliers. he went after the driver, forced the driver off. the passengers fled. he took the bus on a wild ride and stopped at a gas station where payne was working. surveillance video shows payne next to the stopped bus. they maintain that loving backed up and intentionally

to ground by a dumpster where he was working. we caught up with one of payne's friends laying flowers a it a makeshift memorial. this is what he said about his friend who was killed yesterday. >> he never bothered nobody. he always was a helper. yesterday he pumped my gas. we was talking. it's just sad. stephen: now we also learned from the charging documents that prosecutors maintain that when loving was taken to howard university hospital because of his behavior, because he had resisted arrest and was acting belligerently and angry, they took him to howard university hospital. they say they overheard loving tell medical staff there he had smoked p.c.p. and taken another drug named k2. the drugs are often linked to aberrant and violent behavior. loving is still in the courtroom. i will race down there after this and be back at 5:00 to bring you the latest. reporting live, stephen tschida, abc7 news. jonathan: there is a new snapshot on crime in schoo

shows a decline. according to the fed, 3% of students 12 to 18 years of age say they have been victims of a crime at school in 2014. 1.3 million students were suspended for a day or more for alcohol violations. this is the shocker. between 2001-2013 the number of sex crimes on campus more than doubled. what is still unclear is if that reflects increase in sexual violence or reporting of this kind of crime. michelle? michelle: closing arguments are happening right now in the murder of grace mann. the university of mary washington student killed by steven briel. he doesn't deny the murder but his legal team argues he wasn't sane at the time. north virginia bureau chief jeff goldberg reports from the fredericksburg courthouse. jeff: both the prosecution and the defense resting their cases today as we now get closer to a verdict in the murder trial of steven briel. the final witness for the defense testifying for several hours this morning, trying to build the

steven briel is not guilty by reason of insanity. u.v.a. forensic psychiatrist eileen ryan spent 12-1/2 hours evaluating steven briel and came to the conclusion he did not understand the consequences of his actions when he killed his roommate and fellow mary washington student grace mann in april of 2015. dr. ryan testifying that briel is schizophrenic and leading up to the murder his delusion and paranoia intensified. according to ryan, briel felt a group called "the organization" was trying to kill him and his three female roommates, especially grace mann were planning his murder. grace is the one that is out to kill me, he told ryan. on the day of the murder, while home alone with grace, briel said to her "why are you trying to kill me?" and grace loudly responded in disbelief and he pushed her, ultimately leading to him stranglal and killing man -- strangling and killing grace

mann. dr. ryan believed he knew the difference between right and wrong but he believes he was incas pating her to keep himself from being killed. this afternoon we heard doctor for the prosecution countering the claims of dr. ryan. he believes that steven briel was sane in the murder of grace mann. we are following the trial closely and will bring you updates on later editions of abc7 news. in fredericksburg, jeff goldberg, abc7 news. jonathan: all right, jeff. thank you very much. another gray day. a little bit of a chance for rain out there. we have seen this all week. michelle: in case you are keeping track, we are talking now a full week each day for the past seven we have seen some rain. big question now. will showers affect your ride home again? chief meteorologist doug hill now with the forecast. doug? doug: yes. back to you. we're stuck in this pattern now. the showers are not nearly as numerous as yes

area. jonathan: thank you, doug. the ntsb absolutely slamming metro for the safety practices. or lack thereof. leading up to the deadly smoke incident just outside the l'enfant plaza station in january of 2015. dozens of trains were passing through the smoke-filled tum until the yellow line train that carol gloveer was on stopped. as a result she died. brianne carter has more. brianne: patrick reagan the lawyer representing the family of carol glover, the woman who died in the smoke incident in l'enfant plaza in january of 2015 speaking to us tonight. after the ntsb issued more than 30 recommendations for not only metro but other agencies here in this city. he said he was looking for information specifically related to what was in that smoke that filled not only the tunnel but the train. while t

mr. reagan says the report is still a positive step. he said until the report was issued, the law preventing him from moving forward in this case and now he expects that all the lawyers in the case will be able to meet with a judge in a matter of days. he says then depositions could begin as early as next month. he said until the ntsb investigation was finished and the report was,, issued, they were prohibited from doing that. glover son filed a lawsuit against the transit agency. their lawyer again today saying the goal is to make metro safer. >> we are hopeful. the problem has been that safety was a last priority and not the first priority. the new head of metro i think now is appropriately placing safety at a higher level of priority than it has been placed before. so, yes, there is reason for optimism. we will have to see how it ends up translating into whether there is

with his addiction to painkillers. alison starling is at the "live desk" with the latest on the story. alison: what we have learned today is prince's representatives reached out to a renowned addiction doctor in california the day before prince died. however, a lawyer for dr. andrew cornfeld says his client couldn't immediately fly to minnesota. so, cornfeld arranged for prince to meet with a doctor in minnesota the following morning. and prince never made it. cornfeld's son who took a red eye flight to get out to paisley park was among those who found the body. there are reports the plan had been to get prince to go to california for long-term care under dr. cornfeld's supervision. >> dr. cornfeld was never able to meet prince, never talked to prince. and sadly, was not able to arrive in time. alison: investigators are still looking into whether prince died from an ov

