9th circuit court of appeals against reinstating president donald trump's temporary ban on immigrants and travelers from seven predominantly muslim nations. >> the judges did their jobs carefully and well and we appreciate their work. >> reporter: the three judges upheld a halt to the ban stated by a washington state court which claims the executive order that stranded families at airports and forced others to be turned away discriminated on the basis of religion and violated the constitution. the appeals court heard that argument and that of the justice department which maintained the order was made on national security grounds. the judges wrote in their decision the government has pointed to no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the united states. rather than present evidence to explain the need for the executive order, the government has taken the position that we must not review its decision at all. we d

and an investigation is under way after a tractor-trailer plunged off the chesapeake bay fwlij virginia killing the driver. the man actually survived the impact and managed to climb out of the water onto the trailert of the rig where he was rescued by a navy helicopter crew who happened to witness it but he died on the way to the hospital. the coast guard says high winds thwarted initial rescue attempts and may have been a factor in the crash. the storm disrupted travel nationwide. nearly 4,000 flights were canceled yesterday. more than half of them involving the boston and new york airport 37z we saw a ripple effect nationwide. that will continue into the weekend with more flights canceled today. in the west, another home has fallen victim to the relentless storms pounding california. a mudslide in the bay area slammed into a home for a second time this week delivering the knockout punch. the residents are not allowed in obviously even to retrieve their possessions. because more mud

ready to go. >> the pressure that this hillside is putting on this house is just, it's phenomenal how much mother nature can push around things that are in its way. >> the residents were inside the house during the mud slides and had to crawl their way out you have there. can you imagine? no one was injured though. the heavy rains have also caused flooding in northern california. breaking overnight, two borkers injured and another missing after a pipeline explosion in louisiana. authorities say workers were cleaning a 20-inch phillips 66 pipeline when that fire started. and it's now the 30 to 40 feet high. 60 homes near the fire have been evacuated. fire crews plan to let the fire burn off which could take anywhere from several hours to several days. and penn state university is banning alcohol at fraternity and sorority parties following the death of a 19-year-old sophomore during a fraternity party last week. police say members of the beta ei

fraternity waited at least 12 hours before calling for help after the victim fell down the stairs. it has been suspended as a tack force investigates the incident as well as allegations of hazing, sexual assault and other misconduct. a man in mississippi in custody suspected of robbery is in bigger trouble now. here's why. three minnesota state troopers didn't just chase down a speeding suspect, they saved his life after driving 100 miles an hour, the suspect's car went off the ramp in minneapolis and rolled over and burst into flames. now, the cops as you can see there pulled the suspect out to safety. for one of the troopers it was his first day on the job. all three were given awards for this rescue. turning to politics, kellyanne conway is under fire for a potential breach of ethics. >> after the president blasted nordstrom for dropping his daughter's clothing line conway went on tv urging people to buy ivanka's stuff. now congress is
