unconstitutional and damaging. >> what's the irreparable harm to the state of washington? >> we had students and faculty at our state universities who were stranded overseas. we had families that were separated. we had long-time residents who could not travel overseas to visit their families without knowing that they would be able to come back. >> a decision by the appeals court is expected in the next few days. but whatever that decision says, either side will be able to appeal to the supreme court. >> while the trump administration waits for that decision, it's showing no signs of backing down on its favorite target, the news media. officials are refusing to back away from claims that some terror attacks are underreported. >> so the president and some of his surrogates had sharp words about that topic. abc's cecilia vega reports from the white house. >> reporter: president trump not backing down from his attack on the media after accusing journalists of underreporting terror attacks. >> i understand the total dishonesty of the media better than anybody. and i let people know it.

second straight all-night protest. this one against attorney general nominee jeff sessions. senator elizabeth warren sparked some outrage among republicans when she first quoted a letter by the late senator ted kennedy disparaging sessions and then she read a letter from coretta scott king. now, in that 30-year-old letter king accused sessions of trying to block blacks from voting while he was a federal prosecutor. that earned warren a rare senate rebuke for breaking a rarely quoted senate rule. a vote to confirm sessions is expected later on today. the nation's new education secretary promises to be a tireless advocate for all students. betsy devos was sworn in hours after the charter school advocate's historic confirmation vote. mike pence became the first vice president to break a tie in the voting for a cabinet nominee. two republicans joined democrats in an attempt to derail devos's nomination. there's a major cleanup effort under way in new orleans and nearby areas this morning after a swarm of t

louisiana. at least four of those storms are now confirmed but as many as seven have been reported. dozens of people were injured as a result of the high winds and heavy rain. but luckily no reports of fatalities. thousands, though, are without power right now and homes and other buildings were damaged, especially in the city's 9th ward. that's the ward hardest hit by hurricane katrina almost a dozen years ago now. louisiana's governor has issued a disaster declaration for seven parishes. and the west coast is also being battered by heavy rain and winds. in parts of the bay area there's also flooding. there have been several mudslides and rock slides as well, damaging homes and closing roads. the storms have also uprooted trees and knocked down power lines. >> so the worst appears to be over, at least for the southeast. but not for the west. >> let's get the forecast now from accuweather's cam tran. cam, good morning. >> good morning, diane and kendis. the chance for severe weather will taper off across the south and southeast today but a new storm system will be developing on the east coast and this will

produce some snowfall across the mid-atlantic states by tonight and zip into new england bringing some blizzard-like conditions there by thursday. off to the west, another storm system will be moving in, bringing heavy rainfall from seattle down to sacramento and we are looking at concerns especially across central california due to the barrage of storm systems this week. diane and kendis, back to you. >> cam, thanks. we've learned the u.s. will no longer be able to hunt down suspected terrorists in yemen. according to the "new york times" the yemeni government has withdrawn permission for special ops ground missions on its soil. the move is reportedly in response to civilian casualties from last month's u.s. raid. a navy s.e.a.l. was also killed during the operation. and in georgia three fishermen can thank the coast guard for making it off a burning boat. this happened near st. catherine's island. the fishing boat burst into flames yesterday afternoon. the coast guard crew, though, managed to airlift all three men into a helicopter and no one was hurt.

he was rushed to the hospital but died a day later. fraternity members told police the sophomore fell down the basement steps almost 12 hours earlier, around 11:00 p.m., during a party. an autopsy revealing multiple traumatic injuries due to a fall, alcohol in piazza's system. the coroner says the death appears accidental. >> certified by the dawn county coroner saturday morning that mr. piazza was pronounced dead. >> reporter: what's not clear is why no one called for help until the following morning. piazza's family is remembering a vibrant young man. his brother mike writing on facebook that tim's sole mission in life was to make other people smile. penn state has suspended the fraternity. the fraternity says they are cooperating with police and are hopeful that surveillance cameras inside the house will shed light on how this tragedy unfolded. eva pilgrim, abc news, state college, pennsylvania. >> our thanks to eva. and moving on now, a dallas teacher says her past with