not expected to be released for a few more weeks. at the "live desk" today, i'm alison starling. jonathan? jonathan: thanks. president obama right now is in flint, michigan, visiting the area hard hit following the water disaster. that is an effort to try to save money and the state switched over the water supply. that didn't work so well. listen in a few minute to hear what the president has to say. president obama: worried about what it means for children like her. she is worried about the future of the city and the community. so in the middle of a tragedy that should have never happened here in the united states of america, the denial of something as basic as clean, safe drinking water, this 8-year-old girl spoke out. jonathan: the 8-year-old he is talking about wrote the president a letter. remember, this was a problem for two years

behind in a revenge killing that took place in katy, texas. police say the gunman shot two people, killing one and injuring the other before he turned the gun on himself. the gunman was fired from his job this morning from night transportation. but he showed up later and shot his coworkers. michelle: many of you have friends who met through online dating, whether online or the old fashioned way, the dating scene can be risky. people might pretend to be someone they are really not. so many are turning to do-it-yourself background checks. when we are curious about someone, many of us check out social media. that is a good start. but whether you are looking for love or hiring someone to take care of a family member, social media might not be enough. >> just using a name will get you something but usually not very much. michelle: linda montgomery and her team at her private investigation firm do background checks for a living. they check social media all the time. >> so i see you have

michelle: their advice? use social media like facebook, twitter and linkedin to verify information the person told you about themselves. >> their age, towns they have lived in, any activities they have been involved in. michelle: where did they go to school? where have they worked? all information you can easily obtain in a conversation in person or online. >> you need to first determine if this person is being honest and truthful and open about themselves. michelle: but one way to dig deeper is to use an online background check service. the cost from as little as $2 to as much as $50 depending on what you request. one site intellius gets top sites with the easy to use records. it's $50. people wise has premium reports for $25 but you pay more if you want criminal records checked. >> get to know as much as you can about them before y

no rain in the metro area at the moment but give it time. there are showers south and west of washington that we are keeping an eye on. 59 at reagan national airport. east/northeasterly winds at 10. that is why i have the low clouds stuck in place. as far as the numbers across the area, cooler. average high is 72 degrees. this time of the afternoon we should be close to that. it's 63 in fredericksburg. 64 in luray. cloudy skies all over the place. we have a couple of showers. lightning strikes here north of winchester. they are headed to the northeast. we have that little cluster. this same area we had a few of these yesterday. but you notice as they move a little bit, they are diminished. southeast of winchester a storm. when farther south to the metro area and through culpeper to the foothills more showers and storms. they are drifting to the western suburbs in the next hour or so. we are in a pattern with occasional showers and an occasional do

jonathan: a practice called the number of people with breast cancer disturbing. michelle: they are seeing more people under an age than other areas. >> doctors community breast center medical director regina hampton says her youngest breast cancer patient is 26. >> we step up to the plate and make sure we service the needs of the patients because they tend to have different needs other than women that are older. >> stepping up to the plate. >> how is radiation going? >> for patients like sabrina diagnosed last july. >> sickness doesn't have an age group. it doesn't say because you're 40 let me give you cancer. >> she would know. at 26 s

chemotherapy and continues radiation. >> the hardest part for me was losing my hair. >> a bit easier with her biggest supporter, her husband of six years by her side. >> i couldn't do it without him. >> dr. hampton says typically breast cancer patients are about 60 years old. but says in this community 30% of their breast cancer patients are 50 and younger. >> it's alarming. and disturbing. these patients tend to be mostly african-american women. >> hampton says they work to give personalized treatment and says there needs to be more research, especially in more diverse communities. >> we probably don't need to get any other thing -- >> hampton says the office is the recipient of a grant from susan g. komen who allows them to offer free mammograms to women in prince george's county who are uninsure and underinsured. a program that allowed sabrina early detection and support along

s.u.v.'s, those are vehicles that belong to the fire investigators. noon today, the driver of the hummer rammed the front of the silver diner here in tysons. at one point he pinned an elderly gentleman up against the industry way to the restaurant -- entry way to the restaurant. the fairfax county police are confirming they are looking into allegation that the driver of the hummer is an exemployee who had an axe to grind against the restaurant. they are looking at this not being an accident in any shape, way, form but rather a malicious attack on his excoworkers and customers inside. live in tysons, i'm kevin lewis. back to you. jonathan: we shows you this video after a black bear yesterday. having a good time with the bird feeder. at 5:00, we have new video of this guy and what the person who shot hit has to say about him stummaling upon him in

doubling the number of takata air bags on the recall list. jonathan: "7 on your side" consumer reporter kimberly suiters joining us now. what do the drivers need to do now? we are giving warnings out and we are adding to it. kimberly: a great question. first, 40 million consumers need to take the air bag recall seriously. we are talking one in every five cars on the road. at least ten people died because of the exploding air bags and more than 100 people injured. mcclain woman you are about to see was injured by her takata air bag. hehe is -- she shared her story. she asked in 2014 how many more people need to be injured or killed before a total recall? since she asked that question, six more people have died. nissan saying the air bags were not dangerous when they installed but time wears away at them and th

warns too quickly. if you are driving with one of the recalled air bags the head of nitsa offers this advice. >> talk to the dealer. get a loaner be. in contact as much as you can. at the least, i would say the owners check every week. kimberly: if you don't know if your car is on the list, head to wjla.com. we have a link to the government site to find out for sure. back to you. jonathan: thanks. the department of homeland security is taking steps to increase security ahead of the busy summer travel season. the t.s.a. is down 6,000 screeners. federal security officials say more teams will be added but they say you can expect long lines. they recommend arriving at least two hours for domestic flights. they encourage passengers to enroll in t.s.a. precheck to help expedite the process. >> i think it is important to keep us safe. they have to really think
